The funds will be allocated in the City Attorney's operating budget with an increased allocation of$250,000 to Account#001-050- 5503-Litigation-Outside Attorneys and$50,000 to Account#001-050-5177 -Litigation Expenses. Motion: Appropriate $300,000 and allocate $250,000 to line item # 001-050-5503 Litigation-Outside Attorneys and$50,000 to Account#001-050-5177 -Litigation expenses. + Synopsis of Previous Council Action: On March 5, 2012, the Mayor and Common Council restored a total of$939,100 to the City Attorney's budget as a result of a 57% increase in the number of lawsuits filed (between 2008 and 2011)where the City is named. At that same time, the City Attorney advised the Mayor and Common Council that the ongoing increase in lawsuits may require additional funds prior to June 30,2012. Backeround• Based upon further review and reconciliation of ongoing litigation activity in defending the City, it is estimated that the City will incur approximately $300,000 in additional litigation costs with outside counsel by June 30, 2012. In order to mitigate risk and protect the City, the City Attorney recommends that ongoing litigation continue and that the Mayor and Common Council appropriate the required funds in the amount of$300,000 allocated as $250,000 for Litigation- Outside Attorneys (line item # 001-050-5503) and $50,000 for Litigation expenses (line item # 001-050-5177). City staff is currently preparing the FY2012-13 Operating Budget and will account for and reconcile this necessary request for augmented funding with the City's overall © resources and applicable reserves.
