MOTION: That the appointment of Ms. Shirley Berry Foster to the Fine Arts
Commission, as recommended by Councilwoman Betty Dean Anderson, be
approved.

MOTION: That the motions indicated by consent calendar items 6 through

MOTION: That the personnel actions as submitted by the Chief Examiner
dated May 22, 1997, in accordance with Civil Service rules and
Personnel policies adopted by the Mayor and Common Council
of the City of San Bernardino,be approved and ratified.

10. Resolution of the City of San Bernardino awarding a contract to Age General Construction,
Inc., for traffic signal modification at Mt. Vernon Avenue and Seventh Street and Marshall
Boulevard and "E" Street. (See Attached) (Cost to the City -- $127,500 from the Traffic
Systems Construction Fund.) (Contract documents are available in the City Clerk's
Office.) Wards 1,5, & 7
MOTION: That said resolution be adopted.

Public Works/Engineering
1 1. Resolution of the City of San Bernardino authorizing the execution of a Fifth Amendment
to Contract with Inland Overhead Door Company relating to the provision of maintenance
of overhead doors at various locations. (See Attached) (Resolution not available at time of
printing) (Cost to the City — $21,605 [Estimated cost for repair calls] to be paid from
the General, Library and Motor Pool Funds - dependent upon the number of calls
made at the various locations.)
MOTION: That said resolution be adopted.
12. Resolution of the City of San Bernardino authorizing the execution of Fifth Amendment to
Contract with Arrow Power Sweeping relating to the provision of sweeping services for the
Carousel Mall parking spaces. (See Attached) (Resolution not available at time of printing)
(Cost to the City —$56,354 from the General Fund.) Ward 1
MOTION: That said resolution be adopted.
13. Resolution of the City of San Bernardino authorizing and directing the execution of
agreements with the County of San Bernardino for collection of annual assessments on the
County Tax Rolls. (See Attached) (Resolution not available at time of printing)
MOTION: That said resolution be adopted.
14. Approve plans and authorize advertisement for bids-rehabilitation of pavement on
Hospitality Lane and Lena Road, per Plan No. 9655. (See Attached) (Cost to the City -
$404,000 from the Gas Tax Fund) Wards 1 & 3
MOTION: That the plans for pavement rehabilitation on Hospitality Lane,
from "E" Street to Waterman Avenue, and Lena Road, from Mill
Street to Rialto Avenue, in accordance with Plan No. 9655, be
approved; and that the Director of Public Works/City Engineer
be authorized to advertise for bids.

15. Approve plans and authorize advertisement for bids — improvement of Mill Street, from
Lena Road to Tippecanoe Avenue, per Plan No. 9487. (See Attached). (Cost to the City —
$1,287,500 from EDA Grant& IVDA) Ward 1
MOTION #1: That the plans for the improvement of Mill Street, from
Lena Road to Tippecanoe Avenue, in accordance with
Plan No. 9487, be approved; and that the Director of Public
Works/City Engineer be authorized to advertise for bids; and
MOTION #2:That the Director of Finance be authorized to adjust the
Street Construction Fund Budget to reflect project costs
and the anticipated revenue in the amount of$1,287,500
from the EDA Grant and IVDA.

16. Request for waiver of fees - Our Lady of Guadalupe Church/St. Anthony's Church -
Eucharistic Procession - June 14, 1997. (See Attached) (Cost to the City -- $3,670 from
the General Fund [$1,150.00 of that amount is in the form of a refundable deposit].)

19. Request to join as an Amicus in the support of the City of Oceanside in Penn Pacific
Properties, Inc., v. City of Oceanside, et at (See Attached)
MOTION: That the City Attorney's Office be authorized to join Amicus in support of
the City of Oceanside in Penn Pacific Properties, Inc., v. City of Oceanside,
et at

20. Authorize budget amendment for demolition costs - Economic Development Agency
(EDA) reimbursement. (See Attached) (No cost to the City — $88,284 to be reimbursed
by the Economic Development Agency.)
MOTION: That the Mayor and Common Council authorize the Director of Finance to
amend the Fiscal Year 1996-1997 budget to reflect the increase of$88,284
for demolitions, and the reimbursement to be received from EDA Project
490-11.5 Demolition, for the costs as outlined in the attached staff report
dated May 21, 1997 from Bill Skiles, Manager, Code Compliance Division.

