Financial Impact: The two funding sources that support the award of this project are indicated below. The total estimated cost of construction is $159,620.28. Of that, $122,992.04 will come from project SD12-001 (Acct. No. 248-160-0025-5504-7940) and $36,628.24 will come from project SD-B (Acct. No. 248-160-0025-5504-7166). These are sufficient funds available for this project, using two separate Capital project accounts. 1. Synopsis of Previous Council Acfion: 07-OS-11 The Mayor and Common Council adopted the FY 2011-12 to FY 2015-16 Capital Improvement Program (5-year CIP). 12-OS-11 The Mayor and Common Council adopted a motion rejecting all bids for Culvert Repair at Base Line Street and Medical Center Drive, per Plan No. 12766 (SD 12- 001). Back round: The existing corrugated metal pipe culvert at the intersection of Base Line Street and Medical Center Drive has failed and is no longer capable of handling storm water flows. The proposed project would replace the existing culvert with a reinforced concrete culvert. Additionally, the project includes improvements to the adjacent catch basins, outlet, curb ramps, sidewalk, curb and gutter, and street paving. Notice inviting bids for the construction work was advertised in the San Bernardino County Sun Newspaper and on the City of San Bernardino website. The notice inviting bids and copies of the bid documents were also sent to the following plan rooms: F.W. Dodge Company; All Valley Reprographics and Plan Room; Construction Bidboard Inc.; San Diego Transcript; Bid America Electronic; AGC Plan Room; San Diego iSgFt Plan Room; Reed Construction Data; Constmction Bid Source; and Bid Ocean Inc. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. B & T Works, Inc., 23905 Clinton Keith Road, Ste. 114-352, Wildomaz, CA 92595, is the lowest responsible bidder for Culvert Repair at Base Line Street and Medical 9 to (t 12 13 l4 IS I 16 t7 16 19 20 2t 22 23 24 25 Center Drive, per Plan No. 12842 (SD 12-001). The contract is awazded accordingly to said bidder in a total amount of $133,016.90, but such contract shall be effective only upon being' fully executed by both parties. A copy of the contract is on file in the Office of the City Clerk and is incorporated herein by reference as though fully set forth aY length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, i modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. PART A ADMINISTRATION S.K.b Engineer's Estimate (Range Only): $ 110,000 to $125,000 NOTICE INVITING SEALED BIDS CITY OF SAN BERNARDINO Owner NOTICE IS HEREBY GIVEN that the City of San Bernardino (CITY) will receive bids for: CULVERT REPAIR AT BASE LINE STREET AND MEDICAL CENTER DRIVE (SD 12-001) in accordance with Special Provision No. 12842 on file in the Office of the City Engineer, Department of Public Works, Third Floor, San Bernardino City Hall. The Bid and Contract Documents may be obtained from the City Engineer's Office, Third floor, City Hall, 300 N. "D" Street, San Bemardino, California 92418, upon anon-refundable payment of 1$ 5.00 for each set if picked up in person. Upon request, the Bid and Contract Documents may be mailed for an additional charge of $10.00 per set. Electronic copy of the above documents are available upon request by contacting the City Engineer's Office and by providing a firm name, physical address, contact person, phone number and fax number for inclusion on the CITY's List of Plan Holders. It shall be the responsibility of those receiving electronic versions of the Bid and Contract Documents to provide the above listed information and confirmation of receipt of any issued addendum to the City Engineer's Office a minimum of one (1) business day prior to the scheduled day of the Bid Opening. The Contractor shall possess a Class "A" License or Appropriate Specialty License(s) at the time the contract is awarded. The prime Contractor shall perform, with his own organization, contract work amounting to at least 50 % of the contract price. All bids shall be signed, sealed and accompanied by cash, cashier's check, certified check or bid bond made payable to the City of San Bernardino, in the amount of ten percent (10%) of the bid. Such cash, check or bond shall be given as a guazantee that the bidder will enter into the contract if awazded to him. In the event the bidder refuses to execute said contract, the use by the public of the improvements will be delayed, and the public will suffer great damage. All bid forms shall be completed, signed, and sealed in accordance with these instructions and the instructions included with fhe individual bid forms. A bid that fails to include all bid forms will be considered non-responsive. 1.1 BID SCHEDULE The Bid Schedule shall be typed or clearly completed in ink. All spaces for unit prices, item totals, and total bid shall be completed. All prices shall be in dollars. For a lump sum item, the unit price shall match the item total price. The bidder shall make every effort to provide a legible and complete Bid Schedule. The bidder shall verify that its Bid Schedule is free of mathematical errors. If a Bid Schedule is found to contain minor errors or illegible entries, the bidder agrees that the Cily may, if deemed in the public interest, cure the error or entry, using one of the following methods: Mefhod A. If the sum of the item totals does not equal the total bid, but all item totals correctly indicate the products of the unit price and quantity, the City will consider the corrected sum of the item totals to be the Bidder's total bid. Method B. If the sum of the item totals equals the total bid, but the product of a unit price and a quantity does not equal the stated item total, the City will determine a correct unit price by dividing the item total by the item quantity. 2.0 BID GUARANTY Bids shall be accompanied by cash, cashier's check or bid bond made payable fo the City of San Bernardino, in the amount of ten percent (10%) of the bid. Such cash, check or bond shall be given as a guaranty that the bidder will enter into and execute the contract if it is awarded to the bidder. Any bid not accompanied by a bid guaranty in the form of cash, check, or bond will be rejected as invalid. In the event the bidder, to whom the contact is awarded, refuses to execute said contract, and/or fails to fle the necessary bonds and insurance certificate within ten (10) working days following the date of the CITY's Notice of Award letter, the Bidder shall be considered as not fully executing the contract. By not executing the contract, the use by the public of the improvements will be delayed and the public will suffer great damage. From the nature of the case, it would be extremely difficult and impractical to fx the amount of said damage. Therefore, the CITY and the bidder agree that the bid guaranty of 10% of the bid shall be paid to the CITY as liquidated damages and not as forfeiture. Bid bonds shall be underwritten by a surety company having a rating in Best's most recent Insurance Guide of "A" or better. Bonds must be issued by a surely who is listed in the latest version of U.S. Department of Treasury Circular 570 and is authorized to issue bonds in the State of California. The Bid Bond Form is contained in Part A of the Bid and Contract Documents. Notarization of the signatures of the Principal and the Surety and the Power of Attorney of fhe signing Surety shall accompany this form. 3.0 TAXES No mention shall be made in the proposal of Sales Tax, Use Tax, or any tax, as all amounts bid will be deemed and held to include any such taxes, which may be applicable. 