Subject:
Request for Continuance to 12/04/00 - State Street Memorandum of Understanding.
Background:
After discussion with representatives of Fourth Street Rock Crusher and the San Bernardino
City Unified School District, City staff is recommending this matter be continued to the
meeting of December 4, 2000, to allow Fourth Street Rock Crusher an opportunity to revise
the agreement prepared by Brian 1. Simpson, Attorney for Fourth Street Rock Crusher, and
submitted on November 13, 2000. The most substantive change to the agreement relates to
clearly identifying San Bernardino City Unified School District's participation in the project.
Representatives from Fourth Street Rock Crusher and the School District have both been
notified and are in agreement with this recommendation.
Financial Impact:
Funding for the entire State Street Project in the amount of $400,000 was approved in the FY
2000/01 Capital Improvement Program Fund (129). A portion of this amount is required to
fund Design and right-of-way costs for subsequent phases of State Street. All costs incurred
when the project proceeds will be charged to Account No. 129-367-5504-707917060 (State
Street).
There will be no additional cost to the City due to this continuance.
Recommendation:
That the Mayor and Common Council continue this item to the meeting of 12104/2000.

I respectfully submit the following information in response to the concerns raised in the
Council meeting, this morning, regarding the school district's "fair share" toward the
Phase I State Street Improvements.
1. The school district has expended $1,321,068.00 toward off-site improvements
in the vicinity of the new high school. (See the attached exhibit).
2. The off-site 66" (diameter) storm drain extension to the Medical Center
Drive Master Planned Storm Drain constitutes mitigation over and above
what is necessary to address the impacts ofthe new high school.
3. The City had budgeted $50,000.00 in tbe FY 1999/00 Capital Improvement
Program (CIP) for it's share of the Medical Center storm drain. That cost
was "waived" by the district in favor of the City's participation, initially in
tbe CalifornialBaseIine traffic signal improvements, and now carried over to
the State StreetlBaseline Improvements.
4. The school district has agreed to build a bike/pedestrian access from the
CalifornialBaseline intersection to the new high school.

This proposal would require that the City pay an additional $39,000 +/-, out of account
number 129-367-5504-7060 over Mr. Johnson's proposal, leaving an approximate account
balance of $140,000 +/-.
As an aside, I believe moving forward with the construction of the Phase I improvements
as a multi-agency (entity) project will only help the City's application in the up-coming
competitive SANBAG review process I referred to this morning.
