I II a •� _ ® ® ®^. i� sl EE © M s� i -ate 1� -1• � ,i i." °, i• � L;�,� _ � _ �, � ,,_� -"�`� e, ' 'e 1 11-1*ir I RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2012/2013 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1022, ZONE 1, 3 ZONE 2 AND ZONE 3, LANDSCAPING AND STREET LIGHTING MAINTENANCE 4 ASSESSMENT DISTRICT, SBIAA/ALLIANCE CALIFORNIA AREA. 5 WHEREAS, by Resolution No. 2006-260, the Mayor and Common Council found 6 that the public interest, convenience, and necessity required the formation of a landscaping and street lighting maintenance assessment district; and N m 8 WHEREAS, by said Resolution No. 2006-260, the Mayor and Common Council N 9 N 10 formed an assessment district known as Assessment District No. 1022, Zone 1, Zone 2 and o 0 11 Zone 3, for the purpose of providing landscaping and street lighting maintenance in the a 12 SBIAA/Alliance California area pursuant to the provisions of Chapter 12.90 of the San 13 Bernardino Municipal Code; and c -- 14 WHEREAS, by Resolution No. 2006-91, the Mayor and Common Council declared >MA oar 15 N that all the land included within the boundaries of said district receive a special benefit by the g 16 17 maintenance of said landscaping and street lighting except for those portions, if any, set forth 0 18 as a General Benefit in the Engineer's Report approved by said Resolution No. 2006-260, on S 'o N 19 file in the Office of the City Clerk and the City Engineer of said City; and fY 20 WHEREAS, said Resolution No. 2006-91, declared that an annual assessment shall E L 21 22 be levied on all land within the district to provide funding for said landscaping and street a 23 lighting maintenance and the administration thereof; and 24 WHEREAS, an Assessment Roll has been prepared totaling $57,081.33 for Zone 1, 25 $26,690.99 for Zone 2 and$15,542.28 for Zone 3, which sets forth the individual assessments 26 to be levied on each of the parcels of land within Assessment District No. 1022, Zone 1, Zone 27 2 and Zone 3, for the fiscal year 2012/2013;and 28 PacketPg. 1200 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2012/2013 ASSESSMENT .._. 1 ROLL FOR ASSESSMENT DISTRICT NO. 1022, ZONE 1, ZONE 2 AND ZONE 3, LANDSCAPING AND STREET LIGHTING MAINTENANCE ASSESSMENT DISTRICT, SBIAA/ALLIANCE 2 CALIFORNIA AREA. 3 4 WHEREAS, the Assessment District was created pursuant to the provisions of 5 Article XIII D of the California Constitution, which provides for the levying of annual 6 assessments without the necessity of following the assessment ballot procedures as long as 7 said assessments do not exceed any prior approved assessment or the methodology of m 8 N 9 applying assessments is not changed or rates are not increased. N N N 10 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 11 CITY OF SAN BERNARDINO AS FOLLOWS: °a N 12 SECTION 1. That the Mayor and Common Council do hereby find and determine 13 that the assessments as set forth on said Assessment Roll No. 1022, Zone 1,Zone 2 and Zone 0 14 3, comply with the procedural requirements of Article XIII D of the California Constitution > 15 without the necessity of following the assessment ballot procedures as set forth therein. o 16 17 SECTION 2. That the Mayor and Common Council do hereby find and determine c 0 18 that the proportionate costs to be levied against the parcels of land within Assessment District ._ 0 N 19 No.1022, Zone 1, Zone 2 and Zone 3, are correctly set forth on Assessment Roll No. 1022, W 20 `m Zone 1, Zone 2 and Zone 3, for the fiscal year 2012!2013, on file in the office of the City E r 21 Clerk of the City of San Bernardino, and do hereby confirm said assessments. a 22 23 SECTION 3.
