2 RESOLUTION OF THE CITY OF SAN BERNARDINO REQUESTING THE
UNITED STATES CORPS OF ENGINEERS TO ASSUME FINANCIAL BURDEN AND
3 RESPONSIBILITY OF MINIMIZING THE IMPACT OF THE TWIN CREEK-SANTA
ANA RIVER FLOOD CONTROL PROJECT UPON THE SAN BERNARDINO PUBLIC
4 GOLF COURSE SITUATED AT 1494 SOUTH WATERMAN AVENUE, SAN BERNARDINO
CALIFORNIA.

WHEREAS, the San Bernardino Public Golf Course is a
privately owned and tax paying eighteen hole regulation golf

course available for use by the public; and
WHEREAS, said golf course is the only regulation eighteen
10
hole golfing facility available for use by the general public
11 without regard to race, color, creed, sex, national origin, and
12 golfing ability, and said golf course is a vital center of
13 recreation available to all of the people of the City of San
14 Bernardino; and
15 WHEREAS, said public golf course currently provides 60,000
16 rounds of golfing pleasure each year and said golf course serves
17 the entire San Bernardino Valley; and
18 WHEREAS, the United States Corps of Engineers has contracte
19 for the immediate construction of the Twin Creek-Santa Ana River
20 Flood Control project; and
21 WHEREAS, said project has been designed and construction
22 thereon commenced without evaluation by the United States Corps
23 of Engineers or any other body as to the impact of said project
24 upon said golf course as required by laws of the State of
25 California and the United States government, to wit: The
26 California Environmental Quality Act and the National Environ-
27 mental Protection Act; and
28 WHEREAS, said flood control project will in fact cause

1 severe adverse impact and great damage to said golf course and
2 particularly the impact will cause great damage upon that portion
3 of the said golf course that is situated upon real property owned
4 in fee by the City of San Bernardino; and
5 WHEREAS, no statement or report of the impact of said
6 project upon the golf course was ever offered to the City of San
7 ! Bernardino for evaluation purposes pursuant to the provisions of
8 the National Environmental Protection Act and the California
9 Environmental Quality Act,
10 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
11 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

1. That the United States Corps of Engineers should
evaluate the adverse impact of the Twin Creek-Santa Ana River
i!Flood Control Project upon the San Bernardino Public Golf Course
'and ascertain the damages to said property.
2. That the united States Corps of Engineers should fully
assume the responsibility and the financial burden of minimizing
the adverse impact and damages upon and to the San Bernardino
Public Golf Course by their construction of the Twin Creek-Santa
Ana River Flood Control Project.
3. That the United States Corps of Engineers should under-
22 take the responsibility of reconstructing the San Bernardino
23 Public Golf Course in such a manner that will restore the course
24 to a regulation eighteen hole golf facility available to the publi
25 in order that said flood control project be compatible with said
26 golf course. Said reconstruction should be accomplished in the
27 shortest possible time.
28 I HEREBY CERTIFY that the foregoing resolution was duly
