SUBJECT
A resolution ratifying the execution of purchase order to Neff Rental of San Bernardino for one (I)
used Fork Lift to be utilized by the Fleet Division of Public Services Department
BACKGROUND
Apurchase order in the amount of $27,799.50 was issued on November 9, 2000 to Neff Rental for the
purchase of used forklift. Staff requested and the City Administrator approved the purchase of this
forklift, due to the fact that these machines are used and it was conceivable that the recommended
machine may be sold prior to Council approval. Fleet currently has two (2) forklifts, one of which is
inoperable, and unrepairable because parts are no longer available. This forklift was used to unload
trucks, supplies and was used to remove and re-install packer blades, tail gates and other Refuse truck
components. There is only one forklift remaining that is available for use in the City Yard and is
currently experiencing a high level of usage. Because of this high utilization of the one remaining
forklift, the Division is now experiencing delays in accomplishing tasks. If the remaining forklift
experiences any failures, the City will be unable to perform those functions and may need to rent a
forklift at a higher cost.
The Division identified two used forklifts that were available through dealers. The lowest price forklift
was a 1998 Clark CGP-45 model at a price, including tax, of $27,799.50. A new forklift of a similar
capability was also listed at $33,875.52, which is $6,076.02 higher than the lowest priced used forklift
available.

Section 3.04.0701, Negotiated Purchases states that: "At the discretion of the City Administrator, the
Purchasing Agent may authorize the purchase of technical or specialized supplies and equipment by
competitive negotiations when such a method of purchase would be more advantageous to the City and
on anyone of the following conditions exists: 1) The supplies or equipment are such that suitable
technical or performance specifications are not readily available; 2) The City is not able to develop
descriptive specifications; or, 3) The quality of the supplies and equipment cannot be accurately
determined by reference to their specification alone". Since these are used machines, it was not
possible to prepare a specification for the purchase. Furthermore, the forklift was subject to prior sale
before Council Action could be taken.
FINANCIAL IMPACT
Funds for the purchase are available in the Fleet Division's FYOO-Ol Budget, Motor Vehicle Fund 635-
341-5701.
RECOMMENDATION

FOR ONE (1) USED FORK LIFT TO BE UTILIZED BY THE FLEET DMSION OF
PUBLIC SERVICES DEPARlMENT
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That Neff Rental of San Bernardino, California offered for sale one (1)
used 1998 Clark CGP-45 model forklift, and is the best and lowest quote, to be utilized by the
Fleet Division of the Public Services Department. This purchase was authorized by the City
Administrator, as stated in Section 3.04.070I(Negotiated Purchases) of the Municipal Code.
Pursuant to this detemtination, the Purchasing Manager is hereby authorized and directed to issue
a purchase order for the used 1998 Clark forklift in an amount not to exceed $27,799.50.