4.0 INTERPRETATION OF PLANS AND DOCUMENTS If any person contemplates submission of a bid for the proposed contract and is in doubt as to the true meaning of any part of the services to be performed, they may submit a written request for an interpretation or correction S.K.h ` thereof. The person submitting the request will be responsible for its prompt delivery by 5:00 p.m. of th working day prior to the day of the proposed bid opening. Any interpretation or correction of the proposed documents shall be made only by addendum duly issued and wpy of such addendum will be faxed and mailed or delivered to each person of record as receiving a set of such documents. The CITY will not be responsible for any other form of explanation or interpretation of the proposed documents. 5.0 ADDENDA All Bidders are advised as to the possibility of issuance of addenda affecting the items, scope or quantity of the work required for this project. Each Bidder shall be fully responsible for informing themselves as to whether or not any such addenda have been issued. The effect of all addenda to the Contract Documents shall be considered in the bid and said addenda shall be made a part of the Contract Documents and shall be returned with them. Failure to cover in a bid any such addenda issued may render the bid irregular and may result in its rejection by the CITY. Addenda issued during the time of bidding shall become a part of the documents furnished to all bidders far the d preparation of bids, shall be covered in the bids, and shall be made a part of the contract. Each Bid shall ~ include specifc acknowledgement in the space provided of receipt of all addenda issued during the bidding period. Failure to so acknowledge Addenda may result in the Bid being rejected as not responsive. 6.0 SUBCONTRACTOR DESIGNATION Each Bid shall have listed therein the name and address of each subcontractor to whom the bidder proposes to subcontract portions of the work in the amount of 1/2 of one percent of his total bid or $10,000.00, whichever is greater, in accordance with the Subletting and Subcontracting Fair Practices Act, commencing with Section 4100 of the Public Contract Code. The Bidder's attention is invited to other provisions of said Act related to the imposition of penalties for a failure to observe its provisions by using unauthorized subcontractors or by making unauthorized substitutions. The Subcontractor Designation Form is included in Part A of the Bid and Contract Documents. 7.0 REQUIRED EXAMINATION OF ALL CONTRACT DOCUMENTS Before submitting a Bid, each Bidder shall thoroughly examine and be familiar with the Specifications, Plans, Addenda, and all other Contract Documents. The submission of a Bid shall constitute an acknowledgement upon which the CITY may rely that the Bidder has thoroughly examined and is familiar with all the Contrail Documents. The failure or neglect of a Bidder to receive or examine any of the Contract Documents shall in no way relieve that Bidder from any obligation with respect to its Bid or to the Contract. No claim for additional compensation will be allowed which is based upon a lack of knowledge of the Contract Documents. The Bidder shall not be allowed any extra compensation by reason of any matter or thing, concerning that which such Bidder might have fully informed himself prior to the bidding. No Bidder shall at any time after submission of a bid make any claim or assertion that there was any misunderstanding or lack of information regarding the nature or amount of work necessary for the satisfactory completion of the job. 8.0 REQUIRED INSPECTION OF THE SITE 5.K.b ' Bidders are required to inspect the site of the proposed work to satisfy themselves by personal examination, or by such other means as they may prefer, of the location of the proposed work, and of the actual conditions, including subsurface of, and at, the site of the proposed work. If, during the course of examination, a Bidder finds facts or conditions that appear to be in conflict with the letter or spirit of the bidding documents, the Bidder shall notify the Engineer immediately. Submission of a Bid by the Bidder shall constitute conclusive evidence that, if awarded the Contract, it has relied and is relying on its own examination of the following: (1) The site of the proposed work; (2) Access to the site; (3) All other data and matter requisite to the fulfillment of the work; (4) The Bidder's own knowledge of existing facilities on and in the vicinity of the site of the proposed work under the Contract; (5) The conditions to be encountered; (8) The character, quality, scope and complexity of the proposed work; (7) The quality and quantity of the materials to be furnished; and (8) The requirements of the Specifications, Plans, any addenda, or any other Contract Documents. The information provided by the CITY is not intended to be a substitute for, or a supplement to, the independent verification by the Bidder to the extent such independent investigation of site conditions is deemed necessary or desirable by the Bidder. 9.0 WITHDRAWAL OF BIDS A Bid may be withdrawn by a written request signed by the Bidder. Such requests must be delivered to the CITY's designated official prior to the bid opening hour stipulated in the "Notice Inviting Sealed Bids" or an amended date and hour stipulated in a signed addenda to the Bid and Contract Documents. The withdrawal of a bid will not prejudice the right of the Bidder to submit a new bid, providing there is time to do so. Bids may not be withdrawn after said bid opening hour without forfeiture of the bidder's bid guaranty. 10.0 IRREGULAR BIDS Unauthorized conditions, limitations, or provisions attached to a bid will render it irregular and may cause its rejection. The completed bid forms shall be without interlineations, alterations, or erasures. No oral, telegraphic, or telephonic bid, modification, or withdrawal will be considered. 11.0 DISQUALIFICATION OF BIDDERS In the event that any Bidder acting as a prime contractor has an interest in more than one submitted bid, all such submitted bids will be rejected and the Bidder will be disqualified. This restriction does not apply to subcontractors or suppliers who may submit quotations to more than one Bidder and, while doing so, may also submit a formal bid as a prime contractor. 12.0 MINORITY BUSINESS ENTERPRISE AND WOMEN BUSINESS ENTERPRISE GOALS The Disadvantaged Business Enterprise (DBE) participation goal for this project is 7.5 percent. A bidder meets this goal if the bid demonstrates that not less than 7.5 percent of the total bid price will be performed by a certified DBE contractor or subcontractor. Certified DBE participation shall be documented on the Certified DBE Designation form provided in Part A of the Bid and Contract Documents. Certified DBE contractors or subcontractors must be listed on the Caltrans DBE certification database at htta:/lwww.dot.ca.aov/hu/begfflnd certified.htm. If a bidder is unable to meet the DBE participation goal, the bidder shall demonstrate that a good faith effort was made to meet the goal. Prior to the completion of construction, the surveyor shall (1) replace any survey monument disturbed by the contractor, (2) place or replace survey ties by transit method to locate all survey monuments, and (3) fle Corner Records documenting the new conditions. The transit method requires that ties define the location of two intersecting lines which intersect at the location of the monument. Ties shall be located at the top of curb. The Contractor shall submit copies of all Corner Records and proof of recording to the Engineer. The surveyor and contractor shall satisfy the requirements of Survey Monument Preservation Guidelines included in the Appendix. Full compensation for the work described in this subsection shall be considered as included in the lump sum bid price for Surveying, and no additional compensation shall be allowed. 