MILL.k DALLAS AREA 9704 LEGEND LANDSCAPING MAINTENANCE SKET 1 6 ASSESSMENT DISTRICT BOUNDARY = .._._._ ASSESSMENT DISTRICT I SKM 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2012/2013 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1020, 3 LANDSCAPING MAINTENANCE DISTRICT, MILL STREET AND DALLAS 4 AVENUE AREA. 5 WHEREAS, by Resolution No. 97-300,the Mayor and Common Council found that 6 the public interest, convenience, and necessity required the formation of a landscaping 7 maintenance district; and 8 WHEREAS, by said Resolution No. 97-300, the Mayor and Common Council 9 formed an assessment district known as Assessment District No. 1020 for the purpose of o 10 11 providing landscaping maintenance in the Mill Street and Dallas Avenue area, pursuant to the a a 12 provisions of Chapter 12.90 of the San Bernardino Municipal Code; and 13 WHEREAS, by Resolution No. 97-251, the Mayor and Common Council declared o 14 0 that all the land included within the boundaries of said district receive a special benefit by the 15 0 16 maintenance of said landscaping, except for those portions, if any, set forth as a General m 17 Benefit in the Engineer's Report approved by said Resolution No. 97-300, on file in the Office 1:X 18 of the City Clerk and the City Engineer of said City; and E L u 19 WHEREAS, said Resolution No. 97-251 declared that an annual assessment shall be a 20 levied on all land within the district to provide funding for said landscaping maintenance and 21 the administration thereof; and 22 23 WHEREAS, said Resolution No. 97-251 preliminarily approved the Engineer's 24 Report and Resolution No. 97-300 finally approved said Engineer's Report for said 25 Assessment District No. 1020;and 26 WHEREAS, by Resolution No. 2000-208 a Modified Engineer's Report was 27 approved determining that a certain portion of the costs of maintenance within said district 28 PacketPg. 7794 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2012/2013 ASSESSMENT 1 ROLL FOR ASSESSMENT DISTRICT NO. 1020,LANDSCAPING MAINTENANCE DISTRICT,MILL 2 STREET AND DALLAS AVENUE AREA. 3 4 shall be a general benefit not assessable to said district, as set forth therein, and is on file in 5 the office of the City Clerk of said City; and 6 WHEREAS, an Assessment Roll has been prepared totaling $3.176.03, which sets 7 8 forth the individual assessments to be levied on each of the parcels of land within Assessment 9 District No. 1020 for the fiscal year 2012/2013 pursuant to said Modified Engineer's Report; 10 and o a 11 WHEREAS, the Assessment District was created pursuant to the provisions of a a 12 Article XIII D of the California Constitution, which provides for the levying of annual 13 e assessments without the necessity of following the assessment ballot procedures as long as 14 °a 15 said assessments do not exceed any prior approved assessment or the methodology of .2 16 applying assessments is not changed or rates are not increased. o N d BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE � 17 .. CITY OF SAN BERNARDINO AS FOLLOWS: m 18 s u 19 SECTION 1. That the Mayor and Common Council do hereby find and determine 20 that the assessments as set forth on said Assessment Roll No. 1020 are equal to or less than 21 any prior approved assessments and comply with the procedural requirements of Article XIII 22 D of the California Constitution without the necessity of following the assessment ballot 23 procedures as set forth therein. 24 25 SECTION 2. That the Mayor and Common Council do hereby find and determine 26 that the proportionate costs to be levied against the parcels of land within Assessment District 27 No. 1020 are correctly set forth on Assessment Roll No. 1020, for the fiscal year 2012/2013, t` 28 on file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm Packet Pg. 1195 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2012/2013 ASSESSMENT 1 ROLL FOR ASSESSMENT DISTRICT NO. 1020,LANDSCAPING MAINTENANCE DISTRICT,MILL STREET AND DALLAS AVENUE AREA. 2 3 said assessments. 4 5 SECTION 3.
