A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
4 OF SAN BERNARDINO ADOPTING THE MITIGATED NEGATIVE DECLARATION AND
THE MITIGATION MONITORINGIREPORTING PROGRAM, ADOPTING GENERAL PLAN
5 AMENDMENT NO. 12-02 TO CHANGE THE SPLIT LAND USE DESIGNATION FROM
6 OFFICE INDUSTRIAL PARK (OIP) AND INDUSTRIAL LIGHT (IL) TO INDUSTRIAL
7 LIGHT (IL) ON APPROXIMATELY 14.52 ACRES, AND APPROVING TENTATIVE PARCEL
MAP NO. 19369 (SUBDIVISION NO. 12-01) TO MERGE 13 PARCELS INTO ONE, 14.52-
8 ACRE PARCEL, AND DEVELOPMENT PERMIT 2 NO. 12-02 TO CONSTRUCT A 345,802-
9 SQUARE FOOT WAREHOUSE LOCATED ON THE EAST SIDE OF WATERMAN AVENUE,
APPROXIMATELY 300 FEET SOUTH OF MILL STREET.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Recitals.
WHEREAS, the Mayor and Common Council adopted the General Plan for the City by
Resolution No. 2005-362 on November 1,2005; and
WHEREAS, the application for General Plan Amendment No. 12-02, Tentative Parcel Map No.
19369 (Subdivision No. 12-01) and Development Permit 2 No. 12-02 was reviewed under the California
Environmental Quality Act (CEQA) through an Initial Study which found no significant adverse effects

19 on the environment after incorporation of mitigation measures; and

WHEREAS, the Mitigated Negative Declaration pursuant to the California Environmental
Quality Act has been reviewed by the Environmental Review Committee, the Planning Commission,
and the Mayor and Common Council in compliance with the CEQA and local regulations; and
WHEREAS, the Planning Commission conducted a noticed public hearing on March 28, 2012,
in order to receive public testimony and written and oral comments on General Plan Amendment No.
12-02, Tentative Parcel Map No. 19369 (Subdivision No. 12-01) and Development Permit 2 No. 12-02,
and fully reviewed and considered the Planning Division Staff Report and the recommendation of the

WHEREAS, the Mayor and Common Council held a noticed public hearing on April 16, 2012,
and fully reviewed and considered proposed General Plan Amendment No. 12-02, Tentative Parcel Map
No. 19369 (Subdivision No. 12-01) and Development Permit 2 No. 12-02, and the Planning
Commission and Environmental Review Committee recommendations and the Planning Division Staff
Report.
SECTION 2. Mitigated Negative Declaration.
NOW, THEREFORE, BE IT RESOLVED, FOUND AND DETERMINED by the Mayor and
Common Council that:
A. The facts contained in the Recitals section are true and correct.
B. The proposed amendment to the General Plan of the City of San Bernardino will not have a
significant adverse effect on the environment with incorporation of the proposed mitigation measures,
and the Mitigated Negative Declaration heretofore recommended by the Environmental Review
Committee and the Planning Commission as to the effect of this proposed amendment is hereby ratified,
affirmed and adopted.
C. Mitigation measures identified in the Mitigated Negative Declaration have been compiled in
a Mitigation Monitoring and Reporting Program (MM/RP) for the project. The Mayor and Common
Council hereby adopts the MM/RP, attached to the Mayor and Common Council staff report dated April
16,2012 as Attachment 4, and incorporated herein by reference.
SECTION 3. General Plan Amendment No. 12-02.
BE IT FURTHER RESOLVED by the Mayor and Common Council that:
A. General Plan Amendment No. 12-02 is hereby approved based upon the Findings of Facts
contained in the Staff Report to the Planning Commission dated March 28,2012.
B. The Land Use Map of the General Plan is hereby amended pursuant to General Plan
Amendment No. 12-02, to change the split land use designation from Office Industrial Park (OIP) and
Industrial Light (IL) to Industrial Light (IL) in the area outlined in Exhibit A, a copy of which is
attached and incorporated herein for reference.
C. General Plan Amendment No. 12-02 shall become effective upon the adoption of this
resolution.

SECTION 4. Tentative Parcel Map No. 19369 (Subdivision No. 12-01).
Tentative Parcel Map No. 19369 (Subdivision No. 12-01) is hereby approved based upon the
Findings of Fact and subject to the Conditions of Approval contained in the Staff Report to the Planning
Commission dated March 28,2012.
SECTION 5. Development Permit 2 No. 12-02.
Development Permit 2 No. 12-02 is hereby approved based upon the Findings of Fact and
subject to the Conditions of Approval contained in the Staff Report to the Planning Commission dated
March 28,2012.
SECTION 6. Map Notation.
This Resolution and General Plan Amendment No. 12-02 shall be noted on such appropriate
General Plan maps previously adopted and approved by the Mayor and Common Council and which are
on file in the office of the City Clerk.
SECTION 7. Notice of Determination.
The Planning Division is hereby directed to file a Notice of Determination with the County Clerk
of the County of San Bernardino certifying the City's compliance with California Environmental
Quality Act in preparing the Initial Study I Mitigated Negative Declaration.