2-9.2 Survey Service. Replace the entire subsection with the following: The Contractor shall be responsible for hiring a Civil Engineer or Land Surveyor to perform and be responsible for the accuracy of surveying adequate for construction. A working day is any day within the period between the date of the start of the Contract time as specified in 6-1 and the date of feld acceptance of the Work by the Engineer, other than: 1. Saturday and Sunday. 2. January 2, 2012; January 16, 2012; February 20, 2012; May 28, 2012; July 4, 2012; September 3, 2012; November 12, 2012; November 22, 2012; December 24, 2012; December 25, 2012; December 31, 2012; and January 1, 2013. 3. Any day designated as a holiday in a Master Labor Agreement entered into by the Contractor or on behalf of the Contractor as an eligible member of a contractor association. 4. Any day the Contractor is prevented from working at the beginning of the workday for cause as specified in 6-6.1. 5. Replace the entire subsection with the following 7-10.1.7 General. The Contractor's operations shall cause no unnecessary inconvenience to the public or businesses in the vicinity of the Work. The Contractor shall have no greater length or quantity of Work under construction than can be properly prosecuted with a minimum of inconvenience to the public and other contractors engaged in adjacent or related work. The Contractor shall provide continuous and unobstructed access to the adjacent properties unless otherwise approved by the Engineer. The Contractor shall not close more than two (2) traffic lanes at a time. Traffic lane closures shall conform to the requirements of the approved Traffic Control Plan. Traffic lane closures shall only be permitted between the hours of 8:00 a.m. and 4:00 p.m. on designated working days during times of active construction operations. Traffic shall be permitted to pass through the Work site, unless otherwise shown on the Traffic Control Plan. Safe, adequate, and ADA compliant pedestrian access shall be maintained unless otherwise approved by the Engineer. All costs incurred tc comply with the requirements of this subsection shall be included in the lump sum bid price for Traffic Control. SP-7 .,....5...Kb:. Add the following subsections: 7-70.2 Work Area Traffic Control. 7-10.2.1 General. Work area traffic control shall conform to the California Manual of Uniform Traffic Control Devices. The total length of traffic control zone shall include a buffer space, advance signing, striping transitions in advance of the Work site, existing striping, signing, and raised medians. All costs incurred to comply with the requirements of this subsection shall be included in the lump sum bid price for Traffic Control. 7-10.2.2 Traffic Control Plan. 7-10.2.2.1 General. The Contractor shall prepare Traffic Control Plans depicting the layouts, methods, and devices that will be used to satisfy the requirements of subsections 7-10.1 and 7-10.2 of these special provisions. Traffic Control Plans shall be provided for each phase of the Work. At the Pre-Construction Meeting, the Contractor shall submit two copies of the Traffic Control Plans to the Engineer. The Contractor shall incorporate into the Traffic Control Plans any modifications requested by the Engineer. 7-10.2.2.2 Payment. Payment for preparation of the Traffic Control Plan shall be included in the lump sum bid price for Traffic Control. 7-10.3 Street Closures, Detours, Barricades. Delete the entire subsection. The requirements of this subsection are covered under subsections 7-10.1 and 7-10.2. SECTION 9 -MEASUREMENT AND PAYMENT 9-3 Payment. 9-3.2 Partial and Final Payment. Add the following: The Contract shall submit "As Built" project drawings to the Engineer prior to the release of Tinal payment and/or bonds. 9-3.3 Delivered Materials. Replace the entire subsection with the following: No payment will be made for materials which are delivered but not incorporated into the Work. 9.3.4 Mobilization. Replace the entire subsection with the following: When a bid item is included in the Bid for "MOBILIZATION", the costs of work in advance of construction operations and not directly attributable to any specific Bid item will be included in the progress estimate. When no such Bid item is provided, payment for such costs will be considered to be included in the payment for the various items of work. Mobilization may include, but not be limited to, the following: 1. Submittal and modification, as required, of the Construction Schedule. 2. Establishing work and storage areas. 3. Review of the Site. 4. Obtaining all required Transportation Permits. 5. Submittal of all required insurance certificates and bonds. 6. Moving personnel, equipment, materials, and incidentals to the Work Site. 7. Installing construction fencing and temporary construction power and wiring. SP-8 8. Establishing a minimum of one toilet facility and one washing station for each 20 employees or fraction thereof. 9. Establishing temporary utilities. 10. Establishing fire protection facilities. 11. Posting OSHA notices and establishing safety programs. 12. Posting Department of Labor notices. 13. Having the Contractor's representative available full time at the job site during work hours, and available 24 hours per day for emergency contact. 14. Establishing air and water quality protection measures. 15. Potholing and other research and review necessary to verify site conditions and underground utility locations. 16. Demobilization of the Site. The cost of bonds, insurance, move in and move out costs, preparation and submission of submittals, obtaining encroachment permits, and miscellaneous incidental costs, shall be included in the Bid Item provided for mobilization and demobilization and incidental project costs as a lump sum item, for which 75 peroent (75%) will be eligible for inclusion in the first progress payment, with the remaining 25 percent (25°k) not eligible for inclusion until 100 percent (100%) of the work has been completed and if progress of the work is satisfactory. No work shall be started without prior approval of the submittals. Failure to comply with the preceding requirement will be sufficient ground for the Engineer to stop all work on the project until the requirements are met. SP-9 PART 2 CONSTRUCTION MATERIALS The following sections of the Special Provisions supplement and amend the Standard Specifications for Public Works Construction 2009 Edition. As a reference convenience, these sections are arranged in a format that parallels the Standard Specifications. SECTION 200 -ROCK MATERIALS 200-2 UNTREATED BASE MATERIALS. 200-2.1 General. Replace the entire subsection with the following: Untreated base or sub-base shall be Crushed Aggregate Base. All processing or blending of materials to meet the grading requirement shall be performed at the plant or source. The materials shall compact to a hard, firm, unyielding surface and shall remain stable when saturated with water. SECTION 201 -CONCRETE, MORTAR, AND RELATED MATERIALS 201-1 PORTLAND CEMENT CONCRETE. 201-1.1 Requirements. 201-1.1.2 Concrete Specified by Class and Alternate Class. Add the following Where asphalt concrete is constructed in two layers or more, the class and grade for the asphalt concrete base course shall be B-PG 64-10. Where asphalt concrete is constructed in a single layer, or for a finishing course or asphalt concrete overlay, the class and grade of the asphalt concrete shall be C2-PG 64-10. SECTION 206 -MISCELLANEOUS METAL ITEMS 206-3 GRAY IRON CASTINGS. 206-3.3 Manhole Frame and Cover Sets. Add the following The manhole frame and cover shall be constructed in accordance with SPPWC Standard Plan No. 630-3. The manhole cover shall be cast with the following agency identifcalion in 2-inch letters: "CITY OF SAN BERNARDINO" and with the letter "D" for storm drain, placed in the center of the cover. The letter "D" shall be 2-1/2 inches high with a % inch line width. SECTION 209 -STREET LIGHTING AND TRAFFIC SIGNAL MATERIALS 2093 COMPONENTS FOR STREET LIGHTING AND TRAFFIC SIGNAL SYSTEMS. 