2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
REORGANIZATION OF THE TRI-COUNTY COUNCIL ON CRIMINAL JUSTICE
3 AS REFLECTED IN ITS REVISED BYLAWS AND TRANSITION ALTERNATIVE
NUMBER TWO

5 WHEREAS, Title 6.5 of the Penal Code of the State of
6 California mandates that Regional Criminal Justice Planning
7 Boards shall reorganize to not less than 21 nor more than
8 30 members and must adopt various composition standards; and
. 9 WHEREAS, The Tri-County Council on Criminal Justice,
10 composed of San Bernardino, Riverside and Imperial Counties,
11 has recommended that it be reduced to 29 members and that
12 Transition Alternative Number TWo be approved to meet compo-
13 sition standards; and
14 WHEREAS, Penal Code Section 13902 requires that certain
15 units of local government, the County and one-half of the
16 cities must agree concerning the organization of the Regional
17 Criminal Justice Planning Boards,
18 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
19 COUNCIL OF THE CITY OF SAN BERNARDINO that said City, by
20 and through its governing representatives, does hereby approve
21 the proposed reorganization of the Tri-County Council on
22 Criminal Justice, as reflected in the revised bylaws of said
23 Council and Transition Alternative Number TWo, be and the
24 same is hereby approved.

TRI COUNTY COUNCIL ON CRIMINAL JUSTICE
BY-LAWS REVISIONS
Article I
Name and Office
A. This organization shall be known as the Tri COWlty CoWlcil
on CriJDinal Justice. Its principal place of business shall
be in a conventient location within the geographic liJDits
of the Tri County Region,
B'. The Tri County' Region is .comprised of the units of govern-
ment contained within the boundaries of San Bernardino,
Riverside, and Imperial Counties.
Article II
Objectives
A. It is the objective of this organization to define, develop
and correlate planning, programs, and projects for units of
general local government within the Tri County Region for the
improvement of the criJDinal justice system.
Article III
Membership

The membership of t:b8 Council shall be comprised of a
majority of local elected officials. (Elected sheriffs,
district attorneys, and judges shall be considered "local
elected officials. H) The membership shall be: consistent
with state and federal statues and guidelinesl representa-
tive of a.broad range of community interests and vi_
pointsl and balanced in terms of racial, seKu'iIl, age,
economic and geographic factors. Appointing authorities
shall take these factors into consideration in making their
choices.
B. The Council shall consist.of 29 members divided among the
three counties. There will be twelve (12) members from San
Bernardino County, ten (10) members from Riverside County,
and seven (7) members from Imperial County. The members
will be selected fromthe following categories.

c. Membership positions may be transferred between counties
and categories with the approval of the Executive Committee
and the Council as long as county allocations, the prepon-
derance of local elected officials and discipline

Authority
A. The 'l'ri County Council on Criminal. Justice is organized
within the provisions of directives issued by the Office
of Criminal Justice Planning and is limited according to
instructions issued fpom time to time by that state agency.
Funding
A. Participation by all members is based. on voluntary support.
B. Federal, state, and local funds are provided in accorance
with allocations allowed by the OCJP on a contract basis
for necessary expenses.
C. All monies and "in-kind" contributtons will be accounted
for by a legal authorized agent using acceptable methods.

Article VI
Article VII
Officers
A. There shall be the office of chairman and vice chai%1lllln.
Each shall hold office for a term of one year or until his
successor is elected. The term of office shall correspond
to the calendar year, unless the Chair is vacated, in
which case the vice chaiDllaJ\ assume the duties of the chair-
man for the remainder of the term. In the event the position
of vice chairman is vacated, the position will be filled
by an election in accordance with Article VIII of the by-
laws.
B. Chairman: The chabman shall preside at all meetings and
is authorized to represent the Tri County Council on Criminal
Justice in all matters within the area of authority of the
COuncil. He _y siqn offficial documents in the name of the
Council as authorized by the policy adopted by the Council.
C. Vice Chairman: The vice chairmAn is the chairman of the
Executive "Committee. In the event of the absence of the
chairman, the vice chaiman is authorized to act with the
same authority as the chairman.

The Executive Co/lllllittee shall consider the nominations of
the various nominating authorities and select a member or
JIIelIIbers for the positions of: district attorney, superior
court judge, probation officer, public defender, city
councilman, county administrative officer, public/mental
health member, drug abuse, publ.ic schools, private sector

take into consideration the factors listed in Article III.

TerJllS of Membership: Each member of the Council shall serve
for a period of two years and/or until such time as a
successor is selected. .
1. City government representatives' .terJllS shall begin and
end in odd numbered. years at the first meeting in
January.
2. County government representatives' terms shall begin
and end in even numbered years at the first meeting
in January.
3. The terms of the juvenile justice commission, public/mental
health, drug abuse, public schools, and private sector
members shall begin.and end at the first meeting in July
of odd numbered years.

Transition Plan: In order to implement the requiremnts of
AB 960 and LEAA and OCJP guidelines on board composition,
the Council shall eliminate excess positions at the end of
term of the incumbent until the legal size is reached.
Effectively immediately upon approval of this by-laws
revisions and for all appointments thereafter, the appointing
authorities and the Executive Co/lllllittee shall., to the best
of its ability, make appointments in light of the principles
contained in Article III.

