FY 2012-13 JAG grant funds will be used to offset the personnel costs of four existing and filled civilian police positions. Grant funds will provide 45% of the total salary and benefits with the General Fund covering$165,989 or 55%of remaining costs, including any overtime expenditures for the three dispatcher positions. Background: At President Bush's request, Congress consolidated the Byme Grants and LLEBG into a single program known as the Edward Byrne Memorial Justice Assistance Grant (JAG) in order to streamline funding and grant administration. Grant funding is allocated based on a formula that includes population and a three-year average of reported violent crime for each jurisdiction. This grant does not require matching funds. For 2012, the City of San Bernardino's allocation is $136,168. This amount is $40,031 less than the 2011 JAG allocation of $176,199. The San Bernardino Police Department has used the JAG appropriation to pay for four civilian positions over the past nine years. The City of San Bernardino has been designated as a disparate jurisdiction, which is defined as a city receiving one-and-one-half times the County allocation, and is required to file a single joint application with the County of San Bernardino. The County Law &Justice Group has served as the grant administrator and fiscal agent for JAG program funds and charges each recipient a 5% administrative fee. The 2012 administrative fee of$7,167 was deducted from the total award of $143,335 reducing the City's funding to $136,168. The County Law & Justice Group has prepared an Interlocal Agreement between the City of San Bernardino and County of San Bernardino identifying the County Law & Justice Group as the grant administrator and fiscal agent and detailing JAG grant administration and billing procedures. The JAG grant budget narrative and two original signed agreements are due to the San Bernardino County Law & Justice Group by May 1, 2012. In FY 2011-12, the Police Department used JAG funds to cover 64% of the salary and benefits costs of one Property Manager and three Dispatcher I/II's. In FY 2012-13, the department will utilize grant funds to pay for 45% of the full salary and benefits of the Property Supervisor and three Dispatch positions with the General Fund covering $165,989 or 55% of the full salary and benefits totaling $302,157. Since FY 1999-00 this position has been funded by LLEBG funds. We need to maintain the current level of staffing and supervision in the Property Bureau to a provide adequate staffing to collect,process, store, and safeguard property and evidence in police custody, and protect the department and City from liability arising from the mishandling or loss y of these items. Maintaining this position will provide additional safeguards to minimize the City's exposure to liability in this critical area of police operations. For FY 2012-13, the salary ' and benefits of the Property Supervisor will be $85,434. N r O Additional Dispatchers In 2011,the police dispatch center handled more than 350,000 telephone calls, including 135,000 N`o calls on 9-1-1 lines. This workload makes the dispatch center one of the busiest centers servicing medium sized cities. Since FY 99/00, LLEBG funding has been used to augment their staffing, providing funding for three additional dispatcher positions. These positions are essential to maintain quality service for the public and department personnel and handle 9-1-1 a calls and other calls for police service. For FY 2012-13,the salary and benefits of the three grant funded Dispatcher II's will total$216,723. A Z m a m v c v a X W C7 Q M N O N LL C U E L U F Q 1 Packet Pg.270 i INTERLOCAL AGREEMENT "Exhibit B" BETWEEN THE TOWN OF APPLE VALLEY, THE CITIES OF ADELANTO, BARSTOW, CHINO, COLTON, FONTANA, HESPERIA, HIGHLAND, MONTCLAIR, ONTARIO, RANCHO CUCAMONGA, REDLANDS, RIALTO, SAN BERNARDINO, UPLAND, VICTORVILLE, AND THE COUNTY OF SAN BERNARDINO, CA CONCERNING DISTRIBUTION OF THE 2012 JUSTICE ASSISTANCE GRANT AWARD This Agreement is made and entered into this day of 2012, by and between THE a COUNTY OF SAN BERNARDINO, acting by and through its governing body, the Board of Supervisors (hereinafter referred to as "COUNTY"), and the aforementioned TOWN (hereinafter referred to as c "TOWN") and named CITIES (hereinafter referred to as "CITIES"), acting by and through their 2 respective governing bodies, the Town Council and City Councils, all of whom are situated within the m County of San Bernardino, State of California, as follows: v c m WHEREAS, each governing body, in performing governmental functions or in paying for the Mn performance of governmental functions hereunder, shall make that performance or those payments a from current revenues legally available to that party; and „ U WHEREAS, each governing body finds that the performance of this Agreement is in the best interests of all parties, that the undertaking will benefit the public, and that the division of costs fairly N compensates the performing party for the services or functions under this Agreement; and o N WHEREAS, the COUNTY agrees to release to TOWN and CITIES their respective grant m allocation from the JAG Award within sixty (60) days upon receipt of funds, less five percent (5%) for administrative fees, as reflected on Appendix 1 here attached and hereby incorporated by reference as part of this agreement; and COUNTY agrees to use the five percent (5%) of JAG award funds received from TOWN and CITIES under this agreement for administrative fees toward the administration of 2 TOWN's and CITIES' programs during the entire permissible duration of said programs; and TOWN and CITIES agree to deposit their JAG award funds into a separate trust account in accordance with JAG guidelines; and TOWN and CITIES each agree to the five percent (5%) reduction of their respective grant allocation from the JAG award, as reflected on Appendix 1 for administrative fees toward the administration of this program; and additionally the TOWN and CITIES each agree that it is their responsibility to ensure these funds are expended in accordance with JAG guidelines, and that the E interest generated from such funds shall be solely applied and expended in accordance with these m same JAG guidelines; and c WHEREAS, the TOWN, CITIES and COUNTY believe it to be in their best interests to E reallocate the JAG funds, m NOW THEREFORE,the COUNTY and TOWN and CITIES agree as follows: a Section 1. Section 3. `m TOWN and CITIES agree to provide COUNTY with sufficient timely information as necessary within five business days after receiving written request from COUNTY to meet JAG requirements for quarterly and annual financial and performance reports. y N Section 4. m U Nothing arising from this Agreement shall impose any liability for claims or actions against COUNTY other than what is authorized bylaw.
