RESOLUTION NO. 5253
RESOLUTION OF THE COMMUNITY DEVELOPMENT
COMMISSION OF THE CITY OF SAN BERNARDINO MAKING
FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF
UNDERTAKING CERTAIN BLIGHT REMOVAL ACTIVITIES FOR
VARIOUS REDEVELOPMENT PROJECT AREAS OF THE AGENCY
WHEREAS, the City of San Bernardino, California (the
lOCi ty"), is a municipal corporation and a charter city duly created
and existing pursuant to the Constitution and the laws of the State
of California; and
WHEREAS, the Community Development Commission of the City
of San Bernardino (the "Commission") on behalf of the Redevelopment
Agency of the City of San Bernardino (the "Agency"),
is a

redevelopment agency, a public body, corporate and politic of the
State of California, organized and existing pursuant to the
Community Redevelopment Law (Part 1 of Division 24) commencing with
Section 33000) of the Health and Safety Code of the State of
California (the "Act"); and
WHEREAS,
the
Agency
may,
in
furtherance
of
its
redevelopment purposes, undertake redevelopment projects either
within or without redevelopment project areas of the Agency to the
extent that it determines that such projects are of benefit to the
project areas of the Agency; and

WHEREAS, the Agency may undertake various blight removal
("" redevelopment acti vi ties (the "Blight Removal Acti vi ties") including

but not limited to the removal and disposal of debris, trash and
waste materials and the clearing of various rights-of-way and
adjacent land which rights-of-way are located both within and
without the boundaries of various redevelopment project areas of the
Agency if the Agency determines:
(1) that such Blight Removal
Activities are of benefit to the redevelopment project areas of the
Agency or the immediate neighborhoods in which the projects are
located, and (2) that no other reasonable means of financing such
Blight Removal Activities is available to the community; and
WHEREAS, it is in the interests of the City and the Agency
that the Agency causes the undertaking of the Blight Removal
Activities in order to remove blighting conditions from the major
thoroughfares within the City which thoroughfares provide access to
and from the various redevelopment project areas of the Agency; and
WHEREAS, the undertaking of the Blight Removal Activities
wi 11 promote the development of redevelopment proj ect areas wi thin
the City which project areas include: the Meadowbrook-Central City
Project Area, Central City North Project Area, Central City East
Proj ect Area, Central City South Proj ect Area, Central City West
Project Area, Tri-Cities Project Area, Southeast Industrial Park
Redevelopment Project Area, South Valle Project Area, State College
Project Area, Northwest Project Area and the Uptown Project Area, to

the extent that it will make such project areas more desirable for

'- industrial, commercial or residential development which in turn will
assist in the elimination of blight within such areas; and
WHEREAS, in order to promote the City's health, safety and
welfare and ensure the orderly development of the Agency's various
project areas, it is important that the Blight Removal Activities be
financed by the Agency; and
WHEREAS, it is appropriate at this time for the Mayor and
Common Counci 1 of the City (the "Counci l") to make certain findings
and determinations and take certain action with respect to the
financing of the Blight Removal Activities.
NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION ACTING
ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO
DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1.
The Recitals hereinabove
are
true
and
correct and are incorporated herein by this reference.
Section 2.
The Commission consents to the paYment by
the Agency of the costs of the Blight Removal Activities in order to
implement the redevelopment plans of the Agency for the reasons set
forth in the Recitals hereinabove. The Commission further finds and
determines that no other reasonable means of financing the Blight
Removal Activities is presently available to the City or the Agency

and that the City and the Agency require the use of revenues
C generated from the various project areas of the Agency in order to
fund the Blight Removal Activities.
Section 3.
The undertaking
of
the
Blight
Removal
Activities will allow the Agency to promote redevelopment within the
project areas of the Agency by eliminating blighting conditions on
the major arterials leading into and out of the project areas which
in turn will help stimulate development of such project areas and
their immediate neighborhoods.
Section 4.
The Secretary of the Commission is hereby
authorized and directed to cause this Resolution to be transmitted
to the Council for consideration in connection with appropriate

action by that body.
Section 5.
This Resolution shall take effect upon the
date of its adoption.
