Motion: Close hearing; and adopt Resolution. Synopsis of Previous Council Action: On January 23, 2012, the Mayor and Common Council set a public hearing for the rate increase for the March 19,2012. �•/ On January 11, 2012, the Ways and Means Committee recommended setting a date for public hearing for the rate adjustments. On September 20, 2010, the Mayor and Common Council approved Resolution 2010-327, authorizing the execution of a memorandum of understanding with the San Bernardino Municipal Water Department for Integrated Waste Management Billing and Collection Services. On September 20, 2010, the Mayor and Common Council approved Resolution 2010-328, authorizing the establishment of additional fees for the Integrated Waste Management Division and authorizing the San Bernardino Municipal Water Department (IWMD) to bill, collect and take any necessary actions on IWMD delinquent accounts, which has all applicable language incorporated into this new Resolution. On November 17, 2008, the Mayor and Common Council approved a resolution establishing the ® fees and rates to be charged for the collection of refuse, green wastes and recyclables, and i i..A...e.l.I/I ANNO L.. A.A.. T1:11e Daoa 1 1584 repealed resolution 2004-239. BACKGROUND The Department of Public Works manages the Integrated Waste Management (IWM) enterprise fund. Each year, this fund is evaluated to ensure that it is operating efficiently and with appropriate liquidity. If this fund is not solvent, it is the department's obligation to make recommendations on how to address the financial shortfalls and bring solutions forward to the Mayor and Common Council. A review of the IWM fund determined that the fund is facing an approximate $1.4 million shortfall by the end of this current FY 2011-12 (See pg. 4 of attached presentation). This shortfall can be attributed to many factors such as declining collection revenues and increased operational costs. ANALYSIS In fiscal year 2008-2009, the City was faced with a previous IWM fund deficit, resulting in the Mayor and Common Council's approval of a rate increase on November 17, 2008, (Resolution 2008-433) with an effective date of January 1, 2009. Also, in 2009, the City contracted with Matrix Consulting Croup (Matrix) to conduct a management study of the IWM Division to help increase efficiencies and reduce operational costs. The study involved a comprehensive organization and management analysis of IWM's operations, service levels, management practices, and staffing levels. One of the primary recommendations provided in the Matrix report was to conduct a "Cost-of-Service" study for the solid waste collection services and to prepare a"Five-year" financial plan for this service. In order to accomplish these tasks, on September 7, 2010, (Resolution 2010-297)the Mayor and Common Council authorized R.W. Beck, Inc., to complete an Integrated Waste Rate Study. In addition to this study, the City also initiated a Cost Allocation Plan (CAP) in March of 2011. The thorough CAP identified additional costs for the IWM Division which were not included in the initial rate study. As a result, Public Works commissioned additional rate scenarios with R.W. Beck, Inc., to account for the increased financial obligations for this fund. The results of the last rate study indicated a need for an immediate rate adjustment because the current rates for recycling, refuse, and green waste collections are insufficient to meet current and future financial obligations and operational costs. R.W. Beck, Inc. created multiple rate scenarios. However, they have reduced them to the following four options (See attached Summary of Options): Option I is the "Status Quo Option." hi this option, the Integrated Waste Fund will face a$20.4 million shortfall by the end of FY 2015-16 (See pg. 5 of attached presentation). Pros:No rate increase Cons: Severe program cuts such as the elimination of the Right-of-Way and Graffiti programs, and a reduction of street sweeping from twice to once per month. Packet Pg. 600 1584 Option 2 establishes a 13 percent or $2.97 rate increase for residents for the I ' year and subsequent increases every January 2013, 2014, 2015 and 2016 of three (3) percent, two (2) percent,two (2)percent and two (2)percent, respectively(See pg. 6 of attached presentation). Pros: No program cuts. Establishes a new street sweeping fee and creates a $4.3 million reserve by FY 2015-16. This will allow the IWM Division to purchase refuse vehicles instead of leasing them to save tens of thousands of dollars in interest charges. Cons: A 13 percent or$2.97 rate increase the fast year. Option 3 establishes a five(5)percent or$1.14 rate increase for residents the I'year and five(5) percent every January 2013, 2014, 2015 and 2016(See pg. 7 of attached presentation). Pros: No program cuts. This option has the lowest financial impact to the residents by spreading out the rate increase more evenly, establishes a new street sweeping fee, and creates a modest$1.1 million reserve by end of FY 2015-16. Cons: A $478,200 fund deficit will remain at end of FY 2011-12 and temporary salary savings will be used to cover the budgetary shortage. Option 4 establishes a 13 percent or $2.97 rate increase for residents in the Is` year and subsequent increases every January 2013, 2014, 2015, and 2016 of three (3) percent, three (3) percent,three(3)percent and two (2)percent respectively(See pg. 8 of attached presentation). Pros: No program cuts. Establishes a new street sweeping fee and creates a $5.5 million reserve by end of FY 2015-16. This will allow the IWM Division to have a standard three