Transition Plan: In order to .implement the requirements of
AS 960 and the LEAA/OCJP guidelines on regional criminal
justice planning boards composition and size, the appoint-
ing autborit.1es shall be asked to JIIS]c:e new appo.1ntments and
nom.1nations by July 1, 1976 to be effective August 1, 1976
follo",.1ng the princ.1ples of Article III. At the meeting in
July, 1976, the Exec:ut.1ve Colllllittee ",ill c01!B.1der the
nom.1nations and select appo.1ntees accord.1ng to Article III
standards. The Council upon approving the selection shall
set a meeting ,date for August, 1976, and declare itself
d.1sbanded .
At the date set, the new COuncil members shall meet, ",ith
the first order of bus.1ness being the selection of officers.
Thereafter, selection of officers and appointments will
follow the procedures described elsewhere .1n this section.

Vacancies: A vacany mail be declared ..,
1. When the member .1s no longer eligible to hold the public
office by virtue of' not filing for re-election, death,
or other cause for vacating the office.

2. When the member has been absent for two out of three
meeting in anyone quarter.
Upon notice to the Council, by the staff off.1cer, the
chairman will direct the selection of a replacement .1n the
same manner as the original member ",as selected. Appointments
to fill vacancies as a result of declared resignation shall
be made from the same classification as that held by the
person creating the vacancy. The term of office of the
appointee shall be for the remainder of the unexpired term
of the former office hold~. "
J. Quorum: A quorum shall consist of a minumum of ~weft~-~iet
fifteen (lS) members, including no less than two (2) members
from each county. The nwnber of members required for a
quorum from June throuqh September shall be the number of
members in attendance.
K. Regular Meetings. Regular Council Meetings 1118Y be,
held monthly.

Article VIII
Article IX
L. Special Meetings: The Chairman, upon request of six
members of the Council shall call a special meeting.
Special meetings shall be set no less than seven (7)
calendar days nor more than twelve (12) claendar days
after receipt of a written request for such a meeting.
The request and notices of such a meeting must include
the subject matter to be under discussion at the meeting.
No additional items may be added to the agenda of a
special meeting, ~xcept by consent of a majority of
members present:
NOminations and Elections
A. At the first meeting after the beginning of. a new calendar
year, or inthe event of a vacancy, an election shall be
held: Nominations will be received from the nominating
committee or from the floor for the offices of chairman and
vice chairman.
1. In the event more than one candidate is nominated, a
secret ballot will be taken.
2. All nominees must be the principals named in the classi-
fications and not their designated alternates.
3. All nominations are subject to the consent of the
nominee.
Committees
A. 'l'he Executive Coll1lllittee is hereby established.
1. 'l'he Executive ColIIDIittee shall consist of nine (9) members
- the Chairman, Vice-Chairman, and the 1mD.ediate past
.Council Chairman and six (6) additional members as
appointed by the Chairman of the Council, subject to
ratification by the Council.
2. 'l'he duties and responsibilities of the Executive Commit-
tee shall include:
a. RecOll1lllendation of policy to the Council.
b. Consideration and/or action on unusual or serious
matters affecting the Council.
c. Supervision of 'l'ri County Council on Criminal Justice
staff services:
d. 'l'he coltlllittee shall have the power to make recOJlllllenda-
tions to the Council for actions. Such recommendations
shall be subject to vote by the Council, a quorum
present as provided for in these By-Laws, by a
majority vote. .

e. Receiving and conducting appeal hearing on proponent
proposals.
f. Tri County Council on Criminal'Justice. planning
budget review.
g. Such other administrative matters as referred by the
Council.
3. Quorum: A quorum consist of'a lIlinimum of five (5) members.
A decision of this committee will be by a ,majority vote.
4. Meetings: The Executive Committee shall meet as often as
necessary but not less than once a month or at the call
of the Executive Committee Chairman.
B. The. chairman of the Council may appoint additional cOllDllittees
and/or special committees' as needed in carrying out the
objectives of the organi~ation as reflected in Article II.
C. The Select Committee on Legislation is hereby established.
1. The Select Committee on LegiSlation shall consist of
fifteen (15) m~s: three representatives of each
discipline of the criminal justice system, and one
from each of the three member counties of the Region.
2. The duties and responsibilities of the Select Committee
on LegiSlation shall .include:
a. Review mattemof concern to the criminal justice
system in Region "s" which might be resolved
through legislative action at the local or state
level.
b; Review matters of pending legislation at the local
or state level.
c. Review matters of general statutory reform at the
local or state level, such as criminal code
revision.
d. Prepare recommendations to the Council for legisla-
tive action at the local and/or state level.
3. Quorum: A quorum shall consist of a minimUIII of eight (8)
members ot the cOllllll1ttee. A decision of this committee
shall be by a majority vote of the members present.

4. Meetings:. The Select Coumittee on Leqislation shall
meet as often as necessary, but not less than one
time per month,. or at the call of the chairman.
5. Reports: The Select committee on .Legislation shall pre-
pare regular reports and recOl1llllendations and present
them to the. Council at the COuncil's regular meetings.
6. Unlawful Activities: The Select .Committee on Leqisla-
tion shall not engage in any activities which violate
. local, state, or federal statues pertaining to
legislative action, nor. shall .it engage. in lobbying
. activities.
Article X
Parliamentary Authority.
A. Meetings shall be conducted in accordance with principles
contained in Robert's Rules of Order.
B. All actions of the Council (except By-Laws Amendment) will
be subject to a majority vote.
Article XI
Amendments
A. Changes may be made upon approval bY a 2/3 vote of the
membership. Proposed amendments shall be submitted in
wri ting. Notice of proposed changes must be mailed to
members at least one week prior to any regular meeting
on which a vote on the proposal is.expected.
