HomeMy WebLinkAbout1992-5353 ~ ~. 1 2 3 4 5 6 7 8 RESOLUTION NO. 5353 RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO APPROVING A CERTAIN DISPOSITION AND DEVELOPMENT AGREEMENT BY AND BETWEEN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO AND PACIFIC STAR DEVELOPMENT, INC., A CALIFORNIA CORPORATION PERTAINING TO THE DEVELOPMENT OF A LOW AND MODERATE INCOME HOUSING PROJECT WHEREAS, the Community Development Commission of the City of San Bernardino (the "Commission") on behalf of the 9 Redevelopment Agency of the City of San Bernardino (the 10 "Agency"), is a redevelopment agency, a public body, corporate 11 and politic of the State of California, organized and existing 12 pursuant to the Community Redevelopment Law (Part 1 of Division 13 14 15 16 17 18 24) commencing with Section 33000 of the Health and Safety Code of the State of California (the "Act)"; and WHEREAS, the Redevelopment Plan for Uptown the Redevelopment Project (the "Redevelopment Plan") was previously approv~d and adopted by the Mayor and Common Council of the City 19} 20 21 22 23 of San Bernardino (the "Council") by duly authorized Ordinance of the Council; and WHEREAS, the Redevelopment Plan provides for the 24 redevelopment of real property pursuant to the Redevelopment Plan both within and outside of the redevelopment project area which 25 26 27 28 is subject to the Redevelopment Plan (the "Project Area") by owners thereof or by parties seeking to acquire real property from the Agency; and - 1 - "~ (~.... 1 2 3 4 5 6 7 8 9 WHEREAS, the Agency and Pacif ic Star Development, Inc., 10 a California corporation (the "Developer") desire to enter into 11 a certain Disposition and Development Agreement (the 12 "Agreement"), a copy of which is attached hereto as Exhibit "A" 13 and incorporated herein by reference, pursuant to which, among 14 other matters, the Developer would acquire from the Agency 15 certain real property (the "Property") which is described in 16 Attachment "1" to the Agreement. The Property is located 17 adjacent to the Project Area. The acquisition of the Property 18 would be for purposes of the redevelopment thereof, as described 19 in the Agreement, including construction by the Developer of 20 approximately ten (10) detached single family dwelling units to 21 be occupied by low and moderate income households (the 22 "Project"); and WHEREAS, section 33391 of the Act provides that a edevelopment agency may acquire any real or personal property ithin a redevelopment project area or for the purposes of edevelopment and section 33430 of the Act provides that a edevelopment agency may dispose of any real or personal property ithin a redevelopment project area or for the purposes of edevelopment; and '''.... -- 23 24 WHEREAS, the Agency Staff has prepared and made 25 available for public inspection a certain Summary Report (the 26 "Summary" ) concerning the proposed Agreement, as required by 27 / / / 28 / / / '~ - 2 - - 'j.'\lj$lP"- ^,~ '-~~ ,~ 1 Health and Safety Code section 33433, a copy of which is on file 2 with the Agency and is incorporated herein by reference; and :3 4 WHEREAS, the Agency has duly noticed and conducted a 5 public hearing in accordance with the requirements of Health and 6 Safety Code Section 33433 concerning the proposed sale of the 7 Property by the Agency to the Developer pursuant to the proposed 8 Agreement; and 9 10 11 public 12 Safety WHEREAS, the Agency has duly noticed and conducted a hearing in accordance with the requirements of Health and Code Section 33431 concerning the proposed sale of the 13 Property by the Agency to the Developer pursuant to the proposed 14 Agreement; and 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, based upon evidence and testimony submitted to the Agency, it is reasonable and appropriate for the Agency to approve the proposed Agreement. NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION, ACTING ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: section 1. development of the III III The Agency finds and determines that the Property as described in the proposed - 3 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 - 28 Agreement is within the scope, terms and provisions of the Redevelopment Plan. section 2. The Agency has held a public hearing on the disposition of the Property in accordance with Health and Safety Code Sections 33431 and 334333 and hereby accepts and approves the Summary as prepared by Agency Staff. Section 3. The Agency hereby finds and determines that the conveyance of the Property to the Developer pursuant to the terms of the Agreement and the provision of redevelopment assistance as more fully described in the Agreement is reasonable and necessary to effectuate the purposes of the Redevelopment Plan, in that it will permit the Developer to develop the Property in order to eliminate blight, to create employment opportunities, to increase the value of real property in the Project Area and to provide much needed low and moderate income housing within the City of San Bernardino. section 4. The Agency hereby approves the proposed Agreement and the conveyance of the Agency's interest in the Property to the Developer. The Agency authorizes the Executive Director of the Agency to execute the Agreement and to execute such other documents as may be necessary to implement the Agreement and to make any necessary non-substantive changes in the Agreement as may be approved by Agency Special Counsel. III III - 4 - 1 RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO APPROVING A CERTAIN DISPOSITION AND DEVELOPMENT 2 AGREEMENT BY AND BETWEEN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO AND PACIFIC STAR DEVELOPMENT, INC., A CALIFORNIA 3 CORPORATION PERTAINING TO THE DEVELOPMENT OF A LOW AND MODERATE INCOME HOUSING PROJECT 4 5 Section 5.
