HomeMy WebLinkAbout1991-5289 1 2 3 4 5 6 RESOLUTION NO. 5289 RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF CERTAIN UNDERGROUNDING IMPROVEMENTS FOR THE STATE COLLEGE REDEVELOPMENT PROJECT AREA WHEREAS, the City of San Bernardino, California (the 7 "City"), is a municipal corporation and a charter city duly 8 created and existing pursuant to the Constitution and the laws of 9 the State of California (the "City"); and 10 11 12 City of 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the community Development Commission of the (the "Commission") San Bernardino on behalf of the San Bernardino City (the Redevelopment of the of Agency "Agency"), is a redevelopment agency, a public body, corporate and pOlitic of the State of California, organized and existing Community Redevelopment to the (Part 1 of pursuant Law Division 24) commencing with section 33000} of the Health and Safety Code of the State of California (the "Act"); and WHEREAS, pursuant to section 33445 of the Act, the Agency may, with the consent of the Mayor and Common Council of the City (the "Council"), pay all or a part of the cost of construction building, facility, installation of and any structure or other improvement which is publicly owned either within or without the boundaries of a redevelopment project area if the Council determines: (l) that such buildings, facilities, benefit improvements to the other of structures are or redevelopment project area or the immediate neighborhood in which - 1 - the project is located, regardless of whether such improvement is within another project area, or in the case of a project area in which sUbstantially all the land is publicly owned that the improvement is of benef it to an adj acent proj ect area of the Agency, and (2) that no other reasonable means of financing such buildings, facilities, structures or other improvements is available to the community, and such determination by the Agency and the Council shall be final and conclusive; and WHEREAS, the city and the Commission have previously approved and adopted the Redevelopment Plan for the State College Redevelopment Project (the "Redevelopment Plan"); and WHEREAS, it is in the interests of the present landowners within the project area subject to the Redevelopment Plan (the "Project Area") and the residents, both within the Project Area and within the City generally, that the City causes the undergrounding of certain utility facilities in the vicinity of Kendall Drive and Palm Avenue (the "Undergrounding Improvements"); and WHEREAS, the Kendall Drive right-of-way is a major east-west arterial providing access to and from the Project Area and its improvement is necessary in order to ensure the health, safety and welfare of Project Area residents and occupants who frequently use Kendall Drive; and III III - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 '~ 28 WHEREAS, the Palm Avenue right-of-way is a north-south right-of-way adjacent to the Project Area located in a neighborhood which provides a residential base to the Project Area and accordingly, its improvement would provide a benefit for the Project Area and the residents of the neighborhood who undertake activities in the Project Area; and WHEREAS, development of the Undergrounding Improvements will improve aesthetics of the neighborhood and will create safer traffic conditions in areas adjacent to the Project Area which in turn will make the Project Area more desirable for residential and other development thereby benefiting said Project Area; and WHEREAS, in order to promote the city's health, safety and welfare, it is important that the Undergrounding Improvements required for the project Area be financed in order to ensure the orderly development of the Project Area and neighboring areas; and WHEREAS, it is appropriate at this time for the Agency to make certain findings and determinations and take certain action with respect to the installation of the Undergrounding Improvements. NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION ACTING ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: - 3 - 1 section 1. The Recitals hereinabove are true and 2 correct and are incorporated herein by this reference. 3 4 Section 2. The Commission consents to the payment 5 by the Agency of the costs of the Undergrounding Improvements to 6 be undertaken adjacent to the Project Area which are of benefit 7 to such Project Area and other neighborhoods within the City for 8 the reasons set forth in the Recitals hereinabove. The 9 commission further finds and determines that no other reasonable 10 means of financing the installation of the Undergrounding 11 Improvements is presently available to the City and that the City 12 and the Agency require the use of revenues generated from the 13 Project Area in order to fund the installation of the 14 Undergrounding Improvements. 