Motion: Re-establish City Manager (U) Salary Range 4740 at $17,791 - $21,622/month; authorize the Director of Finance to incorporate the changes into the FY 11/12 budget; authorize the Director of Human Resources to update Resolution Nos. 97- 244 and 2011-218 to reflect this action; and authorize higher acting pay for the current Acting City Manager at Step 1 of Range 4740. Synopsis of Previous Council Action: On January 22, 2008, Mayor and Common Council approved Resolution No. 2008-33, which amended Resolution No. 6413, Sections Ten, Eleven, Twelve and Fourteen. Salary Range 4740, $17,791 - $21,622/month,was the salary range set for the position of City Manager. On July 18, 2011, Mayor and Common Council approved Resolution No. 2011-218, which amended Resolution No. 6413, Sections Ten, Eleven, Twelve and Fourteen. Salary Range 4740 had been revised to read"Established by Contract." i Backeround: City of San Bernardino Charter, Article V, Section 103, Vacancy, provides that upon a vacancy in the office of the City Manager, the Assistant City Manager shall be designated as Acting City Manager until a City Manager is appointed. Therefore, upon the retirement of Charles McNeely, Andrea Travis-Miller has been designated as Acting City Manager effective May 2, 2012, by operation of the Charter that also imposes a mandatory duty on the Assistant City Manager to a perform all duties of the City Manager until a new City Manager has assumed the duties of that i office. i For those employees temporarily assuming higher-acting positions and duties, the practice of the City is to temporarily compensate ese individuals at the step in the higher position' salary th s range that gives the employee at least a five percent (5%) increase in pay. Such practice is reflected in the Management and Confidential Compensation and Benefits Plan for those i positions appointed to a higher-acting position where it provides for acting pay for non-safety I Updated: 5/31/2012 by Stephanie Easland A Packet Pg. 75 1866 employees at the first step of the salary range for the acting position next above the employee's regular salary, which would provide the acting employee at least a five percent (5%) salary �r increase. The Assistant City Manager position is different in that it assumes the higher-acting position of City Manager by operation of law and is not covered by the above-mentioned benefits resolution. In the past, the City has followed its usual practice and compensated the Assistant City Manager performing the higher-acting duties of City Manager at the step in the City Manager's salary range that gave him/her at least a five percent (5%) increase in pay. However, in order to provide acting pay to Ms. Travis-Miller, it is necessary to re-establish the salary range for the City Manager position. Resolution No. 2008-33 previously established the range,but upon revision in 2011, it was eliminated. Upon re-establishment of Salary Range 4740 at $17,791 - $21, 622/month and in accordance with City Practice, it is requested that Andrea Travis-Miller be placed at Step 1 of Range 4740, $17,791, to compensate her for the Charter-required assumption of the higher-acting position of City Manager.