to six month of operational costs in reserves, purchase refuse vehicles instead of leasing them. Cons: A 13 percent or$2.97 rate increase the first year. In compliance with Article XIIID of the California State Constitution and the Proposition 218 Omnibus Implementation Act, a public hearing was set 45 days after the notice for the rate increase was mailed out to all customer of records and parcel owners. The notice described the date, time, and place for the hearing and provided an explanation of the proposed increases. It is recommended that noticing be completed to allow the public hearing to be set for March 19, 2012, at 4:00 PM in the City Council Chambers. In the event the new rates are approved on March 19, 2012, then a notice of rate adjustment would be mailed to all customers in March and the new rates would become effective April 1,2012. FINANCIAL IMPACT In order to address the Integrated Waste Fund's deficit of approximately$1.4 million, the Public Works Department recommends the implementation of Option 3 (See Attachment "1"). This option proposes an increase of five (5) percent for the first year and a five (5) percent increase iL.d..wA.]/IA/OON 1... A..d.e..T«.d.. TA:IIe. Denn] I 1584 for the following four (4) years, with an effective date of April 1, 2012. If approved, the new rate for residential collections will increase from $22.84 to $23.98 per month ($1.14 per month increase). Commercial collection rates have numerous variations and are based on the number of and types of collections per week. In addition to an increase in the refuse rates, Public Works also recommends the implementation of a new street sweeping fee. Currently, the cost of this operation is being absorbed by the IWM fund. The Matrix Consulting Group recommended that this operation become a financially self- sustaining City program. The proposed street sweeping fee will be $1.73 for residents and $5.06 for commercial businesses per month effective April 1,2012. RECOMMENDATION That the hearing be closed, and the Resolution be adopted. Each automated collection customer 19 may be permitted to receive an additional 96-gallon automated cart generally color coded m 20 21 black for refuse, blue for commingled recyclables and green for green wastes for the S N 22 following rate: d E 23 Additional black cart $13.62 per month z 24 Additional blue cart $11.92 per month 25 Additional green cart $11.92 per month 26 I 27 Said additional cart charge shall be added to the regular monthly charges set forth in 28 SECTION 3 of this resolution. �I © It shall be the responsibility of the automated collection customer to maintain their 1 2 carts in a clean and sanitary manner and to secure their carts when not placed out for 3 collection. In the event that an automated collection customer requests that a cart be replaced 4 due to willful negligence, or destruction of the cart due to an act by the customer or if a cart is 5 m reported stolen, the customer may be charged a $78.49 replacement fee for each cart and may •� d 6 be requested to submit a police report for their missing container subject to the determination ;: m 7 rc 8 of the Director of Public Works or his/her designee. d 9 M 10 SECTION 5. Collection of Refuse, Green Wastes and Recyclables — Automated m N 11 Residential Collection Services — Mobile Home Parks Not Receiving Automated Green 3 v d 12 Wastes Services. The standard service level unit for automated collection rendered in mobile 2 13 m home parks which do not receive green wastes service shall be defined as the provision to c 14 15 each individual occupied coach or residential unit, two City owned 96-gallon automated carts, C 16 generally color coded black for refuse and blue for commingled recyclables. Services are 'o 17 rendered once per week, on said collection day as determined by the Director of Public Works d 18 or his/her designee. Said service is and shall be subject to all requirements set forth in d 19 Chapters 8.24 and 8.25 of the San Bernardino Municipal Code, as well as other applicable d 20 21 County, State or Federal laws or regulations. N 22 The rate per individual occupied coach or residential unit shall be$16.00 per month. d E 23 The total amount due for collection services rendered within each mobile home park 24 a shall be the total number of occupied spaces for which the mobile home park's owner or 25 authorized agent is collecting rent. It shall be the mobile home park owner or authorized 26 27 agent's responsibility for coordinating service establishment between the mobile home park 28 tenant and the City. It shall be the mobile home park owner or authorized agent's ME responsibility to report to the Water Department Customer Service Department on the fifth 1 2 business day of each month, the total number of occupied spaces within the park for the 3 previous calendar month. Payment for the total amount for collection services rendered 4 within a mobile home park shall be the responsibility of the mobile home park owner or 5 authorized agent upon submission of an invoice. Nothing in this section shall preclude the •� d 6 owner or authorized agent of a mobile home park from individually billing or otherwise m 7 8 collecting reimbursement from the tenants located in the mobile home park for the collection E m 9 services provided. m 10 11 SECTION 6. Collection of Refuse, Green Wastes and Recyclables — Manual 3 v d 12 Collection Services for Small Businesses. This service level unit shall be offered to any 13 small business which, in the determination of the Director of Public Works or his/her designee c 14 15 is unable to receive either automated collection service or front load collection services M 16 because of either a lack of volume or inaccessibility to the business by either the front-load .2 0 17 collection truck or the automated collection truck, or if manual collection services is required m 18 temporarily. 