Staff Report
Subiect:
Resolution awarding contract to Janus Corporation for abatement of lead-based paints,
asbestos, PCB, and clean up at the San Bernardino Santa Fe Depot.
Back!!round:
The first phase of the renovation and retrofit on the Santa Fe Depot is to remove the hazardous
waste materials listed above from the interior of the building.
Public Works staff, with assistance from the Earth Tech Company, has completed the plans
and specifications for this project and it is ready to be awarded. A slightly higher contingency
amount is recommended for this project due to the nature of the work. Staff has satisfactorily
completed a reference check of the low bidder.
The estimated project costs are as follows:
Construction Estimate $293,832.00
Contin!!encies 58,800.00
Desi!!n and Insoection 58,768.00
Total $411,400.00
This project was advertised locally; the following companies responded (successful bidder is in
bold type):

Financial Imoact:
Caltrans will reimburse funding for this project through the $1,300,000 in federal
transportation funds that have been awarded, in addition to the $168,926 the City received
from SANBAG as local match on July 6, 1999.
Recommendation:
That the Mayor and Common Council adopt the Resolution awarding a contract to Janus
Corporation for abatement of lead-based paints, asbestos, PCB, and clean up at the San
Bernardino Santa Fe Depot.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO JANUS CORPORATION FOR ABATEMENT OF LEAD-BASED
3 PAINTS, ASBESTOS, PCB, AND CLEAN UP OF THE SAN BERNARDINO SANTA FE
4 DEPOT
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
6 CITY OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. JANUS CORPORATION is the lowest responsible bidder for abatement
8 of lead based paints, asbestos, PCB, and clean up of the San Bernardino Santa Fe Depot. A

contract is awarded accordingly to said bidder in a total amount not to exceed $293,832.00,
10
with a contingency amount of $58,800.00, but such award shall be effective only upon being
11
12 fully executed by both parties. All other proposals, therefore, are hereby rejected. The Mayor
13 is hereby authorized and directed to execute said Contract on behalf of the City; a copy of the
14 Contract is on file in the office of the City Clerk and incorporated herein by reference as fully
15
as though set forth at length.

SECTION 2. This Contract shall not take effect until the Contract is fully signed and
18 executed by the parties, and no party shall be obligated hereunder until the time of such full
19 execution. No oral agreements, amendments, modifications or waivers are intended or
20 authorized and shall not be implied from any act or course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
22
within sixty (60) days of the passage of the resolution.
