RESOLUTION NO. 2012-45
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE SAN BERNARDINO CITY FIRE
DEPARTMENT TO SUBMIT TO FACTORY MUTUAL GLOBAL AN
APPLICATION FOR A 2011 FIRE PREVENTION GRANT PROGRAM GRANT
AND TO ACCEPT AND ADMINISTER THE GRANT FUNDS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Fire Chief or his designee is authorized to submit to Factory
Mutual Global an application for grant funds under the 2011 Fire Prevention Grant
Program, and to accept and administer any grant funds awarded under the program. A
copy of the grant application is attached as Exhibit "A" and incorporated herein by
reference.

Two Digital SLR cameras and equipment for still and video photography use on fire and arson investigation scenes,
surveillance operations, intelligence gathering and sharing, training exercises, etc.

10. Please answer the following questions:
a. Why does your organization need the requested funding?
Our department's fire-arson investigation unit is in need of efficient and professional camera equipment to
appropriately document fire-arson investigation scenes. Such equipment will support the work of our well trained and
experienced fire-arson investigators in their efforts and duties as sworn peace officers/investigators to professionally
document and record their findings at fire, arson and bombing scenes, as well as conducting surveillance operations.
Possession and use of professional cameras and equipment will greatly attribute to the preservation of evidence
through digital documentation for prosecution and court purposes, as well as providing a permanent record of the
incident / investigation. Use of such equipment on surveillance operations will further assist investigators in their
efforts and duties to locate and monitor suspects, subjects/persons and locations of interest, etc. Such use will assist
in the apprehension of dangerous and destructive arson suspects. Relevant intelligence and information gathered
during digital camera / video surveillance operations can also be shared to further benefit public and private agencies
and entities with the need and right to know. This is very important to our department and nation in its
counter-terrorism efforts.
Our department fire-arson investigation unit (FAIU) and its investigators average approximately130 to 140
investigations of all types, every year. Our FAIU is responsible for conducting thorough day to day and complex
fire-arson investigations throughout the City of San Bernardino. Our FAIU is responsible for conducting scene and
follow-up investigation work, filing cases with the District Attorney's Office and testifying in court. Our FAIU is
responsible for the disposition on all criminal and non-criminal fire-arson investigation cases in our City.

b. How will funding enhance your current/future fire prevention. prefire planning or investigation efforts?
Our FAIU Investigators will be professionally equipped to professionally complete the necessary work that is required
to complete and close criminal and non-criminal-civil investigations / cases.
Professional camera equipment will provide professional results, which will be realized when reviewing digital
evidence for the completion and disposition of criminal and non-criminal-civil investigations / cases.
c. What is the expected impact funding will have within your community, both immediate and long-term?
Improved efficiency and quality in the digital documentation of evidence at fire, arson and bomb investigation scenes.
This includes improved identification, collection, preservation, presentation and intelligence sharing of recorded
scenes, suspects, subjects, locations, etc., during surveillance operations.
This improved efficiency and quality of critical digital evidence documentation will directly benefit the community
when a case goes through state or federal court in pursuance of prosecution of dangerous and destructive arson
suspects. Such evidence is often examined by attorneys, judges, jurors, investigators, public and private entities, etc.
d. What recent (within past 10 years) local fire-related statistics support the need for funding?
Our FAIU- Fire-Arson Investigators respond to several hundred fires every year, opening approximately130-140 fire,
arson and bomb cases each year.
Our last few department budgets have taken a drastic downturn, which have obliterated funding for training and
essential equipment, which includes standardized/professional grade cameras for investigative work.
e. What other relevant information do you believe will support the need for funding?
Our department is considered a leader in the region in many aspects, including fire-arson investigation. This is most
likely associated with our investigative work load and experience, as we respond to hundreds of fires each year. Our
FAIU is very active throughout San Bernardino County, state and region. I (Capt. Payan) am a sworn Deputy U.S.
Marshal with the Bureau of Alcohol, Tobacco, Firearms and Explosives. I serve as a TFO (Task Force Officer) and
often work with Federal A TF Agents and other sworn officers on cases and operations involving fires, explosives and
other federal crimes in the City and County of San Bernardino, and State of California.
Professional performance and efforts on investigations involving criminal and non-criminal related fires is essential in
the apprehension and prosecution of dangerous and destructive arson suspects. Investigations and cases that we
submit for criminal filings will be compromised without essential and professional tools, such as digital cameras.