19 This rate shall be $114.11 per month for once per week service. Additional services 20 21 per week shall be charged by multiplying the rate of$114.11 per month by the total number of S N 22 days per week of service required. d E 23 Services are rendered on said collection day as determined by the Director of Public s 24 Works or his/her designee. Collection of Refuse, Green Wastes and Recyclables—Commercial, 1 2 Multiple Family Residential, Professional and Industrial Accounts — Service 3 Establishment and Deposits. The owner or authorized agent shall contact the City of San 4 Bernardino Public Works Department, Integrated Waste Management Division in order to 5 establish commercial refuse, green wastes or recyclables collection service at a lawfully •� m 6 established business or service address within the City. The owner or authorized agent shall « A 7 8 execute an Application/Receipt for Solid Waste Services with the City, which provides all E m 9 necessary billing and service information. 10 A $25.00 account initiation fee shall be charged to all new customers. A deposit in the w 11 amount of$172.50 or the first month's estimated cost of service, whichever is greater, for 3 v 12 each new account shall be made at the time that the Application/Receipt for Solid Waste W 13 Services is completed. Said deposit must be received prior to commencement of services. c 14 �• 15 This deposit shall be retained by the City and applied to any closing bill upon termination of c 16 services. Any amount of deposit in excess shall be refunded. 0 17 In the event that collection service has been discontinued for non-payment, the City m m 18 may require a $25.00 account initiation fee and payment of said non-paid bill and a security d 19 deposit equal to three times that average monthly service for all billed services before service m 20 21 will be restored. All payments on the day service stopped must be in the form of cash, S N 22 cashier's check, money order or credit card only. All payments after the account is shut off m E 23 must be in the form of cash, cashier's check, money order or credit card only. The City of San Bernardino shall provide front load bin service to all lawfully 3 5 established service addresses in which the owner or authorized agent has either 6 entered into a Service Contract with the City to provide said service, or who ; 7 has historically received City service. The City may provide front load bin m 8 E a 9 service ranging in size from 2-cubic yard to 6-cubic yard, and frequency of c m 10 service from one day per week to six day per week in order to meet the refuse, m m 11 recyclables and green waste service needs of the customer. Said service is and 3 9 12 shall be subject to all requirements set forth in Chapters 8.24 and 8.25 of the 13 San Bernardino Municipal Code, as well as other applicable County, State or 14 15 Federal laws or regulations. c 16 B. Any customer who is receiving six-day per week collection service and is not 2 0 17 serviced six times during any calendar week due to a Federal, State or Locally m z 18 declared holiday in which the City Integrated Waste Management Division d 19 does not operate, shall not be entitled to a credit to their account for the missed .2 20 21 day of service. c N 22 C. It is the responsibility of the owner or authorized agent to provide an adequate m E 23 and appropriate location for the safe and proper storage of refuse, recyclables m 24 or green wastes bins while on the owner or authorized agent's property, and to 4 25 clean, repair and maintain all refuse bin enclosures or compactors in order to 26 27 reduce, prevent and eliminate all potential health, safety or code violations and 28 in accordance with established City standards. The Director of Public Works I I IMEM 7.C.d or his/her designee shall have the authority to impose an administrative fee of 1 2 $52.50 per service day to an individual service address in the event that 3 collection at the service address poses a health risk, safety hazard or danger to 4 employees or the public and is not corrected within ten (10) business days of 3 5 written notice to the owner or authorized agent of the property. a 6 D. The Director of Public Works or his/her designee shall have the authority to 7 8 suspend refuse service for the failure to pay any delinquent payment balances d E N 9 due the City by the customer within thirty (30) calendar days, of written notice c m 10 to the owner or authorized agent of the property. The City of San Bernardino shall offer the following specialized v 19 ° c services using Front Load Bins for split bins, residential clean-up specials or temporary bin v 20 21 service to all service addresses located within the City: c r 22 Temporary Bin Service. A temporary bin service shall be defined as a three- or d E 23 four-yard front load refuse bin which is provided to a residential customer for a maximum of m 24 seven (7) calendar days from date of bin delivery for use by a resident for clean-up purposes. a 25 The bin shall be placed in the public street at the curb in front of the address for use by the 26 27 customer. The temporary bin service rate includes one collection of the material in the 28 container. Additional services may be provided upon pre-payment during the seven day 7.C.d period at the same rate per bin size as set forth in Section 10, subject to available personnel 2 and equipment. 