RESOLUTION NO. 5404
RESOLUTION OF THE COMMUNITY DEVELOPMENT
COMMISSION OF THE CITY OF SAN BERNARDINO,
CALIFORNIA, MAKING FINDINGS AND
DETERMINATIONS AS TO THE BENEFIT OF CERTAIN
IMPROVEMENTS FOR THE VARIOUS REDEVELOPMENT
PROJECT AREAS OF THE AGENCY (532 NORTH "D"
STREET BUILDING)
WHEREAS, the City of San Bernardino, California (the
"City"), is a municipal corporation and a charter city duly
created and existing pursuant to the Constitution and the laws of
the State of California; and
WHEREAS, the Community Development Commission of the
City of San Bernardino (the "Commission") on behalf of the
Redevelopment Agency of the City of San Bernardino (the
"Agency"), is a redevelopment agency, a public body, corporate
and politic of the State of California, organized and existing
pursuant to the Community Redevelopment Law (Part 1 of
Division 24 commencing with Section 33000) of the Health and
Safety Code of the State of California (the "Act"); and
WHEREAS, pursuant to Section 33445 of the Act, the
Agency may, with the consent of the Mayor and Common Council of
the City (the "Council"), pay all or a part of the cost of
installation and construction of any building,
facility,
structure or other improvement which is publicly owned either
within or without the boundaries of a redevelopment project area
28 structures or other improvements are of benefit to the
if the Council determines: (1) that such buildings, facilities,

1 redevelopment proj ect area or the immediate neighborhood in which
2 the project is located, regardless of whether such improvement is
3 within another project area, or in the case of a project area in
4 which substantially all the land is publicly owned that the
5 improvement is of benefit to an adjacent project area of the
6 Agency, (2) that no other reasonable means of financing such
7 buildings, facilities, structures or other improvements is
8 available to the community, and such determination by the Agency
9 and the Council shall be final and conclusive, and (3) that the
10 payment of funds for the cost of the facilities, structures or
11 other improvements will assist in the elimination of one or more
12 blighting conditions inside the project; and
13
14 WHEREAS, the City and the Commission have previously
15 approved and adopted Redevelopment Plans (collectively
16 hereinafter referred to as the "Redevelopment Plans") for various
17 redevelopment project areas within the City which project areas
18 include: the Meadowbrook-Central City Project Area, Central City
19 North Project Area, Central City East Project Area, Central City
20 South Project Area, Central City West Project Area, Tri-Cities
21 proj ect Area, Southeast Industrial Park Redevelopment proj ect
22 Area, South Valle Project Area, State College Project Area,
23 Northwest Project Area and the Mt. Vernon Project Area; and

25 WHEREAS, it is in the interests of the present
26 landowners wi thin the various proj ect areas subj ect to the
27 Redevelopment Plans (the "Project Areas") and the residents, both
28 within the Project Areas and within the City generally, that the

Agency causes the construction and rehabilitation of a certain
publicly owned commercial office building of the Agency located
at 532 North "D" Street in the City of (the "Project"); and
WHEREAS, the Project Areas presently suffer from a high
degree of impaired investments and depreciated values along with
high business vacancies which conditions are being exacerbated by
the lack of economic opportunities within the various Project
Areas; and
WHEREAS, the Project Areas also suffer fron factors
which prevent or substantially hinder the economically viable use
or capacity of buildings and lots; and
WHEREAS, in order to ensure continued investment and
growth in the Project Areas, the residents and occupants of the
Project Areas are having to avail themselves of economic
opportunities and services in the central business district which
opportunities and services are often provided by governmental
offices located in the central business district; and
WHEREAS, the proj ect, which consists of the
construction and rehabilitation of the Agency's office building,
will allow for the rental and occupancy within said building by
the Consulate General's offices for the Government of Mexico; and
WHEREAS, the population of Mexican nationals within the
City accounts for approximately thirty-five (35%) of the entire

population of the City according to recent census information;
and
WHEREAS, the Mexican Consulate General provides a full
range of social and economic services and opportunities to the
community, including but not limited to, the issuing of visa's,
the initiation of cultural and economic exchanges, the provision
of relocation assistance, the assistance in criminal and civil
investigations and the ir.tervention of legal matters, which
services are relied upon by residents and occupants of the
Project Areas and the City generally; and
WHEREAS, the Project is located within a portion of the
central city area of the City of which suffers from a lack of
business opportunities as well as inadequate and deteriorating
office space facilities and which area is patronized by residents
and occupants of the Project Areas who pursue emploYment, seek
business opportunities and who rely on the provision of economic,
social and civic services provided by governmental businesses
including the Mexican Consulate; and
WHEREAS, the central city area suffers from high
vacancy rates and the location of the Mexican Consulate within
such area will help alleviate such vacancy rate both from its own
occupancy of office space as well as the occupancy of nearby
space by businesses and offices that typically congregate in
proximity to Consul offices; and

WHEREAS, the undertaking of the Project in the downtown
area of the City, wherein residents of the Project Areas and the
City generally may avail themselves of economic opportunities as
well as civic and commercial services, will provide a benefit for
the proj ect Areas and the residents of the adj acent neighborhoods
who participate in activities or who are employed in the downtown
area; and
WHEREAS, in order to promote the City's health, safety
and welfare, it is important that the Project be financed in
order to ensure the orderly development of the Project Areas and
neighboring areas; and
WHEREAS, it is appropriate at this time for the Agency
to make certain findings and determinations and take certain
action with respect to the undertaking of the Project.
NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION
ACTING ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF
SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
Section 1. The Recitals hereinabove are true and
correct and are incorporated herein by this reference.
Section 2. The Agency approves the paYment by the
Agency of the costs of the proj ect to be undertaken in the
central business district which are of benefit to the Project

Areas and other neighborhoods within the City for the reasons set
forth in the Recitals hereinabove. The Agency also finds and
determines that no other reasonable means of financing of the
Project is presently available to the City and that the City and
the Agency require the use of revenues generated from the various
Project Areas in order to fund the Project. The Agency further
finds that the Project will enhance the desirability of the City
for economic investment which in turn will enhance economic
viabili ty in the proj ect Areas thereby eliminating existing
blighting conditions in the Project Areas.
Section 3. The construction of the Project in the
downtown area will make the central business district more
economically viable through the reduction of otherwise high
vacancy rates and elimination of factors hindering the economic
viability of downtown buildings which will thereby make the
entire City and the Project Areas more desirable for development
which will in turn help eliminate blight within the Project Areas
and other areas of the City.
Section 4. The Agency Secretary is hereby
authorized and directed to cause this Resolution to be
transmitted to the City for consideration in connection with
appropriate action by that body.

Section 5.
The findings and determinations herein
shall be final and conclusive. This Resolution shall take effect
upon the date of its adoption.
