SUIT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is authorized
8 and directed to execute on behalf of said City an agreement with Airline
9 Schools Pacific relating to a workstudy student program in the Park and
10 Recreation Department, a copy of which is attached hereto, marked exhibit "A"
11 and incorporated herein by reference as fully as though set forth at length.

by and between AIRLINE SCHOOLS PACIFIC of San Bernardino, 191 S. "E" Street,
hereinafter called "Contractor" and CITY OF SAN BERNARDINO, a public non-profit
organization, hereinafter called "City",

WHEREAS, a grant from the U.S. Commissioner of Education, pursuant to
Title 1, Part C, of the Economic Opportunity Act of 1964, Public Law 88-452,
78 Stat. 583, to stimulate and promote the part time employment of students from
low income families who are in need of the income from such employment to pursue
courses of study at institutions of higher education, such as Contractor, and
WHEREAS, Contractor and City desire that certain of Contractor's students
engage in work for public and private non-profit organizations under the Work-Study
Program authorized by the Act, and
WHEREAS, City is in a position to utilize the services of such students,
NOW, THEREFORE, the parties hereto agree as follows:
1. City shall utilize the services of students furnished by Contractor
who are eligible to participate in the Work-Study Program and, who are qualified
and acceptable to City. The specific services to be performed by said students are
set forth on the attached Exhibit "A" which is incorporated herein.
2. The work performed by said students will be an extension of some

substantial part of the student's academic program or be clearly connected with
the studen~ long-range vocational goal. Such work shall also be in the public
interest and shall be consistent with the purposes of the Economic Opportunity Act
of 1964.

3. The work performed by said students shall not:
a. Otherwise be provided;
. b. displace employed workers or impair existing contracts for
services;
c. imrolve political activity or work for any political party;
or
d. involve the construction, operation or maintenance of so
much of any facility used for sectarian instruction or as a
place. of religious worship.
4. City agrees to:
a. Reasonably supervise the services of students participating in
the Work-Study Program and permit reasonable supervision by a
representative of the Contractor;
b. make a report to Contractor of the time worked by students
participating in the program, at least monthly;
c. allow no student to work for more than sverage of fifteen
hours per week per semester in which he is enrolled in classes
-- no individual weekly hours to exceed twenty (20) hours
and for not more than forty (40) hours in any other week; and
d. pay to Contractor at least twenty (20) percent of the total
compensation to be paid to students participating in the program
at such times as are agreed upon with the Contractor in writing.
5. Compensation to be paid to students participating in the program will
be appropriate and reasonable in light of the work to be performed by them.
6. The services and benefits of City which involve the work of such
students shall be available to all persons regardless of race, color or national
origin. No student shall be denied participating in the Work-Study Program because
of race, color or national origin.

7. City will be responsible for all employee benefits, normally provided
to temporary part time personnel employed by the City.
8. This agreement shall be subject to the availability of funds to
Contractor for the portion of the student's compensation not to be paid by City.
It shall also be subject to the provisions of the Economic Opportunity Act of 1964,
the. regulations adopted thereunder, and all legislation and regulations pertaining
to the Work-Study Program adopted subsequently.
9. This agreement may be cancelled by either party if there is a failure
to comply with the provisions of the agreement.
10. This agreement shall terminate June 30, 1977, unless .sooner terminated,
and shall be subject to extension by the mutual agreement of the parties hereto in
writing.

to supervise recreation areas.

5. Cost estimate: Use a separate line for each category, and using factors of
hourly pay rate and number of weeks per year, produce a total cost per job per
year for each category. Multiply this by number of jobs to arrive at total
cost for similar jobs. Add costs of all jobs for total cost of program.

6. The City of San Bernardino, hereinafter known as the "Organization" agrees to
pay to Airline Schools Pacific, hereinafter known as the "Institution" 20% of
the Students' Gross Wages and the FICA and SUI employer payroll taxes and the
Workmsns Compensation fee.
The 'Organization also agrees to pay the Institution 15% of the Gross Wages
to compensate the Institution for its administrative costs relating to admin-
istering the College Work Study Program. The Organization will submit to the
Institution an advance payment based on the number of students and number of

hours each student is calculated to be employed by the Organization in the
subsequent thirty (30) day period. Any unused portion of the above-mentioned
advance payment will be refunded by the Institution to the Organization at the