3 The rate for each temporary bin service shall be$72.45. 4 Bin Roll-out Service. Bin Roll-out service is provided in those instances in which 5 d either the bin placement at the service address is not accessible to a front-load refuse track and •� d 6 requires the assistance of a second service vehicle, or is located in such a manner as to require m 7 8 the bin to be manually rolled out and placed back into a permanent position. The 13 d 14 overweight charge shall be calculated by multiplying the number of tons over the ton limit by S 15 the current County of San Bernardino Waste Systems Division tipping fee as set forth in c 16 accordance to the terms and conditions of the Waste Delivery Agreement between the City °- S 0 17 and the County of San Bernardino, plus a $12.60 per ton overweight penalty fee and $38.57 a rc 18 w per ton overweight fee. This additional charge shall be billed to the customer, and shall be d 19 due and payable immediately. d 20 21 In the event that the Director of Public Works or his/her designee determines that a bin N 0 N 22 is so overweight that the safe movement of said bin would not be feasible, it shall be the d E 23 responsibility of the customer to reduce the weight of the bin to an acceptable level at the m s 24 customer's own cost. In the event that the customer does not reduce the weight of the bin to a 25 safe level within 5-days of receipt of a red-tag, the City may perform the clean-up services 26 27 required to safely dispose of all material to be billed at a rate of$38.04 per fifteen minutes, as © 28 established in Section 16"Clean-up Service"of this Resolution. I I IMME Standing or Roll-back Charge. A $142.49 standing or roll-back charge shall be 2 charged under the following circumstances: 3 1) When a red tag was issued for either a roll-off or compactor which, as a result of 4 customers action or inaction, prevented the City from providing service to the bin 5 3 when the collection truck arrived at the location and which situation was not 6 corrected by the customer in less than fifteen (15) minutes with the truck present w 7 8 in order for the City to render service; E 9 2) When a customer cancels a previously scheduled service in which the truck is n c n 10 already en route to the location or has arrived at the location; or v m 11 3) A request by the customer to stand-by at the customer's location for a period in 3 12 excess of fifteen(15)minutes,but not to exceed one hour. 13 14 4) Stand-by time after the first hour shall be charged at the rate of$142.49 per hour. 15 Compactor Cleaning. The City shall provide at the customer's request, a cleaning c 16 service for compactors that are serviced by the City. Said compactor shall be brought to the 2 0 17 City Yard, steam cleaned and returned to the customer's location. The compactor steam 18 cleaning charge shall be$140.01 plus any other applicable rates established in this Resolution. d 19 Miscellaneous Compactor Repairs. Upon request of the customer, the City may d 20 X 21 make any necessary repairs to the non-operating portion of the body of any compactor unit in N 0 N 22 order to repair sheet metal or hardware damage, patch and repair holes, or install or repair any E E 23 safety devices necessary to ensure safe transport of the compactor. The City shall prepare an m 24 estimate for labor and materials and submit the estimate to the customer prior to commencing a 25 repairs. The customer shall authorize said repairs in writing, prior to commencement. The 26 27 rate for said repairs shall be $70.26 per hour, plus materials and supplies. A minimum of one 28 hour shall be charged to the customer for any repairs. I I IMME i i i Contamination of Recycling. Green Waste, Uncontaminated Wood Wastes and i 1 2 Organics. In the event that a customer allows, causes or fails to prevent contamination of any 3 roll-off or compactor assigned to and used for recycling, green waste, uncontaminated wood 4 wastes or organics, the customer shall be responsible for payment of the entire load as if it 3 5 was all refuse and disposed of at an appropriate sanitary landfill at the rates set forth for the d 6 service of refuse roll-offs and compactors. In addition, a $61.95 recycling contamination d 7 8 penalty fee shall be levied in addition to the regular refuse charges for each occurrence of m E contamination. 00 9 M 10 Red Tag/Return Trip Fee. The City of San Bernardino Integrated Waste m m 11 Management Division may charge a fee of $144.38, plus any other applicable rates 3 v 12 established in this Resolution, for red tags and return trips per service. E rn 13 � ^ 14 �✓ SECTION 16. Miscellaneous Services and Charges. The following rates and 15 �- 16 schedules shall apply to the miscellaneous services described. °- 15 0 17 Automated Residential Collection Service Late Set-out Charge. The City of San 18 Bernardino hereby establishes that collection of refuse, recyclables and green wastes shall be d 19 accomplished between the hours of 6:00 a.m. and 7:00 p.m. on the collection day as d 20 21 determined by the Director of Public Works or his/her designee. All residential carts shall be N 0 N 22 placed at the designated collection location on the collection date no later than 6:00 a.m. An E E 23 automated residential collection service late set-out shall be defined as any owner or t, A 24 authorized agent at a lawfully established service address who fails to place the automated 25 carts in the designated manner and place in order to permit the City to service the automated 26 27 carts by 6:00 a.m. For the purposes of further clarification, a report of"missed service" shall 28 not be considered valid and shall be considered to be a late set-out, unless additional service e f locations and the same color-coded cart have been missed within the same physical street 1y 1 2 block, as determined by investigation. The charge for a late set-out shall be $30.19 per 3 occurrence. 