15 16 17 18 19 20 21 22 23 section 4. The Secretary of the Commission is 24 hereby authorized and directed to cause this Resolution to be 25 transmitted to the Common Council for consideration in connection 26 with appropriate action by that body. 27 III 28 III section 3. The provision of the Undergrounding Improvements in the Project Area will improve traffic safety conditions in and around the Project Area which will make the Project Area more desirable for residential and other development which will in turn help eliminate blight within such Project Area and other areas of the city. - 4 - 1 RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING FINDINGS AND 2 DETERMINATIONS AS TO THE BENEFIT OF CERTAIN UNDERGROUNDING IMPROVEMENTS FOR THE STATE COLLEGE REDEVELOPMENT PROJECT AREA 3 4 section 5. The findings and determinations herein 5 shall be final and conclusive. '-' " 14 15 16 17 18 19 20 21 22 23 1 RESOLUTION NO. 91-187 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO MAKING FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF ASSISTING IN THE DEVELOPMENT OF A LOW- AND MODERATE- INCOME FAMILY RELOCATION PROJECT. 3 4 WHEREAS, the City of San Bernardino, California (the 5 6 7 "City" ), is a municipal corporation and a charter city duly created and existing pursuant to the Constitution and the laws of the State of California: and 8 9 WHEREAS, the Community Development Commission of the City of San Bernardino (the "Commission") on behalf of the 10 Redevelopment Agency of the City of San Bernardino (the 11 12 "Agency" ), is a redevelopment agency, a public body, corporate 13 and politic of the State of California, organized and existing pursuant to the Community Redevelopment Law (Part 1 of Division 24) commencing with Section 33000) of the Health and Safety Code of the State of California (the "Act"): and WHEREAS, the City and the Agency have previously approved and adopted the Redevelopment Plan for the State College Redevelopment Project, the Meadow Brook Central City Redevelopment Project, the Central City North Redevelopment Project, the Central City West Redevelopment Project, the Central City East Redevelopment Project, the Central City South Redevelopment Project, the Tri City Redevelopment Project, the South Valle Redevelopment Project, the Northwest Redevelopment 24 Project, the Mt. Vernon Corridor Redevelopment Project, the 25 26 27 28 Southeast Industrial Park Redevelopment Project and the Uptown Redevelopment Project (the "Redevelopment Plans"): and / / / DAB/ses/Family.res April 30, 1991 1 '. . c c t"""'" "- 18 1 WHEREAS, the Agency may, in furtherance of its 2 redevelopment purposes, undertake redevelopment projects and may 3 use revenues allocated to its low- and moderate-income housing 4 fund in accordance with Health and Safety Code Section 33334.2, 5 et seq., either within or without a redevelopment project area of 6 the Agency to the extent that it determines that the use of such 7 revenues are of benefit to the project area of the Agency: and 8 WHEREAS, the Agency deems it desirable to assist in 9 relocating certain low- and moderate-income households from 10 housing units in substandard condition which have been closed, to 11 decent, safe and sanitary living quarters (the "Project"), both 12 within and without designated project areas: and 13 WHEREAS, the Project will result in the relocation of a 14 number of low- and moderate-income households and it is in the 15 interests of the City and the Agency that the Agency causes the 16 undertaking of the Project in order to improve and increase the 17 community's supply of low- and moderate-income housing: and WHEREAS, the Project is located both within and withput 19 the project areas and will provide decent, safe and sanitary 20 living quarters to low- and moderate income families making all 22 21 of the project areas more desirable for development: and WHEREAS, the undertaking of the Project will promote the 23 development of the redevelopment project areas within the City to 24 the extent that it will also provide a decent; and safe 25 residential base to low- and moderate-income families who are 27 26 employed or engaged in business within such project areas of the 28 Agency which in turn will make such project areas more desirable for industrial and commercial development: and DAB/ses/Family.res April 30, 1991 2 c I"""" \...- I'" '-' 1 WHEREAS, in order to promote the City's health, safety and 2 welfare and ensure the orderly development of the Project Areas 3 it is important that the Project be assisted with Agency 4 financing; and 5 WHEREAS, it is appropriate at this time for the Mayor and 6 Common Council of the City (the "Council") and the Commission to 7 make certain findings and determinations and take certain action 8 with respect to the financing of the Project. 9 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION 10 ACTING ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN 11 BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: 12 SECTION 1. The Recitals hereinabove are true and correct 13 and are incorporated herein by this reference. 14 SECTION 2. The Commission consents to the payment by the 15 Agency of certain costs in connection with the relocation of 16 certain low- and moderate-income families to implement the 17 Redevelopment Plans of the Agency for the reasons set forth in 18 the Recitals hereinabove. The Commission further finds and 19 determines that no other reasonable means of financing the 20 Project is presently available to the City or the Agency and that 21 the City and the Agency require the use of low- and moderate- 22 income tax increment revenues generated from the Project Areas of 24 23 the Agency in order to assist in the funding of the Project. SECTION 3.
