Pursuant to the recommendation of the .Chief of Po-
lice, Council Member Hernandez made a motion, seconded by
Council Member Castaneda and unanimously carried, that the
application filed by the San Bernardino Y.M.C.A., Downtown
Branch, to conduct a 5 and 10K Run on June 12, 1984, at
7:30 a.m., be approved. (3)

In a letter dated April 27, 1984, Carolyn Clayton of
the Community Church of God, requested permission to.,block
the car traffic onto Garner Street, from Base Line to
Orange Street for the purpose of a carnival to be held,on
June 2, 1984, from 8:00 a.m. to 6:00 p.m. (4)
Ben Gonzales, Chief of POlice, recommended in a memo-
randum dated May 11, 1984, that the request from Community
Church of God to block traffic onto Garner Street, from
Base Line to Orange Street, be approved.
Council Member Hernandez made a motion, seconded by
Council Member Castaneda and unanimously carried, that the
request for street closure for the purpose of a carnival
on Garner, between Orange Street and Base Line, on June 2,
1984, from 8:00 a.m. until 6:00 p.m., be approved.

A memorandum dated April 30, 1984 was received from
Lee Gagnon, License Supervisor, recommending that Dorothy
Campbell, Business License Inspector, be appointed to
represent the City in Small Claims Court in order to col-
lect delinquent business license tax. (5)
Council Member Hernandez made a motion, sec.onded by
Council Member Castaneda and unanimously carried~ that
Dorothy Campbell, Business License Inspector, City Clerlt'is
Office, be authorized to represent the City in Small

Frank Schuma, Planning Director, stated that the
Council can accept the landscaping along the west side as
an alternative but a wall should be installed where the
area is zoned for residential purposes, and answered ques-
tions of the Council.

Council Member Frazier left the Council Meeting.
Council Member Marks made a motion, seconded by Coun-
cil Member Strickler, that the appeal hearing be closed
and the decision of the Planning Commission be modified to
include the three foot hedge on the west side and the
inclusion of an additional four foot wall on the east side
and the rest of the Planning Commission's conditions be
contained within the decision.

This is the time and place continued to for the fol-
lowing Planning Commission recommendation:

That the application for Change of Zone No.
83-12, various owners, City initiated, to
change the land use zoning district from
R-1-7200 Single-Family Residential, R-2
TWO-Family Residential, R-3-1200 Multiple
Residential, PRD Planned Residential Devel-
opment, C-l Neighborhood Commercial and
C-3A Limited General Commercial to PRD 14-U
Planned Residential Development at 14
dwelling units per acre for a. study area
bounded by Lynwood Dr i ve on the south,
Eureka Street on the north, Mountain Avenue
on the west and Del Rosa Avenue on the
east, including an additional area located
within approximately 400 feet on the east
side of Del Rosa Avenue, between Eureka
Street and Marshall Boulevard, be recom-
mended for denial.

Frank Schuma, Planni ng Director, explained the his-
tory of the proposed change of zone stating that a
mittee was established consisting of residents of
area to look into the zoning possibilities and for a
ommendation to the Council.
The Planning Director recommended that the general
plan be amended to a density of 8-20 units per acre. He
sta ted tha t the Counc i 1 could approve the recommendation
of the Planning Commission, deny the recommendation, or
refer it back to the Planning Commission to initiate a
general plan amendment for medium density of 8-20 units
per acre.

wash.
Mr. Jim L. Potter of 1294 West 27th Street and owner
of property in the area, was in opposition to the car
wash.
Mr. Henry L. Moring of 1356 West 26th Street, stated
that the vacant lot is a disgrace to the neighborhood and
there is crime and people set up stands to sell flowers.
He stated that he cannot understand why these residents
are opposed to the proposed car wash. He is in favor of
the development of the car wash there and stated that it
would be an improvement to the neighborhood.

Council Member Strickler made a motion, se~onded by
Council Member Castaneda, that the hearing be closed and
the decision of the Planning Commission be reversed and
the appeal accepted and that the project be approved under
the condition that the facility be closed at 10:00 p.m.
every night and the gates secured at 10:00 p.m. at night
so that there cannot be any entrance into the facility
after 10: 00 p.m.; and that the project be reviewed after
it has, been in operation for six months to determine if
there are any adverse effects.

This is the time and place set for a hearing on the
appeal filed by Donald Cox and Dona Colombero on the Plan-
ning Commission's requirement for Building Moving No.
84-3, which would move a single-family house from 1212
South Mt. Vernon Avenue to 347 West Wabash Street. The
requirement being appealed is for a six foot solid wall
along the property line, utility lines to be installed

plicable to Building Moving No. 84-3, that the Planning
Director and City Attorney be directed to recommend a
modification of the section of the ordinance to allow the
City standard requirement pertaining to walls adjacent to
parking areas be modified and the recommendations come
back to the Council.

This is the time and place continued to for a report
from the City Attorney on the issue of recouping the
City's loss from the bond company f.or the corrective work
for Tract Nos. 9995 and 10304, which are located north of

City Attorney be instructed to file suit against the bond

sion on the procedures and methodology for compiling and

request to discuss procedures and methodology for compil-
ing and publishing Council agenda for Council meetings
and/or special Council meetings, be tabled as Council

LIBERTY TV CABLE COURT SETTLEMENT - USE .OF
FUNDS- CONTINUED FROM MAY 7. 1984
This is the time and place continued to for a report
from Council Member Marks on the court settlement of the
Liberty TV Cable court case in which the C;ity was awarded
$83,927.67, after expenses, and recommended that the City
Administrator develop procedures for returning that amount
to the subscribers in a most equitable and expeditious
manner. (20)
City Administrator Matzer suggested that the City
advertise and ask the public to come forward and apply for
a rebate.
The Council discussed how the rebates could be han-
dled.
Council Member Marks made a motion, seconded by Coun-
cil Member Hernandez and unanimously carried, that the
disposition of funds be referred to the Cable TV Commis-
sion for recommendation back to the Council within 30
days.