4 "Clean-up" Service. The City shall offer to all owners and authorized agents a 5 "Clean-up" service at any location within the City. Said service shall be defined as a manual � 6 collection service designed to handle any miscellaneous refuse services not accommodated m 7 z 8 through other collection methods. Said service shall be offered in fifteen (15) minute blocks, w E 9 billable to the customer. The City shall provide an estimate to the customer of the amount of c A 10 time required and the cost, prior to provision of the service. The customer shall pay, in d N 11 advance of the service, the estimated cost. In the event that said estimate is less than the 3 v 12 actual cost of providing the service, the customer shall be billed the difference. In the event 13 14 that said estimate is higher than the actual cost of providing the service, the customer shall be v 15 provided a refund of the difference. c 16 The rate for a refuse collection special service shall be$38.04 per fifteen minutes. °- S 0 17 Provision of City Issued Locks for Refuse Bins and Enclosures. 18 At the request of owner or authorized agents, the City shall provide a standard lock v 19 with two keys to the customer for use in securing the refuse, recyclables or green wastes bins 20 21 or bin enclosures. A charge of $18.59 shall be billed the customer for each standard lock N 0 N 22 provided by the City. It is the responsibility of the customer to maintain the lock and keys in E E 23 working order. The customer shall be responsible for replacement of locks or keys that are R 24 damaged or stolen. Special locks and keys requested by the customer shall be billed at a rate 25 equal to the cost to the City for providing such services plus any other applicable costs 26 27 established in this Resolution. 28 ® _Special Assistance Program. The City shall provide a special assistance program to 1 2 elderly or disabled residents who are unable to move their automated carts to the curb for 3 servicing and who do not have any able-bodied individual living with the resident. 4 Subscription to this program requires a letter from a doctor or other medical professional, 5 stating that the individual is unable to move their automated carts to the curb and that there is 6 no caregiver or other able-bodied individual available to perform this activity at this address d 7 8 or location. Said subscription must be renewed on an annual basis in order to remain on the E 9 special assistance program. There is no charge for this program. The City may discontinue, c m 10 this service if sufficient evidence exists that the information provided by the applicant is m - N 11 fraudulent. 3 D 12 Refuse Bin Enclosure and Bus Stop Cleaning Service. The City may provide, upon 13 14 request, broom and steam cleaning of any refuse bin enclosure or bus stop located within the S © N 15 City on either an on-call or scheduled service. The rate for this service shall be $38.04 per c 16 fifteen minutes. .0 5 0 17 Charge for Late Payment. All charges for collection services are due and payable no 18 later than thirty (30) calendar days after issuance of a claim, bill or invoice by the City of San d 19 20 Bernardino Public Works DepartmentfWater Department. Payments not received by the due z 21 date shall be assessed a late charge of twelve percent (12%) per year, divided into a monthly N 0 N 22 late charge of one percent (1%) on the outstanding balance. Accounts which are delinquent m E 23 more than ninety days may be turned over to a collection agency for collection. A fee of$2 ¢, 24 shall be charged for the mailing of any delinquent notice. 25 Contamination of Residential Recycling and Green Waste. San Bernardino 26 27 Municipal Code Section 8.24.070 (D) Contamination of Green Waste and Commingled 28 i Recycling sets forth that containers set aside for recyclables or green waste shall be used only 1 2 for recyclables or green waste and no other materials. 3 For the purposes of enforcement of this section, the first notification of contamination i 4 shall be by a red tag attached to the customer's contaminated container not serviced by the 3 5 route driver and a notification letter sent to the service billing address. The second d 6 notification shall be by a red tag attached to the customer's contaminated container not ;; 7 z 8 serviced by the route driver and subject to a $25.00 fee. The third incident of contamination d E d 9 may result in removal of all service containers and termination of services for a period of up c m 10 to six months. d 11 When practicable, a photograph of the alleged contamination shall be taken by a 3 v 12 supervisor or field inspector in order to document the contamination for any subsequent E 13 violations. A letter of notification shall follow removal of the container. E �^ 14 �.r Upon the customer's request, service may be reestablished with submission of a signed 15 16 recycling container agreement, and subject to any applicable charges set forth in this 'g 0 17 Resolution. Subsequent contamination may result in permanent removal of the blue or green m d 18 container. d 19 Bulky Items. Bulky items are generally defined as disposable items that are too large d 20 21 to fit in containers provided for regular service, including, but not limited to couches, water N 22 heater;, refrigerators and other non-hazardous items. The City may provide "bulky item"pick d E 23 up services twice per year, per residential account, at no cost to the customer. Additional 24 residential bulky item service requests shall be billed at the rate of$38.04 per service request. 