W O� j� g3aIIage e41 6g�g S 33 Nag n� Ig MHHE MRi 3 s F€f ar �• 5�y 's'ggY a 3a g.Ra � i a g o 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 201212013 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1035, ZONE 1 3 AND ZONE 2, LANDSCAPING MAINTENANCE DISTRICT, PALM AVENUE AND 4 MEYERS ROAD AREA- 5 WHEREAS, by Resolution No. 2004-370, the Mayor and Common Council found 6 that the public interest, convenience, and necessity required the formation of a landscaping 7 maintenance district; and N N 8 WHEREAS, by said Resolution No. 2004-370, the Mayor and Common Council N ad 9 M 10 formed an assessment district known as Assessment District No. 1035,Zone I and Zone 2, for in a 11 the purpose of providing landscaping maintenance in the Palm Avenue and Meyers Road area N r 12 pursuant to the provisions of Chapter 12.90 of the San Bernardino Municipal Code;and 13 WHEREAS, by Resolution No.2004-294,the Mayor and Common Council declared .w 14 that all the land included within the boundaries of said district receive a special benefit by the s 15 16 maintenance of said landscaping except for those portions, if any, set forth as a General c 17 Benefit in the Engineer's Report approved by said Resolution No. 2004-370, on file in the c 18 Office of the City Clerk and the City Engineer of said City; and w at 19 WHEREAS, said Resolution No. 2004-294, declared that an annual assessment shall c E 20 be levied on all land within the district to provide funding for said landscaping and 21 a maintenance and the administration thereof, and 22 23 WHEREAS, an Assessment Roll has been prepared totaling $12,765.30 for Zone 1 24 and 1S .662.70 for Zone 2, which sets forth the individual assessments to be levied on each of 25 the parcels of land within Assessment District No. 1035, Zone 1 and Zone 2, for the fiscal 26 year 2012/2013;and 27 28 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2012/2013 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1035, ZONE 1 AND ZONE 2, LANDSCAPING 2 MAINTENANCE DISTRICT,PALM AVENUE AND MEYERS ROAD AREA. 3 WHEREAS,the Assessment District was created pursuant to the provisions Of Article 4 5 XHI D of the California Constitution,which provides for the levying of annual assessments 6 without the necessity Of following the assessment ballot procedures as long as said 7 assessments do not exceed any prior approved assessment or the methodology of applying 8 assessments is not changed or rates are not increased. at1 N 9 BE IT RESOLVED BY TIRE MAYOR AND COMMON COUNCIL OF THE o 10 CITY OF SAN BERNARDINO AS FOLLOWS: o a 11 SECTION 1. That the Mayor and Common Council do hereby find and determine N 12 that the assessments as set forth on said Assessment Roll No. 1035, Zone 1 and Zone 2, .. 13 comply with the procedural requirements of Article XIII D of the California Constitution a 14 d without the necessity of following the assessment ballot procedures as set forth therein. 15 M 16 SECTION 2. That the Mayor and Common Council do hereby find and determine o a 17 that the proportionate costs to be levied against the parcels of land within Assessment District `o 18 No.1035, Zone 1 and Zone 2,are correctly set forth on Assessment Roll No. 1035,Zone 1 and d 19 Zone 2, for the fiscal year 2012/2013, on file in the office of the City Clerk of the City of San 20 E Bernardino, and do hereby confirm said assessments. 21 > a 22 SECTION 3.