209-3.7 Pull Boxes. Replace the first sentence of the subsection with the following: Pull boxes and covers shall be size No. 5 constructed of Portland cement concrete in accordance with SPPWC Standard Plan No. 405-1. Pull boxes shall be constructed with vandal resistant pull box inserts manufactured by McCain (www.mccain-inc.com) or approved equal. Pull box covers shall be cast with the following identification: "TRAFFIC SIGNAL". 209.5 TRAFFIC SIGNAL MATERIALS. 209-5.8 Detectors. 209-5.8.2 Inductive Loop Detectors. Add the following: Loop detectors shall be 6 feet diameter circular loops, Type E, conforming to Caltrans Standard Plan ES- SB. SECTION 210 -PAINT AND PROTECTIVE COATINGS 210-1 PAINT. 270-t.6 Paint for Traffic Striping, Pavement Marking, and Curb Marking. 210-1.6.7 General. Replace the first sentence with the following: Paint for traffic striping and marking shall be thermoplastic type and shall conform to the requirements of TABLE 210-1.6.1 (A). SP-11 S.K.b' PART3 CONSTRUCTION METHODS The following sections of the Special Provisions supplement and amend the Standard Specifications for Public Works Construction 2009 Edition. As a reference convenience, these sections are arranged in a format that parallels the Standard Specifications. SECTION 300 -EARTHWORK 300-1 CLEARING AND GRUBBING. 300-1.1 General. Add the following: In addition to the items specified in this subsection, clearing and grubbing shall include the removal and disposal of the existing pipe culvert, culvert manhole, catch basins, outlet structure, local depressions, driveway approaches, curb, gutter, sidewalk, and asphalt concrete pavement, as indicated on the Plans. 300-1.3 Removal and Disposal of Materials. 300-1.3.1 General. Replace the entire subsection with the following: Objectionable materials removed by the Contractor during clearing and grubbing operations shall become the property of the Contractor and the Contractor shall be responsible for the lawful disposal of these materials, except as follows: During removal of the existing culvert system, the Contractor shall collect the three manhole covers serving the system, and a drain cleaning nozzle that is stuck in the pipe culvert near the Base Line Street centerline. The Contractor shall deliver the manhole covers and cleaning nozzle to the City Yard at 234 South Mountain View Avenue, San Bernardino, CA 92408 during normal business hours. The Contractor shall notify the Operations and Maintenance Division at 909-384-5045 at least one working day prior to delivery. 300-1.3.2 Requirements. a) Bituminous Pavement. Replace the second sentence with the following: Edges to be joined shall be saw cut to the full depth of the existing bituminous pavement SECTION 302 -ROADWAY SURFACING 302-5 ASPHALT CONCRETE PAVEMENT. 302-5.1 General. Add the following: In the overlay areas shown on the Plans, asphalt concrete pavement shall be placed in a single fnish course at a thickness of 2.0 inches, and the class and grade of the asphalt concrete shall be C2-PG 64-10. In the reconstruction areas shown on the Plans, the asphalt concrete pavement base course shall be placed at a thickness of 2.0 inches, and the class and grade of the asphalt concrete shall be B-PG 64-10. 302.5.9 Measurement and Payment. Replace the first sentence with the following: Asphalt concrete pavement will be paid for at the Contract Unit Price per ton as shown in the Bid. SP-12 S.K.b:'. SECTION 303 -CONCRETE AND MASONRY CONSTRUCTION 303-1 CONCRETE STRUCTURES. 303-1.1 General. Add the following: Box Culverts. The box culvert system shall be constructed in accordance with the Plans. The box culvert system outlet shall include a galvanized steel angle constructed in accordance with City of San Bernardino Standard Plan No. 400. The box culvert system shall be connected to catch basins in accordance with the Plans. Box Culvert Manholes. The box culvert system shall be constructed with two, 24 inch manholes as indicated on the Plans. At the manholes locations indicated, 24 inch diameter holes shall be provided in the steel plate. Manholes shall be constructed using the reinforced concrete rings and construction methods specified in the SPPWC Standard Plan No. 324-2. The reinforced concrete rings shall be secured to the steel plate of the box culvert using four, 3 inch long sections of 3 inch by 3 inch by 1/2 inch steel angle. The steel angle sections shall be welded at 90 degree intervals along the perimeter of the concrete ring. Two sides of the each angle section shall be joined to the steel plate using 2 inch long, 114 inch fillet welds. Catch Basins. Catch basins shall be constructed in accordance with SPPWC Standard Plan No. 302-3. Catch basins shall be connected to the box culvert in accordance with the Plans. Catch basin reinforcement shall comply with the Plans and SPPWC Standard Plan No. 309-2. Catch basin face plate assembly and protection bar shall comply with SPPWC Standard Plan No. 310-3. Catch basin frame and grating shall comply with SPPWC Standard Plan No. 311-3, amended as follows: The grating design shall pose no hazard to bicyclists. 303-1.7 Placing Reinforcement 303.1.7.1 General. Delete the first sentence of the subsection. 303-1.7.2. Splicing. Replace the first sentence with the following: Splices shall be permitted only for bars placed longitudinally within the box culvert system. 300-3 STRUCTURE EXCAVATION AND BACKFILL. 300-3.5 Structure Backfill. 300-3.5.1 Requirements. Add the following: Structure backfill for the box culvert shall be concrete class 100-E-100 with a maximum slump of 5 inches. The cost for this backfill shall be considered as included in the price for the construction of the box culvert. 303.5 CONCRETE CURBS, WALKS, GUTTERS, CROSS GUTTERS, ALLEY INTERSECTIONS, ACCESS RAMPS, AND DRIVEWAYS. 303-5.1 Requirements. 303-5.1.1 General. Add fhe following: Curb and Gutter. Curb and gutter shall be constructed in accordance with City of San Bernardino Standard Plan Nc. 200, Type B, amended as follows: The concrete class shall be 560-C-3250. S.K.b ' Sidewalk. Sidewalk shall be constructed in accordance with City of San Bernardino Standard Plan No. 202, Case °A", amended as follows: Sidewalk width and location shall be as indicated on the Plans. Curb Ramps. Curb ramps shall be constructed in accordance with SPPWC Standard Plan No. 111-4. Local Depressions. Local depressions shall be constructed in accordance with the Plans and SPPWC Standard Plan No. 313-3, Case F, H=O, K=5 ft. SECTION 307 -STREET LIGHTING AND TRAFFIC SIGNAL SYSTEMS 307-11 PULL BOXES. 307-11.1 General. Add the following to the subsection: Pull boxes shall be constructed in accordance with SPPWC Standard Plan No. 405-1. Pull boxes within the sidewalk reconstruction areas indicated on the Plans shall be replaced with new pull boxes, covers, and extensions. Pull boxes shall be raised or lowered to match new sidewalk sudace elevations. Pull boxes shall be constructed with vandal resistant pull box inserts, and covers. 307-17 TRAFFIC SIGNAL CONSTRUCTION 307-17.7 Vehicle Detectors. 307-17.7.3 Inductive Loop Detectors. 307-17.7.3.2 Installation Details. Replace the second and third sentences of the first paragraph in the subsection with the following: Slots for Type E loops shall have vertical sides and a width of 5/8 inch. The slot entering and leaving the circular part of the loop shall have a minimum radius of 1.5 inches to prevent damage to the conductors. Replace the first sentence of the fifth paragraph of the subsection with the following: The inductive loop detectors constructed for this project replace the existing loop detectors, and shall terminate within new pull boxes that match the location of the existing pull boxes. Loop conductors shall be installed without splices and shall not penetrate curbs and gutters. Replace the first sentence of the last paragraph of the subsection with the following: Loop detectors shall be installed prior to placing the asphalt concrete surface course. SECTION 310 -PAINTING 310-5 PAINTING VARIOUS SURFACES. 