RESOLUTION OF THE COMMUNITY DEVELOPMENT
COMMISSION OF THE CITY OF SAN BERNARDINO,
CALIFORNIA, FINDING BENEFIT TO ITS VARIOUS
REDEVELOPMENT PROJECT AREAS IN THE USE OF
LOW AND MODERATE INCOME HOUSING FUNDS FOR
THE PURPOSES OF SUBSIDIZING CERTAIN HOUSING
COSTS ON BEHALF OF LOW AND MODERATE INCOME
HOUSEHOLDS
WHEREAS, the City of San Bernardino, California (the
is a municipal corporation and a charter city duly
9 created and existing pursuant to the Constitution and the laws of
10 the State of California; and

WHEREAS, the Community Development Commission of the
13 City of San Bernardino (the "Commission") on behalf of the
14 Redevelopment Agency
of the City of San Bernardino (the

15 "Agency"), is a redevelopment agency, a public body, corporate
16 and politic of the State of California, organized and existing
17 pursuant to the Community Redevelopment Law (Part 1 of Division
18 24) commencing with Section 33000 of the Health and Safety Code
19 of the State of California (the "Act"); and

WHEREAS,
pursuant to Health and Safety Code
22 Section 33334.2 (g), the Agency may use its Low and Moderate
23 Income Housing Funds inside or outside of a project area upon a
24 resolution of the Agency and the Mayor and Common Council of the
25 City (the "Council") which determines that such use will be of
26 benefit to the project; and

1 WHEREAS, pursuant to Health and Safety Code
2 Section 33334.2(e) (8), the Agency may provide subsidies to, or
3 for the benefit of, very low income households, lower income
4 households or persons and families of low or moderate income, to
5 the extent those households cannot obtain housing at affordable
6 costs on the open market; and
7
8 WHEREAS, the City and the Agency have previously
9 adopted various redevelopment plans for various project areas
10 located throughout the City (collectively, such project areas
11 shall be referred to as the "Project Areas"); and
12
13 WHEREAS, many low and moderate income households reside
14 throughout the City, both in and adjacent to the various Project

17 WHEREAS, the City has previously experienced difficulty
18 in providing affordable housing to persons employed within the
19 City as well as within the various Project Areas, and has
20 suffered a job housing imbalance which has negatively impacted
21 upon the development potential of the various project Areas and
22 the City generally; and

24 WHEREAS, the City has recently caused an increase in
25 certain water, sewer and refuge charges (collectively hereinafter
26 referred to as "utility Charges") which apply to all residents of
City, including low and moderate income households; and

1 WHEREAS, because of the increases in these utility
2 Charges, many of the low and moderate income households within
3 the City are experiencing difficulty in paying such increased
4 utility Charges which is impacting upon their ability to obtain
5 or retain affordable housing; and

7 WHEREAS, such utility Charges comprise a portion of the
8 housing costs of the low and moderate income households within
9 the Project Areas and within the city generally; and
10
11 WHEREAS, the Agency deems it desirable to assist such
12 low and moderate income households by providing subsidies for the
13 costs of the increases in the utility Rates presently being
14 assessed within the City; and

16 WHEREAS, in order to promote the City's health, safety
17 and welfare, it is important that the Agency assist in funding
18 the increase in utilities Charges for certain low and moderate
19 income households throughout the City who qualify under the
20 City's income guidelines; and

22 WHEREAS, it is appropriate at this time for the
23 commission to make certain findings and determinations and take
24 certain action with respect to the payment of the costs of
25 increased utility Charges.

1 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION
2 ACTING ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF
3 SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
4 FOLLOWS:

6 Section 1. The Recitals hereinabove are true and
7 correct and are incorporated herein by this reference.

9 Section 2. The Commission hereby approves the
10 funding by the Agency of subsidies to certain low and moderate
11 income households within the City in order to fund a portion of
12 the costs of such households' utility Charges, which portion is
13 attributable to recent increases in such charges, for the reasons
14 set forth in the Recitals hereinabove. The Commission further
15 finds and determines that no other reasonable means of financing
16 such subsidies is presently available to the City and that the
17 City and the Agency require the use of revenues attributable to
18 the low and moderate income housing purposes generated from the
19 various Project Areas to fund such costs of increased utility
20 Charges on behalf of qualifying low and moderate income
21 households.

23 Section 3. The provision of subsidies for the
24 payment of the increased portion of the utility Charges will
25 improve living conditions within the various Project Areas of the
26 Agency and make such Project Areas more desirable for development
27 and thereby further assist in eliminating blighting conditions
28 within such Project Areas.

4 Section 5. The Commission Secretary is hereby
5 authorized and directed to cause this Resolution to be
6 transmitted for the City for consideration in connection with the
7 appropriate action of that body.

This Resolution shall take effect upon