County was adopted by Resolution No. 84-170 on May 7,
1984, but the motion to grant the funding was omitted from

cil Member Marks, that the payment of $4,000 from Account
No. 42-510-410 "Improvement-Major Streets", as the City's
share of the cost for landscaping the median in Waterman
Avenue, from the Santa Ana River to Dumas Street, be
authorized.

in a memorandum dated May 10, 1984, that. the MUnicipal
Code Title 5 be amended to delete, combine and revise
sections pertaining to business licenses to further
streamline and update the Municipal Code. (25)

cil Member Quiel ana unanimously carried, that the city
Attorney be instructed to prepare the necessary amendments
to Title 5 of the Municipal Code to delete, combine and
revise sections pertaining to business licenses as set
forth in the memorandum dated May 10, 1984 from the Busi-
ness License Supervisor.

Council Member Reilly stated he would abstain
action on this item as the firm he is employed by is
forming engineering sex:vices on this site.
Mayor Holcomb stated that the City has only so many
connections that they can give out due to limited capa-
ci ty. He recommended that the bedroom charge be increased
for County hookups to create a differential which would
induce annexation.
Council Member Marks made a motion, seconded by Coun-
cil Member Quiel, that the request for outside sewer ser-
vice at 4088 and 4080 North "F" Street be continued to
Monday, June 4, 1984, and that staff be directed to pre-
pare a differential x:ate scnedule for review and approval
at the next Council Meeting. (June 4, 1984)
The motion carried by the following vote: Ayes: Coun-
cil Members Castaneda, Marks, Quiel, Frazier, Strickler.

a borderline case ,of whether or not it is legal and stated
that the time saved by having the Administrative Assistant

Council Member Quiel made a motion, seconded by Coun-
cil Member Marks and unanimously carried, to direct the
City Administrator to look into the feasibility of creat-
ing a staff position to coordinate an access channel or
look into using the services of Valley College or Cal
State College to coordinate an access channel and that
the remaining Legislative Review Committee report of May
17, 1984, be filed.

John Matzer, City Administrator, presented a memoran-
dum dated May 18, 1984, setting forth a request from the
Mayor asking that the members of the Citizen's Mobile Home
Fact Finding Committee initiate the preparation of a for-
mula defining rent gouging. (S2)
City Attorney Prince advised against the Mayor's
request, stating that rent gouging is an emotional issue
and a term that the Committee would be unable to define;
any definition would not withstand a court case.

At 12:55 p.m., Mayor Holcomb returned to the Council
Meeting and took his place at the Council Table.
Mayor Holcomb suggested that the Committee come up
with some standard for determining a reasonable rate of
return for the landlord.
Council Member Strickler made a motion, seconded by
Council Member Castaneda, to notify the members of the
Citizens Mobile Home Fact Finding Committee to initiate as
their first task the preparation of a formula defining
rent gouging.
The motion carried by the following vote: Ayes: Coun-

Council Member Quiel made a motion, seconded by Coun-
cil Member Strickler and unanimously carried, that further
reading of the resolution be waived and said resolution be
adopted.
Resolution No. 84-209 was adopted by the following
vote: Ayes: Council Members Castaneda, Marks, Quiel,
Frazier, Strickler. Noes: None. Absent: Council Members
Reilly, Hernandez.

ENFORCEMENT SIGNS
In a memorandum dated May 18, 1984, Roger Hardgrave,
Director of Public Works/City Engineer, stated that the
Central City Parking Place Commission discussed the park-
ing impact of the proposed Fuddrucker's Hamburger Restau-
rant to be located at the northeast corner of Second and
"E" Streets. Concerns were raised by a representative of
the Harris Company and of the Central City Company with
regard to the potential conflict that Fuddrucker's custom-
ers could create should they utilize the Central City Mall
parking lot at the northwest corner of Second and "E"
Streets. (57)
The Director of Public Works/City Engineer further
stated in his memorandum that the Parking Place Commission
recommends to the Mayor and Council that a decorative
fence be constructed along the north side of Second Street
and the west side of "E" Street and post parking enforce-
ment signs at all Central City Mall entrances and parking
lot light standards.
Mayor Holcomb suggested that the City take no action
on this fence and sign request until an actual problem has
developed.
Council Member Castaneda made a motion, seconded by
Council Member Frazier, that the request be tabled.
The motion failed by the following vote: Ayes: Coun-
cil Members Castaneda, Frazier, Strickler. Noes: Council
Members Marks, Quiel. Absent: Council Members Reilly,
Hernandez.
Council Member Quiel made a motion, seconded by Coun-
cil Member Marks, to continue this request to Monday, June
4, 1984, and that the City Administrator be directed to
request the presence of an appropriate official from the
Central City Parking Place Commission to answer questions.
The motion failed by the following vote: Ayes: Coun-
cil Members Marks, Quiel, Strickler. Noes: Council Mem-
bers Castaneda, Frazier. Absent: Council Members Reilly,
Hernandez.