310.5.6 Painting TrafTic Striping, Pavement Markings, and Curb Markings. 310.5.6.1 General. Add the following to the subsection. The work shall include the replacement of all traffic striping and pavement markings disturbed by the pavement construction work. SP-14 Traffic striping and pavemerd marking shall be installed in accordance with the following California MUTCD Details: Solid Double Yellow Line Detail 21 8 Inch Solid White Line Detail 36A 12 Inch Solid Yellow Crosswalk No applicable detail Left Turn Arrow Type IV (L) Right Turn Arrow Type IV (R) 3105.6.10 Measurement and Payment. Replace the first sentence of the suhsection with the following: Traffic striping and marking shall be measured and paid as a lump sum. SP-15 S:Kb`„' APPENDIX N 5:K.b STATE OF CALIFORNIA DEPARTMENT OF INDUSTRIAL RELATIONS APPRENTICESHIP PROGRAM FOR PUBLIC WORKS CONSTRUCTION S.Kb' ` EXCERPTS FROM THE CALIFORNIA LABOR CODE RELATING TO APPRENTICES ON PUBLIC WORKS Chapter 1 of Division 2 APPRENTICES ON PUBLIC WORKS 1773.3. An awarding agency whose public works contract falls vrithin the jurisdiction of Section 17725 shall, within five days of the award, send a copy of the award to the Division of Apprenticeship Standards. When specifically requested by a local joint apprenticeship committee, the division shell notify the local join[ apprcntieeship committee regarding alt such awards applicable to the joint apprenticeship committee making the request. Within five days of e finding of any discrepancy regarding the ratio of apprentices to joumeymen, pursuant to the certificated fined number of apprentices to joumeymen, Lhe awazding agency shall notify the Division of Apprenticeship S[andazds. 1776. (a) Each contractor and subcontractor shall keep accurate payroll records, showing the name, address, social security number, work dassification, straight time and overtime hours worked each day end week, and the actual per diem wages paid to each journeyman, apprentice, worker, or other employee employed by him or her in connection with the public work. Each payroll record shall contain ar be verified by a written dedara[ion that it is made under penalty of perjury, stating both of the following: (I) The information contained in the payroll record is tme and correct (2) The employer has complied with the requirements of Sections 1771, 1811, and 1815 for any work performed by his or her employees on the public works project. (b) The payroll records enumerated under subdivision (a) shall be certified and shall be available for inspection at all reasonable hours at the principal office of the contractor on the following basis: (lj A certified copy of an employee's payroll record shall be made availebk for inspection or tarnished to the employee or his or her authorized representative an request. (2) A certified copy of all payroll records enumemted in subdivision (eJ shall be made available for inspection or famished upon request to n mprcsentetive of the hotly awarding the contmct, the Division of Labor Standards En[orcemenp and the Division of Appzemiceship Standards of the Department of Industrial Relations. (3J A certified copy of all payroll records enumerated in subdivision laj shell be made available upon request by the public for inspection or for copies thereof. However, a request by fhe public shall be made through either the body awarding the contract, the Division of Apprenticeship Standards, or the Division oC Labor Standards Enforcement. If the requested payroll records have not been provided pursuant to paragraph (2), the requesting party shall, prior to being provided the records, reimburse the costa of preparation by the contractor, subrnntractors, and the entity through which the request was made. The name and address of the contractor awarded the contract or the subcontractor performing [he contract shell not be marked or obliterated. Any copy of records made available for inspection by, or furnished to, a join[ lahor- management committee established pursuant to the federal Labor Management Cooperation Act of 1978 (Section 178a of Title 29 of the United States Code) shall be mazked or obli[eraed roily to prevent disclosure of an individual's name and social security number. A joint labor management committee may maintain an action in a court of competent jurisdiction against an employer who fails to comply with Section 1774. The court may award restitution to an employee for unpaid wages and may award the joint labor management committee reasonable attorneys fee and costs incurred in maintaining the action. An action under this subdivision may not be based on the employees misclassification of the craft of a worker on its certified payroll records. Nothing in this subdivision limits any other available remedies for a violation of this chapter. IQ The contractor shell inform the body awarding the contract of the location of the records enumerated under subdivision (a), including the street address, city and county, and shall, within five working days, provide a notce of a change of location end adtlress. fgf The contractor or subcontractor shall have 10 days in which to comply subsequent to receipt oC a wdt[en notice requesting the records enumerated in Subdivision (aJ. Upon the request of the Division of Apprenticeship 5tandania or the Division of Labor Standerets Enforcement, Iheae penalties shell be withheld from progress payments then due. A contractor is not subject to a penalty assessment pursuant to this section due to the failure of a subcontractor to comply with this section. (h) The body awarding the contract shall cause to be inserted in the contract stipulations to effectuate this section. (i) The director shall adopt rules consistent with the California Public Records Act, (Chapter 3.5 (commencing with Section 6250), Division 7, Title 1, Government Coded and the Information Practices Act of 1977, (75t1e 1.8 (crommencing with Section 1798), Pazt 4, Division 3, Civil Code( governing the release of these records, including the establishment of reasonable Cees to be charged for reproducing copies of records required by this section. The employment and [raining of each apprentice shall 6e in accordance with either (1) the apprenticeship standards and apprentice agreements under which he or she is training or (2) the rvl<s end regulations of the CalHomie Apprenticeship Council. (d) When the contractor to whom the contract is awarded by the state or any political subdivision, in performing any of the work under the contract, employs workers in any apprenticeable craft or trade, the contractor shall employ apprentices in at least the ratio set forth in this section and may apply to any apprenticeship program in 2 the craft or trade that can provide apprentices [o [he site of the public work for fl certificate approvfag the contractor under the apprenticeship standards for the employment and training of apprentices in the azea or industry effected. However, the decision of the apprenticeship program to approve or deny a certificate shall be subject to review by the Administrator of Apprenticeship. The apprenticeship program or programs, upon approving the contractor, shall arrange for the dispatch of apprentices to the contractor. A contractor covered by an apprenticeship program's standards shall not be required to submit any additional application in order to include additional