B 4aJ®• x.... wa4 _ MMIE E/� nrA cip mO�yF®�' u®8S W ° E=M '^STM_ET p ® B y ¢ w A N &® SO ® t�O ! oaTFwT '• .wXO!m �'UIE F S � 7.Xb 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2012/2013 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 997, 3 LANDSCAPING MAINTENANCE DISTRICT, CHESTNUT AVENUE AREA. 4 WHEREAS, by Resolution No. 90-381, the Mayor and Common Council found that 5 the public interest, convenience, and necessity required the formation of a landscaping 6 7 maintenance district;and 8 WHEREAS, by said Resolution No. 90-381, the Mayor and Common Council 9 formed an assessment district (mown as Assessment District No. 997 for the purpose of 10 providing landscaping maintenance in the Chestnut Avenue area,pursuant to the provisions of v 11 a Chapter 12.90 of the San Bernardino Municipal Code; and a 12 WHEREAS, by Resolution No. 90-338, the Mayor and Common Council declared 13 14 that all the land included within the boundaries of said district receive a special benefit by the a C is maintenance of said landscaping; and °- 0 16 WHEREAS, said Resolution No. 90-338 declared that an annual assessment shall be 17 levied on all land within the district to provide funding for said landscaping maintenance and E is the administration thereof; and 19 a 20 WHEREAS, an Assessment Roll has been prepared totaling $5,667.0 7, which sets 21 forth the individual assessments to be levied on each of the parcels of land within Assessment 22 District No. 997 for the fiscal year 201212013;and 23 WHEREAS, Article XIII D of the California Constitution requires that any and all 24 25 Assessment Districts existing on the effective date of said Article XIII D shall comply with 26 the procedural and approval process as set forth in Section 4 of said Article XIII D, except as 27 set forth in Section 5 therein. `.. 28 PacketPg: 1135 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 201212013 ... 1 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 997, LANDSCAPING MAINTENANCE 2 DISTRICT,CHESTNUT AVENUE AREA. 3 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 4 CITY OF SAN BERNARDINO AS FOLLOWS: 5 SECTION 1. That the Mayor and Common Council do hereby find and determine 6 that the assessments as set forth on said Assessment Roll No. 997 are hereby exempt from the 7 procedural and approval requirements of Article XIII D of the California Constitution, as 8 9 provided for under Section 5(a) of said Article XIII D, and that the assessment amounts as set 10 forth on said Assessment Roll are equal to or less than any prior approved assessments. 11 SECTION 2.