Council Office
21. Consider request from San Bernardino Public Employees Association to schedule a time
after working hours for City employees to address the Mayor and Common Council. (See
Attached)
MOTION: That the Mayor and Common Council discuss and take possible action on
the General Unit members' request for a meeting with the Common Council
to that City employees can address the Council on future employment
issues; and that said request be granted and scheduled.
Finance
22. Resolution authorizing and approving the borrowing of funds for Fiscal Year 1997-1998;
the issuance and sale of a 1997-1998 Tax and Revenue Anticipation Note therefor and
participation in the California Communities Cash Flow Financing Program. (See Attached)
(Resolution not available at time of printing) (Estimated net earnings to City - $100,000
to the General Fund)
MOTION: That said resolution be adopted.
Parks. Recreation & Community Services
23. Resolution authorizing the Director of Parks, Recreation and Community Services
Department to execute an agreement with the Center of Health Resources Purchase
Connection, group purchasing, dietary program for raw food products for the City's Senior
Nutrition Program. (See Attached) (Resolution not available at time of printing)
MOTION: That said resolution be adopted.
24. Resolution of the Mayor and Common Council of the City of San Bernardino approving
the destruction of certain city records of the Parks, Recreation and Community Services
Department. (See Attached)

Police
25. Authorize budget amendment to cover cost of POST-mandated training courses and
department's share of CAL-ID payment to the San Bernardino Sheriffs Department. (See
Attached) (Cost to the City-- $56,600 from the General Fund)
MOTION: That$50,000 in Patrol Division salary savings be transferred into
the Personnel and Training Division budget for the purpose of
sending sworn personnel to POST training courses for the
remainder of the fiscal year; further, that $6,600 in overtime
funding be transferred to professional/contractual services to
cover the Police Department's share of the CAL-ID payment to
the San Bernardino Sheriffs Department.
Water
26. A resolution of the Mayor and Common Council of the City of San Bernardino, successor
to the South San Bernardino County Water District, assessing properties within the
previous district boundaries in the amount of$14,687.50 for the Fiscal Year 1997/98. (See
Attached) (Resolution not available at time of printing.) Ward 1
MOTION: That said resolution be adopted.
27. Update on the Court House relocation project by the Honorable Judge John Kennedy.

NOTE: The next regular meeting is scheduled to be held at 8:00 a.m., Monday, June
16, 1997, in the Council Chambers of City Hall, 300 North "D" Street, San
Bernardino, California.

NOTICE: Any member of the public may address this meeting of the Mayor and
Common Council/Community Development Commission on any item
appearing on the agenda, by approaching the microphone in the Council
Chambers when the item about which the member desire to speak is called,
and by asking to be recognized.
Any member of the public desiring to speak to the Mayor and Common
Council/Community Development Commission concerning any matter not
on the agenda but which is within the subject matter jurisdiction of the
Mayor and Common Council/Community Development Commission, may
address the body at the beginning of the meeting, during the period reserved
for public comments, said total period for public comments shall not exceed
forty-five(45) minutes, unless such time limit is extend by the Mayor and
Common Council/Community Development Commission. A three-minute
limitation shall apply to each member of the public unless such time limit is
extended by the Mayor and Common Council/Community Development
Commission. No member of the public shall be permitted to "share" his/her
three minutes with any other member of the public.
The Mayor and Common Council/Community Development Commission
may refer any item raised by the public to staff, or to any commission,
board, bureau, or committee for appropriate action or have the item placed
on the next agenda of the Mayor and Common Council/Community
Development Commission. However, no other action shall be taken nor
discussion held by the Mayor and Common Council/Community
Development Commission on any item which does not appear on the agenda
unless the action is otherwise authorized in accordance with the provisions
of subdivision (b) of Section 54954.2 of the Government Code.
Public comments will not be received on any item on the agenda when a
public hearing has been conducted and closed.