25 Commercial bulky item pick up services shall be billed at the rate of$38.04 for each service 26 27 request, starting with the first request. The Mayor and Common Council do hereby declare that the responsible 26 party for the purposes of payment for regularly scheduled refuse and recycling collection 27 services at designated apartment buildings and regional shopping malls shall be the owner or 28 Packet Pg.649 L ME their designated agent of each apartment building and regional shopping mall. The City is not 1 2 responsible for billing individual tenants within a designated apartment building or regional 3 shopping mall. Nothing in this section d 7 z 8 shall preclude, limit or otherwise restrict the rights, options or authority of the owner or their d E a 9 designated agent from billing, allocating or otherwise collecting said costs for regularly c A 10 scheduled refuse and recycling collection services from an individual tenant. This section d b 11 shall not be applicable to refuse or recyclable collection services directly arranged for between 3 9 12 a tenant of a regional shopping mall and the City; such services shall be billed at the rates set 13 forth herein. 14 15 16 SECTION 18. Emergency Waiver of Collection Fees. The Director of Public ._ 0 17 Works or his/her designee may provide collection and disposal service without charge in m s 18 emergency situations and when, in the opinion of the Director or designee, such action is d 19 necessary to correct immediately health and safety hazards. d 20 21 N 22 SECTION 19. Annual Increases of Refuse Rates and Street Sweeping Fees (Cost 3 Index). This resolution establishes a Street Sweeping Fee to be charged for all residential and 4 commercial accounts. Most taxes are subject to voter approval; however,sewer,water and refuse collection services are subj ect only to the notice,hearing and majority protest rule rather than voter approval. There are five substantive requirements imposed by Article XI ID, section 6: 1. Revenues derived from the fee shall not be used for any purpose other than that for which the fee was imposed; 2. Revenues from the fee shall not exceed the funds required to provide the service. This includes both direct and indirect costs; United Business Commission v. City of San Diego (1979) 91 Cal.App.3d 156, 166; 3. The amount of the fee shall not exceed the proportional cost of the service attributable to the parcel; 4. No fee may be imposed unless it is actually used or made available to the parcel; 5. No fee may be imposed for governmental services ofpolice,fire,etc.where the service is available to the public in general as well as parcel owners. Thus,in order to survive a challenge to a rate increase governed by Article XIIID and Proposition 218, the record must demonstrate the basis for the increase and show that it is not more than the cost of the service.Io this case,only a power point summary of the increase was included which does not have a complete analysis of the fees and costs and justification for said costs. On March 15, 2012, the City Attorney's Office received the above agenda item for review at around noon. After reviewing the item,I rejected it as follows: "There is a 218 issue. Essentially,the power point is a summary of options that have been provided pursuant to a study prepared by RW Beck in 2010. The summary itself does not constitute the basis for the increase, although it is helpful in presenting the matter. However, the 2010 RW Beck study is not attached as backup. In order to satisfy Prop 218, several prerequisites must be met including providing written notice by mail, calculating the rate change,justifying the rate change, having a public hearing and collecting all written objections to the proposed rate change. Because the study is not attached,the record is incomplete and there are possible liability issues. While the City is currently in need of funds this is not the way to secure funding for any future or current service(s). The current proposal as written takes any future increase for five years out of the hands of the voters and provides the Mayor&City Council with a funding system to use as they see fit since any surplus from the respective department or decrease in current funding levels reverts back to their city. The refuse proposal is for a 5%increase every year for five years.The first increase would be effective April 1, 2012 and increase for the next five years if approved by the Mayor and City Council.This is a six year rate increase and not five and a total of 21.65%increase over current rates. We are planning on retiring in the next year and won't be able to afford"automatic adjustments". Please look for alternate ways to keep your budget in line such as cutting the pay of an overpaid administrator. You have already eliminated labor cost by implementing trucks that do all the lifting and dumping of the refuse. On the street sweeping, that's a joke in this old neighborhood. First of all, it's an old neighborhood with single lane driveways where most homeowners have multiple vehicles that are typically parked in the street. On top of that,the city's 62 year old Oak tree in my front yard makes all the mess that the city would sweep up if not for the very large branch that the sweeper can't