R - � u � | ! i § § ƒƒl lit `67X » / § ■ ��l �; z 3s 2 � A | § [ � a%7 � ! � � - { ]Tj , � p-4 \ ��mt 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2012/2013 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 962, 3 SEWER LIFT STATION MAINTENANCE DISTRICT,PINE AVENUE AREA. 4 WHEREAS,by Resolution No. 84-523, the Mayor and Common Council found that 5 6 the public interest, convenience, and necessity required the formation of a sewer lift station ,7 maintenance district;and 8 WHEREAS, by said Resolution No. 84-523, the Mayor and Common Council 9 formed an assessment district known as Assessment District No. 962 for the purpose of 10 providing maintenance of a sewer lift station in the Pine Avenue area, pursuant to the 11 provisions of Chapter 12.90 of the San Bernardino Municipal Code;and N 12 WHEREAS, by Resolution No. 84-487, the Mayor and Common Council declared 13 14 that all the land included within the boundaries of said district receive a special benefit by the a 15 maintenance of a sewer lift station; and .' 16 ° WHEREAS, said Resolution No. 84-487 declared that an annual assessment shall be d 17 levied on all land within the district to provide funding for said maintenance of a sewer lift E 18 r station; and 19 a 20 WHEREAS,by Resolution No. 87-7,the Mayor and Common Council declared that 21 the public interest and necessity required the amendment of the boundaries of the District by 22 expanding the boundaries thereof to include additional territory in the District; and 23 WHEREAS, an Assessment Roll has been ared totaling 20 PreP g7 .20 which sets$ 9 . 24 25 forth the individual assessments to be levied on each of the parcels of land within Assessment 26 District No. 962 for the fiscal year 2012/2013; and 27 WHEREAS, Article XIII D of the California Constitution requires that any and all © 28 Assessment Districts existing on the effective date of said Article XIII D shall comply with Packet Pg. 1150 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2012/2013 1 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 962, SEWER LIFT STATION 2 MAINTENANCE DISTRICT,PINE AVENUE AREA. 3 the procedural and approval process as set forth in Section 4 of said Article XIII D, except as 4 set forth in Section 5 therein. 5 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 7 8 SECTION 1. That the Mayor and Common Council do hereby find and determine 9 that the assessments as set forth on said Assessment Roll No. 962,are hereby exempt from the 10 procedural and approval requirements of Article XHI D of the California Constitution, as 11 provided for under Section 5(a)of said Article XIII D, and that the assessment amounts as set a' 12 forth on said Assessment Roll are equal to or less than any y prior approved assessments. ... 13 SECTION 2. That the Mayor and Common Council do hereby find and 14 °a 15 determine that the proportionate costs to be levied against the parcels of land within `o S 16 Assessment District No. 962 are correctly set forth on Assessment Roll No. 962, for the fiscal v 17 year 2012/2013, on file in the office of the City Clerk of the City of San Bernardino, and do d E 18 hereby confirm said assessments. 19 SECTION 3.