public works contracts under that program. "Apprenticeable craft or trade;' as used in this section, means a craft or trade determined as an apprenticeable occupation in accordance with rules and regulations prescribed by the California Apprenticeship Council. As used in this section, "contractor" includes any subcontractor under a rontracror who performs any public works not excluded by subdivision (o). (e) Prior to commencing work on a contract for public works, every contractor shalt submit contract award information to an applicable apprenticeship program that can supply apprentices to the site of the public work. The information submitted shall include an estimate of journeyman hours to be performed under the contract, the number of apprentices proposed to be employed, and the approximate dates the apprentices would be employed. A copy of this information shall also be submitted m the awarding body U requested by the awarding body. Within 60 days after concluding work on the contract, each contractor and subcontractor shall submit to the awarding body, if requested, and to the apprenticeship program a verified statement of the joumeyman and apprentice hours performed on the rontract. The information under this subdivision shall be public. The apprenficeship programs shall retain this information for 12 months. (t) The apprenticeship program chat can supply apprentices to the area of the site of the public work shall ensure equal employment and affirmative action in apprenticeship for women and minorities. (gJ The ratio of work performed by apprentices to journeymen employed in a particular craft or trade on [he public work may be no higher than the ratio stipulated in the apprenticeship standads under which the apprenticeship program operates where the contractor agrees to be bound by those standards, but, except as otherwise provided in this section, in no case shall the ratio be less than one hour of apprentice work for every five hours oC joumeyman work. (h) This ratio of apprentice work to joumeyman work shall apply during any day or portion of a day when any journeyman is employed at the jobsite and shall be computed on the basis of the hours worked during the day by journeymen so employed. Any work performed by ajourneyman in excess of eight hours per day or 40 hours per week shall not be used to calculate [he ratio. The conUac[or shall employ apprentices for the number of hours computed as above before the end of the contract or, in the case of a subcontractor, before the end of the subcontract. However, the contractor shall endeavor, to the greatest extent possible, to employ apprentices during [he same time period that the journeymen in the same craft or trade are employed at the jobsite. Where an hourly apprenticeship ratio is not feasible for a particular craft or trade, the Chief of the Division of Apprenticeship Standards, upon application mf an apprenticeship program, may order a minimum ratio of not less than one apprentice for each rive joumeyman in a craft or trade classification. (i) A contractor covered by this section that has agreed [o be covered by an apprenticeship program's standards upon the issuance of the approval certificate, or that has been previously approved for an apprenticeship program in the craft or Vade, shall employ the number of apprentices or the ratio of apprentices to journeymen stipulated in the applicable apprenticeship standards, but in no event less then the 1-to-6 ratio required by subdivision (g). GI Upon proper showing by a contractor [ha[ he or she employs apprentices in a particular craft or trade in the state on all of his or her contracts on an annual average of not less then one hour of apprentice work for every five hours of labor performed by joumeyman, the Chief of the Division of Apprenticeship Standards may grant a certificate ezemptmg [he contractor from the 1-to-5 hourly ratio, as set forth in this section far that craft or trade. (k) An apprenticeship program has [he discretion to grant to a pazticipating contractor or contractor association a certificate, which shall be subject to [he approval of the Administrator of Apprenticeship, exempting the contractor from the 1-to-5 ratio set forth in this section when it (finds that any one of the following conditions is met (Ij Unemployment for the previous three-month period in [he area exceeds an average of 15 percent. (2) The number of apprentices in training in the area ezeceds a ratio of I to 5. (3) There is a showing that the apprenticeable craft or trade is replacing at least one-thirtieth of its journeymen annually through apprenticeship training, either on a statewide basis or on a local basis. (4) Assignment oC an apprentice to any work performed antler a public works contract would create a condition that would jeopardize his or her life or the life, safety, or property of fellow employees or [he public et large, or the specific task to which the apprentice is to be assigned is of a nature that training cannot be provided by a journeyman. IL) When an exemption is granted pursuant to subdivision (k) to an organization that represents contractors in a specific trade from the 1-to-6 ratio on a local or statewide basis, the member contractors will not be required to submit individual applications for approval to local join[ apprenticeship committees, if they are already covered by the local apprenticeship standards. (m) (I) A contractor to whom a contract is awarded, who, in performing any of the work under the contract, employs joumeyman or apprentices in flay apprenticeable crag or trade shall contribute to the California Apprenticeship Council the same amount that the director determines is the prevai]irg amount of apprenticeship training convibutions in the area of the public works site. A contractor may take as a credit for payments to the council any amounts paid by the contractor to an approved apprenticeship program that can supply apprentices m the site of the public works project. The contractor may add the amount of the contributions in computing his or her bid for the contract. (21 At the conclusion of each fiscal year, the California Apprenticeship Council shall distribute veining contributions received by the council under this subdivision, less the expenses of the Division of Apprenticeship Standards for administering this subdivision, by making grants to approved apprenticeship programs for the purpose of training apprentices. The tondo shall be distributed as follows: (A) If [here is an approved multiemployer apprenticeship program serving the same craft or trade end geographic area for which the training conMbutions were made to the council, a grant to that program shall be made. (B~ If there ere two or mare approved multiemployer apprenticeship programs serving the same crag or trade and geographic area for which the training contributions were made to the council, the grant shall be divided among those programs based on the number of epprenhces registered in each program. (C) All training contributions not distributed under subparagraphs (A) and (B) shall be used to defray the future expensex of administering this subdivision. (3) A11 veining. contributions rceeived pursuant to this subdivision shall be deposited in the Apprenticeship Training Contribution Fund, which Cund is hereby created in the State Treasury. Notwithstanding Section 13340 of the Govemmtni Code, all money in the Apprcnticeahip Training Contribution Fund is hereby continuously appropriated tar the purpose of cazrying out [his subdivision and to pay the expenses of the divisimt in administering this subdivision. (n) The body awarding the contract shall cause m be inserted in the contract stipulations to effectuate this section. The stipulations shall fix the responsibility of compliance with this section for all apprenficeable omupations with the prime contractor. (o( This section does not apply to contracts of general contractors or to contracts of specialty contractors not bidding for work through a general or prime contractor when the contracts oC general contractors or those specialty contractors involve less than thirty thousand dollars 1$30,0001, lpl All decisions of an apprenticeship program under [his section are antrject to Section 3081. 