go under due to the limited clearance. Not only does the front of our house not get swept, we are stuck cleaning up all the mess that tree makes all year including acorns, branches, tree sap on our cars, little golden caterpillar looking things that the tree produces in abundance, and leaves. You should be paying us for all the cleanup we do for your tree that is pushing out the curb and has literally taken over our yard with its' extensive roots. We don't even have a streetlight that works. How about fixing that? On the automatic increases, it would be far better if we were allowed to cut rates when we feel that we are paying too much for the services we receive. I find it ironic that the notification that I received in the mail states that there has been no raise in refuse rates for three years,yet I vividly recall Council Member Kelley telling me how difficult it was to see 300 refuse workers in orange occupying each of th seats in the City Council Chamber. It was so difficult that the council member couldn't deny them their outrageous increase in pay. Since the city has cut 56 police officers, I'd rather have a police officer come to my door than a refuse worker if I have a public safety concern. I also encourage a NO vote since the proposal allows a rate increase each of five years not to exceed five percent.This will not increase the service I receive from the refuse department. If my trash can fall onto its side,the worker will simply drive by and leave the cans contents uncollected. To increase rates at this time in the economy would present a clear and present hardship to all citizens of San Bernardino, especially the elderly and disabled. The present monthly rate of$22.84 given a 5% increase would rise to $23.98 the first year, $25.18 the 2nd year, $26.44 the 3rd year, $27.76 the 4th ear and $29.15 in the 5th year for a total increase of$6.31. Today, at the present rate, a resident will spend $274.08 per year for refuse fees. Given your proposal, they will be spending $349.80 for those fees. This idea of a refuse fee rate increase at this time is preposterous and I hope the citizens of San Bernardino react accordingly and rise to defeat such a proposal. We are already paying too much for the service we now receive. Also, the street sweeping fee should not be raised either. We haven't had a street sweeper service our streets in months. To: Whom it May Concern; I received the letter from the City of San Bernardino Public Works regarding the proposed Rate increase for refuse removal. I recommend a"no"vote regarding the proposed increase. First,to be honest,you really don't want feedback—your letter states, "If written protest against the proposed refuse rate increase are presented by a majority of owners of the identified parcels, the City shall not increase the refuse rate". As you know most of the people in your city are working middle class and in some cases working poor. They do not have the time and in many cases the education to respond—talk about taxation without representation. If you really wanted peoples' input and vote you would put this increase to a ballot as they are currently doing in Contra Costa County for a wastewater issue. Your letter also states"This shortfall can be attributed to many factors such as declining revenues and increased operational costs due to a stricken economy". You folks obviously could not work in private industry. I have worked for both a Fortune 50 company (30 years) and now a small privately held company (<50 employees) and we have never had"increased operational costs when revenues were down". We responded by cutting cost—making the difficult leadership decisions to manage the cost. That obviously has not occurred here. A few ideas: • Put out an RFP for the service among multiple providers. • If this is currently insourced look to outsource the function to private industry that knows how to deal with"reduced revenue". • Instead of 2 times per month—how about 3 times every 2 months? • Freeze wages. • Put in a system of productivity measurements/results. I understand that times are tough but the solution is not simply increasing costs to the public you serve. People are really starting to get tired of elected officials that do not have courage to do the right thing. We are opposed to the Refuse Rate Increase for the following reasons: 1. Our increase for the remaining 8 months of 2012 (street sweeping new charge of$ 1.73/mo, one extra green barrel at $0.57/mo and single family pick up $ 1.14/mo) would be a total of $27.52 in 2012 alone. This is not an insignificant amount tacked onto our Water/Sewer/Refuse City utility bill. 2. Most disturbing,however, is your proposal to"authorize automatic adjustments for five(5)years based upon the Mayor and Common Council rate increase recommendations, (not to) exceed five (5%) percent per year for refuse collection" (and we assume, in our case,for the extra green barrel as well). Our calculations show that if the 5%upper limit is allowed each year,this would result in a 27.63%increase in our monthly bill by the end of the 5th year(2017). 3. Currently our refuse charges amount to$410.28 annually. Calculating the annual charge with the(new)proposed basis of $23.98/month with a 5%annual increase, our annual refuse charge for residential service with one extra green bin would be$549.84,a 34%increase. 4. Note: Our street is not, in fact,swept two times/month. In years past our street was never swept until a citizen/resident on our street complained and got results.Currently our street is usually swept once per month,but never twice. 