2 ORDINANCE OF THE CITY OF SAN BERNARDINO ADOPTING THE
SAN BERNARDINO MUNICIPAL CODE, AND INCLUDING IN THE CODE, AS
3 A PART THEREOF, ORDINANCES PASSED SUBSEQUENT TO ORDINANCE NO.
3848, BUT PRIOR TO ADOPTION OF THIS CODE.

WHEREAS, the California State Legislature has provided
5
for the codification and publication of the permanent and
6
general ordinances of cities in Sections 50022.1 through 50022.8
and 50022.10 of the Government Code; and

WHEREAS, the Book Publishing Company, Seattle, Washing-
9
ton, has compiled, edited and published a codification of the
10
permanent and general ordinances of the City of San Bernardino,
11
California; and
12
WHEREAS, there have been filed and there are now on file
13
in the office of the City Clerk, for public inspection, three
14
copies of a document entitled "San Bernardino Municipal Code,"
15
together with three copies of each of the secondary codes
16
therein adopted by reference;

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

Section 1. Adoption. Pursuant to the provisions of
Sections 50022.1 through 50022.8 and 50022.10 of the Government
Code, there is hereby adopted the "San Bernardino Municipal
Code" as published by Book Publishing Company, Seattle, Washington,
together with those secondary codes adopted by reference as
authorized by the California State Legislature, save and except
those portions of the secondary codes as are deleted or modified
by the provisions of the "San Bernardino Municipal Code."
Section 2. Title--Citation--Reference. This code
28 shall be known as the "San Bernardino Municipal Code" and it

shall be sufficient to refer to said code as the "San Bernardino
Municipal Code" in any prosecution for the violation of any
provision thereof or in any proceeding at law or equity. It
shall be sufficient to designate any ordinance adding to,
amending, correcting or repealing all or any part or portion
thereof as an addition to, amendment to, correction or repeal of
the "San Bernardino Municipal Code." Further reference may be
had to the titles, chapters, sections and subsections of the
"San Bernardino Municipal Code" and such references shall apply
to that numbered title, chapter, section or subsection as it
appears in the code.
section 3. Codification authority. This code consists
of all the regulatory and penal ordinances and certain of the
administrative ordinances of the City of San Bernardino,
California, codified pursuant to the provisions of sections
50022.1 through 50022.8 and 50022.10 of the Government Code.
section 4. Ordinances passed prior to adoption of
the code. The last ordinance included in this code was Ordinance
No. 3848, passed July 9, 1979. The following ordinances, passed
subsequent to Ordinance 3848, but prior to adoption of this code,
are hereby adopted and made a part of this code: Ordinances 3849,
3850, 3851, 3852, 3853, 3854, 3855, 3856, 3857, 3858, 3859, 3860,
3861, 3862, 3863, 3864, 3865, 3866, 3867, 3868, 3869, 3870, 3871,
3872, 3873, 3874, 3875, 3876, 3877 , 3878 , 3879, 3880, 3881, 3882,
3883, 3884, 3885, 3886, 3887, 3888, 3889, 3890, 3891, 3892, 3893,
3894, 3895, 3896, 3897, 3898, 3899, BOO, 3901, 3902, 3903, 3904,
3905, 3906, 3907, 3908, 3909, 3910, 3911, 3912, 3913, 3914, 3915,

section 5. Reference applies to all amendments.

Ii Whenever a reference is made to this code as the "San Bernardino
I Municipal Code" or to any portion thereof, or to any
7

ordinance of the City of San Bernardino, California, the
9
reference shall apply to all amendments, corrections and
10
additions heretofore, now or hereafter made.

Section 6. Title, chapter and section headings.
12 Title, chapter and section headings contained herein shall not
13 be deemed to govern, limit, modify or in any manner affect the
14 scope, meaning or intent of the provisions of any title, chapter
15 or section hereof.

Section 7. Reference to specific ordinances. The
17 provisions of this code shall not in any manner affect matters
]8 of record which refer to, or are otherwise connected with
19 ordinances which are therein specifically designated by number
20 or otherwise and which are included within the code, but such
21 reference shall be construed to apply to the corresponding
22 provisions contained within this code.

Section 8. Effect of code on past actions and obliga-
24 tions. Neither the adoption of this code nor the repeal or
amendment hereby of any ordinance or part or portion of any
25

ordinance of the City of San Bernardino shall in any manner
27
affect the prosecution for violations of ordinances, which
28
violations were committed prior to the effective date hereof,

nor be construed as a waiver of any license, fee, or penalty
2 at said effective date due and unpaid under such ordinances,
3 nor be construed as affecting any of the provisions of such
4 ordinances relating to the collection of any such license,
5 fee, or penalty, or the penal provisions applicable to any
6 violation thereof, nor to affect the validity of any bond or cash
7 deposit in lieu thereof required to be posted, filed or deposited
8 pursuant to any ordinance and all rights and obligations
9 thereunder appertaining shall continue in full force and effect.

Section 9. Effective date. This code shall become
II effective on the date the ordinance adopting this code as the
12 "San Bernardino Municipal Code" shall become effective.
Section 10. Constitutionality. If any section, sub-
13

section, sentence, clause or phrase of this code is for any
15
reason held to be invalid or unconstitutional, such decision
16
shall not affect the validity of the remaining portions of
17
this code. The Mayor and Common Council hereby declare that it
18
would have passed this code, and each section, subsection,
19
sentence, clause and phrase thereof, irrespective of the fact
that anyone or more sections, subsections, sentences, clauses
or phrases had been declared invalid or unconstitutional, and
if for any reason this code should be declared invalid or
unconstitutional, then the original ordinance or ordinances
shall be in full force and effect.
I HEREBY CERTIFY that the foregoing ordinance was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at
