II animals and city is agreeable to aid and assist Lorna Linda by I' impounding, caring for and disposing of animals delivered to the I ' Animal Shelter by residents of Lorna Linda or official represen- 12 13 14 15 16 tatives of Loma Linda, according to the fee provisions of 17 18 19 this Agreement, NOW, THEREFORE, IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS: 20 1. City shall, through its Animal Control Department, 21 accept, impound and dispose of any and all dogs, cats or other 22 animals whiCh are delivered to City's Animal Shelter pursuant 23 to this Agreement. This Agreement shall be for a term of five 24 (5) years commencing July 1, 1976. 25 2. City shall, for and on behalf of Lorna Linda, euthanize 26 or otherwise dispose of all dogs at the request of Loma Linda, 27 provided that no dog shall be euthanized or disposed of without 28 an attempt to notify the owner of such dog, if he be known by , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 IS 16 17 18 19 20 21 22 23 24 25 26 27 28 '. City; and no dog so impounded shall be euthanized or~isposed of before seventy-two (72) hours have elapsed from the time the dog was delivered to the Animal Shelter. Lorna Linda "'Slial.l indemn fy, defend and hold harmless City, its officers, agents and employees from any liability or claim arising from the performance of any of the provisions of this Agreement. 3. Lorna Linda shall pay to City the sum of eight dollars ($8.00) for each and every dog brought to the City Animal Shelter by an agent, officer or employee of Lorna Linda. 4. It is agreed that upon Lorna Linda delivering a dog, together with a bona fide request from the owner for the imme- diate disposal thereof, City, pursuant to said authorization, shall dispose of said dog and shall charge eight dollars ($8.00) to cover the cost of euthanization or other means of disposal. 5. Lorna Linda agrees to pay to City the sum of eight dollars ($8.00) for each and every stray dog brought into the Animal Shelter by anyone from within the corporate limits of Lorna Linda. The person delivering said dog shall sign a stub or delivery sheet. 6. city is hereby authorized to accept a dog (or cat) from the bona fide owner thereof residing within the incorpora- ted limits of Lorna Linda. In such cases, where such dog (or cat) is delivered to the Animal Shelter by the. owner thereof, no charge shall be made against Lorna Linda for its disposal. Fees charged the owner for such disposal shall be the same as those provided for in this Agreement for Lorna Linda. 7. City shall charge three dollars ($3.00) per day for each anilllal placed in quarantine for observation of suspected -2- - ". 1 2 ~ Ii 11 Ii I , ! disease and, in the event of disposal of said animal upon II I order of Loma Linda, City shall charge the sum of three dollars ($3,00) for said disposal. B. City shall charge the sum of three dollars ($3.00) . . 3 4 5 each for the disposal of dead dogs, the sum of one dollar 6 ($1. 00) each for the disposal of dead cats; the sum of three 7 dollars ($3.00) each for the disposal of live cats over the 8 age of four (4) months; and the sum of one dollar ($1.00) each 9 for the disposal of live kittens under the age of four (4) 10 months. The sum of two dollars ($2.00) each shall be charged 11 12 13 14 for the disposal of live puppies under the age of four (4) months, when authorized to be disposed of by the agent, officer and/or employee of Loma Linda. 9. city shall present a bill on or before the tenth day of 15 each month for all charges made during the prior month, which 16 said bill shall be paid by Lorna Linda not later than the last 17 day of the month in which billed. 18 10. city officers, agents and/or employees shall be 19 deputized and authorized to collect Loma Linda's license, 20 apprehension, Shelter and related penalty fees at the Animal 21 Shelter, as directed by Loma Linda, for all dogs released 22 from the Shelter to residents of Loma Linda. City officers, 23 agents. and/or employees shall also collect the requisite sums 24 for rabies vaccinations where required. Such license forms 25 26 27 and receipt books as may be deemed necessary by Loma Linda will be furnished to City by ~oma Linda. 11. All monies collected by the City Animal control 28 Department for Loma Linda in connection with this Agreement -3- - J 1 i i' ! 2 3 4 5 6 7 8 9 10 11 12 13 14 IS 16 17 18 19 20 21 22 23 24 25 26 27 28 T 'I 'i wl' .. shall be deposited in the City Treasury and shall be paid to Loma Linda on or before the tenth day of each month for the month preceding. 12. City shall annually review the fees charged herein for the purpose of determining whether an adjustment in the fees charged will be required, effective the following July first. If City determines that an increase in the fees charged is warranted, based upon its cost to perform the services herein described, it shall notify Loma Linda in writing of the proposed increase, on or before the first day of May of that year. It is mutually agreed that City shall not increase fees charged by more than ten percent (10%) annually. 13. This Agreement terminates that certain agreement between the parties hereto dated December 10, 1971.