5. Further, because of constraints on your good drivers (whom you hire and `fire' on a regular basis—we suspect so the city does not have to pay benefits) all our green waste on this street is collected with the trash! Therefore, all of this weekly pick-up on our street goes to the dump! 6. Finally,if we did not insist,the contents of our blue recycling barrel would also go in with the once/week trash pick-up. We and our neighbors are committed to recycling. Only once have we seen a recycling truck come to our street for proper pick up. For us, the same truck that picks up our trash and green waste returns to pick up our blue bin, depending on the time constraints on the driver! So,we are not sure that any of our blue bin pickup(e.g. recycled newspapers, cardboard, clean glass, clean cans etc.) actually goes to San Bernardino's Recycling center, when it is comingled in a dirty refuse truck. 7. Note: We have not dealt with proposed charges of your new street sweeping fee of$1.73/mo which could go to $2.17 (not as stated in your letter"per year,"but we assume,"per month")—or do you mean an increase per month in any given year not to exceed an additional amount of$2.17/month. We are writing to you today to deny the rate increase here in San Bernardino. Although we appreciate all the new developments and efforts to keep our streets clean and assist in a healthier environment through recycling efforts, we are hereby submitting a request for a refusal rate increase. This increase comes at a time when our economy continues to struggle and intelligent hard-working family members have been laid off. My family and I have been loyal customers of the City of San Bernardino for over 30 years and continually support all the department efforts including keeping our neighborhoods clean and safe. Uwe are asking that the Mayor and Common Council not increase the rates five (5) perfect for all residential and commercial services as this will impact a lot of homeowners and commercial owners who are working hard to just make it by on the current rates. We understand that this also impacts The City in many more ways then one; however, increasing rates may also have a negative impact on individuals who are barely making ends meet or transitioning to keep up due to rising food, health, taxes, and general costs. In addition, if approved the proposal will also authorize "automatic" adjustments for five (5) years based recommendations by the Mayor and Common Council. We disagree that it should be an "automatic adjustment" within each year for five (5) years and that it should be voted by the homeowners and commercial owners are then able to agree or disagree based on the needed rate increase for purposes of the Public Works Department. Requesting such increase may have a better passing of a proposed rate increase if it were limited to only three(3)years, instead of the five(5) years. Rate increases are never good for the customers. We propose other methods to help declining revenues and increased operational costs due to a stricken economy such as looking into other companies (private or public) that have lower operating rates for The City or join with other local entities, cities and agencies to work together in reducing rates. For example, the Foothill Transit Company partners with neighboring cities to share in the costs of their public transportation. Can the City of San Bernardino share costs with Colton,Fontana and Redlands? My/our fear is that the homeowners and commercial owners of San Bernardino may not understand this letter and need to write-in to stop the refusal of such rate increase due to the non-savvyness and less proactiveness of the San Bernardino population they may not respond in numbers to impact the need to refuse the rate increase. We speak for most of them. Nonetheless, Uwe are hereby refusing the proposed rate increase for the City of San Bernardino on behalf of our fellow homeowners and commercial customers. My objection is not so much that additional money may be warranted in order to continue in the same manner that these services have been conducted but I've seen untold waste, no pun intended, especially the way the street sweeping service is done. The area I live in was, as I was told, a pilot program to sweep streets in an orderly way where cars are not allowed on the street during the function; cars are ticketed if left on the street during assigned hours. This was four years ago I believe. I honestly don't know what is happening in other parts of the city but where my office is, not too far away, it's the same old thing where the street sweeper weaves in and out of cars and it's extremely wasteful in terms of fuel, wear and tear on the equipment, and does an incomplete job leaving a wake of trash. A strong wind is more effective. So, the city wants to tax the residents in order to continue to do a terribly inefficient job. The solution seems obvious. Please have the whole city remove cars when the street sweeping service is in motion and fine cars that don't comply. The penalty revenue should easily cover this proposed tax with the result being longer lasting equipment, cleaner streets and the added advantage that some of our citizens realize that clean streets are necessary and good for the city as a whole and not just in the more upscale neighborhoods. Our city needs to be cleaner and more organized but the leadership has been missing in encouraging some citizens that this is imperative if we wish to be viewed seriously as a city of value not as a haven for those who find sanctuary in living in an area where they are not held accountable for their wrong doing.
