Execution of Amendment No. I to the Crossing Guards Service Agreement with the Rialto
Unified School District for the Operation of the School Crossing Guard Program at Myers
Elementary School and Kelley Elementary School by the Police Department.

Backl!:round:
The City of San Bernardino Police Department manages several crossing guard positions for the
San Bernardino City Unified School District (SBCUSD). There is an agreement in place with
SBCUSD as well as an agreement with Redlands Unified School District to manage crossing
guard positions located at schools within the city limits of San Bernardino. Each Agreement is
set up to have the school districts reimburse the City of San Bernardino for one half of the actual
costs incurred to provide the services. The City also has an agreement with Rialto Unified
School District with the same terms.
There are two (2) crossing guards employed by the City of San Bernardino that actually work at
schools that are in the Rialto Unified School District. Myers Elementary School is at 975 N.
Meridian Avenue and Kelley Elementary School is at 380 S. Meridian Avenue. Both schools are
within the city limits of San Bernardino and the crossing guards are crossing children on City of

The Rialto Unified School District has agreed to share 50% of the cost for two (2) crossing
guards throughout the 2011-2012 school year. This Amendment extends the agreement to cover
the 11112 school year. This agreement is retroactive to July 1,2011 through June 30, 2012. No
interruption of services have or will occur.

NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
7 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1: The City Manager of San Bernardino is hereby authorized and directed
to execute the Crossing Guards Service Agreement for FY 2011/12 with the Rialto Unified

School District, which is attached, marked as Exhibit "A" and incorporated herein.

SECTION 2: That the implementation date of this agreement is July I, 2011,
therefore, any action taken between July 1,2011, and the date that this resolution is adopted is
hereby ratified.
SECTION 3; The authorization to execute the above referenced amendment to the
Services Agreement is rescinded ifit is not issued within sixty (60) days of the passage of this
resolution.

AMENDMENT NO.1 TO THE CROSSING GUARD SERVICES AGREEMENT
BETWEEN THE CITY OF SAN BERNARDINO AND THE RIALTO UNIFIED SCHOOL
DISTRICT
TIllS AGREEMENT is made and entered into this _ day of 2012, by and between the
City of San Bernardino - Police Department, hereinafter referred to as the "City" having a business
address as 710 North "D" Street, San Bernardino, California 92401 and the Rialto Unified School
District, hereinafter referred to as the "District" having a business address at ] 82 E, Walnut Avenue,
Rialto, California 92376.
WHEREAS, the City and the District previously entered into an Agreement to share equally the
cost of a school crossing guard program; and,
WHEREAS, the parties wish to extend the agreement through the current school year; and
WHEREAS, the parties wish to amend Paragraphs I and V of the agreement;
NOW, THEREFORE, the parties agree to amend paragraphs I and V of the Agreement to read
as follows:
I. TERM OF AGREEMENT
A. This Agreement is effective beginning July I, 2011, and continuing through June 30,
2012. The school year is from July I to June 30 of each succeeding year.
V.
CITY'S FEE AND PAYMENT THEREOF
A, In accordance with the negotiation with the City, the District agrees to compensate the
City for one-half of the cost of services rendered to accomplish the results required
hereunder, in a total amount not to exceed $8,792.00, The cost of the crossing guard is
calculated at the rate of $8.14 per hour, including benefits. Invoices shall be submitted
quarterly in arrears,
All other terms and conditions will remain the same