1777.6. It shall be unlawful for an employer or a labor union to refuse to accept otherwise qualified employees as registered apprentices on any public works, on [he ground of the race, religious creed, roloq national origin, ancestry, sex, or age, except as provided in Section 3077, o(such employee. 1777.7. la) h( A convector or subcontractor that is determined by the Chief of the Division of Apprenticeship Standards Lo have knowingly violated Section 1777.5 shall forfeit as a civil penalty an amount not exceeding one hundred dollars ($100) for each full calendar day oC noncompliance. The amount of this penalty may be reduced by the Chief if the amount of the penalty would be disproportionate to the severity of the violation. A contractor or subcontractor that knowingly commits a second or subsequent vielahon of Section 1777.5 within athree-year period, where tha noncompliance results in apprenticeship training not being provided es required by this chapter, shell forfeit as a civil penalty rite sum of not more than three hundred dollars ($3001 Cor each full calendar day of noncompliance. Notwithstanding Section 1727, upon receipt of a determination that a civil penalty has been imposed by the Chief, the awazding body shall withhold the amount of the civil penalty from contract progress payments then due or to become due. (2) In lieu of the penalty provided for in this subdivision, the Chief' may, for a diet-time violation end with the concurrence of an apprenticeship program described in subdivision ldl. order the contractor or subcontractor [o provide apprentice employment equivalent to the work hours [hat would have been provided for apprentices during the period of noncompliance. Ib) fn the event a contractor or subcontractor is determined by the Chief to have knowingly committed a serious violation of any provision of Section 1777.5, the Chief may also deny to the contractor or subconractor, and to its reaponaible officers, the right to bid on or be awarded or perform work as a subcontractor en any public works contract For a period of up to one year foe rite fvst violadon and Cor a period of up m three years far a second or subsequent violation. Each period of debarment shall run from the date the determination of noncompliance by the Chief becomes a final order of the Administrator of Apprenticeship. (c) 11) An affected contractor, subcontractoq or responsible otEcer may obtain a review of the tlet<rminadon of the Chief imposing the debarment or civil penalty by transmitting a written request to the otbce of tht Administrator within 30 days aRer service o[ the determination of debarment or civil penalty. A copy of this report shall also be served on the Chief. (2) Within 20 days of the timely receipt of a request for review, the Chief shall provide the contactor, subcontractor, or responsible offittr the opportunity to review any evidence the Chief may offer at the hearing. The Chief shell also promptly disclose any nonprivil<ged documents obtained aRer the 20-day time limit at a time set forth for exchange of evidence by the Administrator. (31 Within 90 days of the timely rettip[ m[ a request for review, a hearing shall be commenced before the Atlministmtor or an impartial hearing officer designated Fry die Administrator and possessing the qualifications of an adminisvative law judge pursuant to subdivision Ibl of Section 11502 of the Government Code. The affected contractor, subcontractor, or responsible officer shell have the burden of providing evidence of compliance with Section 1777.5. 14) Within 45 days of the conclusion of the hearing, the Administrator shall issue a written decision affirming, modifying, or dismissing the determination of debarment or civil penalty. The decision shall contain a statement of the factual and legal basis Car the decision end an order. This decision shall be served on all parties and the awarding body pursuant w Section 1013 of the Code of Civil Procedure by first-class mail at the last known address of the party that the party has filed with the Administrator. Within 15 days of iasnance of the decision, the Administrator may recrosider m modify the decision to correct an error, except that a clerical error may be corrected at any time. (5) An affected contractor, subcontractor, or responsible offittr who has timely requested review and obtained a decision under paragraph (4J may obtain review of the decision of the Administrator by Kling a petition for a writ cf mandate to the appropriate superior court pursuant to Section 1094.5 of the Code of Civil Procedure within 45 days after service of [he final decsion. ff no timely petition for a writ of mandate is Eiled, the decision shall become the final order of the S.Kb Administrator. The decision of the Administrator shall be warmed unless [he petitioner shows that the Administrator abused his or her discretion. If the petitioner claims that the findings are not supported by [he evidence, abuse of discretion is established if [he court determines that the findings are not supported by substantial evidence in light of the entire record. (6) The Chief may certify a copy oC the final order oC the Administrator and file it with the clerk of the superior court in any county m which the affected contractor ar subcontractor has property or has or had a place of business. The clerk, immediately upon the filing, shall enter judgment for the state against the person assessed in the amouvt shown on the certified order. A judgment entered pursuant to this section shall bear the same rate of interest and shall have the same effect as other judgments and be given the same preference allowed by the law on other judgments rendered for claims for [eyes. The clerk shell not charge for the service performed by him or her pursuant to this seotion. An awarding body that has withheld Cunds in response to a determination by the Chief imposing a penalty under this section shall, upon receipt of a certified copy of a final order of the Administrator, promptly transmit the withheld funds, up to the amount of the certified order, Lo the Administrator. (d( If a aubcontrector is found to have violated Section 1777.5, the prime contractor of the project is not liable far any penalties under subdivision (a~, unless the prime contractor had knowledge of the subcontractor s failure to comply with the provisions of Section 1777.5 or unless [he prime contractor Coils to comply with any of the following requirements: (I) The contract executed between the contractor and the subcontractor or the performance of work on the public works project shall include a copy of the provisions of Sections 1771, 1775, 1776, 1777.5, 1813, and 1815. (2) The contractor shall continually monitor a subcontractor's use of apprentices required to be employed on the public works project pursuant to subdivision (d) of Section 1777.5, including, but not limited to, pertodic review of the certified payroll of the subconVactor. (3j Upon becoming awaze of a failure of the subcontractor to employ [he required number of apprentices, the contractor shall take corrective action, including, but not limited to, retaining fvntls due [he subcontractor for work performed on the public works project until the failure is corrected. (4( Prior to making the final payment to the subconrac[or Cor work performed on [he public works project, the contractor shall obtain a declaration signed under penalty of perjury from the subcontractor that the subcontractor has employed the required number of apprentices on the public works project. (e) My funds withheld by the awazding body pursuant to Chia section shall be deposited in the General Fuvd if the awarding body is a state entity, or in the equivalent Lund of an awarding body if the awarding body is an entity other than the state. (Q The Chief shall consider, in setting the amount of a monetary penalty, in determining whether a violation is serious, and in determining whether and for how long a party should 6e debarred for violating this section, all of [he fallowing circumstances: (1) Whether the violation was intentlonal. (2( Whether the party has committed other violations of Section 1777.5. (3) Whether, upon notice of the violation, the party took steps to voluntarily remedy the violation. (4) Whether, and to what ex[enq the violation resulted in lost training opportunities far apprentices. (5J Whether, and to what extent, the violation otherwise harmed apprentices or apprenticeship programs. ]f a pazty seeks review of a decision by the Chief to impose a monetary penalty or period of debarment, the Administrator shall decide de novo the appropriate penalty, by considering the same factors set forth above. (g~ The interpretation of Section 1777.5 and this section shall be in accordance with the regulations of the California Apprenticeship Council. The Administrator may adopt regulations to establish guidelines for the imposition of monetary penalties and periods of debarment and may designate precedential decisions under Section 11425.60 of the Government Code. Regulation 230.1 has been amended. The change will affect projects bid after June 30, 2009. Projects bid on or before June 30, 2009 will still be controlled by the prior version of 230.1. The change requires all contractors (who are not already employing sufficient apprentices) to request dispatch (ether consecutively or simultaneously) from all approved apprenticeship programs in the geographical area of the project. The change also requires that contractors who employ apprentices but are not meeting the required ratio for their craft must request dispatch from any other programs in their craft that exist in the geographical area of the project The change also requires contractors to give the approved apprenticeship programs written notice of the request for dispatch at least 72 hours in advance. (a) Contractors, as defined in Section 228 to include general, prime, specialty or subcontractor, shall employ registered apprentice(s), as defined by Labor Code Section 3077, during the performance of a public work project in accordance with the required one hour of work performed by an apprentice for every five hours of labor performed by a journeyman, unless covered by one of the exemptions enumerated in Labor Code Section 1777.5 or this subchapter. Unless an exemption has been granted, the contractor shall employ apprentices for the number of hours computed above before the end of the contract. Contractors who are not already employing sufcient registered apprentices (as defined by Labor Code Section 3077) to comply with the one-to-five ratio must request the dispatch of required apprentices from the apprenticeship committees providing training in the applicable craft or trade and whose geographic area of operation includes the site of the public work by giving the committee written notice of at least 72 hours (excluding Saturclays, Sundays and holidays) before the dale on which one or more apprentices are required. If the apprenticeship committee from which apprentice dispatch(es) are requested does not dispatch apprentices as requested, the contractor must request apprentice dispatch(es) from another committee providing training in the applicable craft or trede in the geographic area of the site of the public work, and must request apprentice dispatch(es) from each such committee, either consecutively or simultaneously, until the contractor has requested apprentice dispatches from each such committee In the geographic area. All requests for dispatch of apprentices shall be in writing, sent by first class mail, facsimile or email. If anon-signatory contractor declines to abide by and comply with the terms of a local committee's standards, the apprenticeship committee shall not be required to dispatch apprentices to such contractor. Conversely, if in response to a written request no apprenticeship committee dispatches, or agrees to dispatch tluring the period of the public works project any apprentice to a contractor who has agreed to employ and train apprentices in accordance with either the apprenticeship committee's standards or these regulations within 72 hours of such request (excluding Saturdays, Sundays and holidays) the contractor shall not be considered in violation of this section as a result of failure to employ apprentices for the remainder of the project, provided that the contractor made the request in enough time to meet the above-stated ratio. If an apprenticeship committee dispatches fewer apprentices than the contractor requested, the contractor shall be considered in compliance if the contractor employs those apprentices who are dispatched, provided that, where there is more than one apprenticeship committee able and willing to unconditionally dispatch apprentices, the contractor has requested dispatch from all committees providing training in the applicable craft or trade whose geographic area of operation include the site of the public work. Nothing in this section shall affect the right of a contractor who participates in and employs registered apprentices from programs approved under Labor Code Section 3075 outside the geographic area of the public work from employing said apprentice(s) on the site of the public work in order to meet the ratio requirement of Labor Code Section 1777.5. Work of the creft or trade consists of job duties normally assigned to journeymen in the apprenticeable occupation. All work is to be performed by aperson or under the supervision of a person authorized to practice Land Surveying (refer to subsection 2-9 "SURVEYING" of the Special Provisions). PRIOR TO CONSTRUCTION (L) The survey crew shall diligently search for all survey monuments of record and on the surface of the road. It is suggested (that) the seazch (sh)ould include the use of a metal detector. When the detector indicates the possibility of a buried survey monument, then digging below the surface to uncover the monument within 2" of the road surface is recommended. (2.) The survey crew shall properly reference all found survey monuments, which maybe disturbed or covered during constmction, to stable surface points. (3.) The authorized surveyor shall properly complete a Corner Record or Record of Survey for the monuments noted in (I)tem (2.), above. Prior to the start of any constmction work, the original or a print of the Comer Record or Record of Survey shall be submitted to the County Surveyor for review, signature and filing. B. AFTER CONSTRUCTION AND PRIOR TO RECORDING NOTICE OF COMPLETION 1. All covered and disturbed monuments shall be reset with the same or more durable type of monument as the original, in the surface of the constmction. Key monuments shall be a minimum 1" inside diameter iron pipe of appropriate length. 2. A monument box or other protective stmcture is recommended to be placed around key monuments (section corners, quarter section comers). 3. The authorized surveyor shall properly complete a Corner Record of Record of Survey for all set monuments with a change in chazacter, including tag number, and submit it to the County Surveyor for review, signature and filing.
