BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said City an agreement with the City of Rialto concerning the use of the City Animal Shelter and related facilities, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. (animal shelter) THIS AGREEMENT, made and entered into at San Bernardino, California, .this , 1976, by and 16~h day of August between the CITY OF SAN BERNARDINO, a municipal corporation, hereinafter called "City", and the CITY OF RIALTO, California, hereinafter called "Rialto". WIT N E SSE T H: ---------- WHEREAS, City has an Animal Shelter and other facilities for the handling of animals; and WHEREAS, Rialto does not have an Animal Shelter or other facilities to handle the impounding or disposal of animals and City is agreeable to aid and assist Rialto by ~pounding, caring for and disposing of animals delivered to the AIlimal Shelter by residents of Rialto or official represen- tatives of Rialto, according to the fee provisions of this Agreement, NOW, THEREFORE, IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS: 1. City shall, through its Animal Control Department, accept, impound and dispose of any and all dogs, cats or other animals which are delivered to City's Animal Shelter pursuant to this Agreement. This Agreement shall be for a term of five (5) years commencing July 1, 1976. 2. City shall, for and on behalf of Rialto, euthanize or otherwise dispose of all dogs at the request of Rialto, provided that no dog shall be euthanized or disposed of without an attempt to notify the owner of such dog, if he be known by 11 II I 1 I City; and no dog so impounded shall be euthanized or disposed 2 of before seventy-two. (12) hours have elapsed from the time the 3 dog was delivered to the Animal Shelter. Rialto shall indemnify, 4 defend and hold harmless City, its officers, agents and employees 5 from any liability or claim arising from the performance of any 6 of the provisions of this Agreement. 7 3. Rialto shall pay to City the sum of eight dollars ($8.00) for each and every dog brought to the City Animal 8 9 Shelter by an agent, officer or employee of Rialto. I 4. It is agreed that upon Rialto delivering a dog, I together with a bona fide request from the owner for the imme- I diate disposal thereof, City, pursuant to said authorization, shall dispose of said dog and shall charge eight dollars ($8.00) . to cover the cost of euthanization or other means of disposal. IG 11 12 1l 14 15 5. Rialto agrees to pay to City the sum of eight dollars ($8.00.) for each and every stray dog brought into the Animal Shelter by anyone from within the corporate limits of Rialto. The person delivering said dog shall sign a stub or delivery sheet. 16 17 18 19 20 6. City is hereby authorized to accept a dog (or cat) from the bona fide owner thereof residing within the incorpora- Ited limits of Rialto. In such cases, where such dog I (or cat) is delivered to the Animal Shelter by the owner thereof, I no charge shall be made against Rialto for its disposal. Fees charged the owner for such disposal shall be the same as those provided for in this Agreement for Rialto. 21 22 23 24 2S 26 27 28 7. City shall charge three dollars ($3.00) per day for -2- I 2 3 4 5 6 7 8 9 IG 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 disease and, in the event of disposal of said animal upon order of Rialto, City shall charge the sum of three dollars ($3. 00) for said disposal. 8. City shall charge the sum of three dollars ($3.00) each for the disposal of dead dogs, the sum of one dollar ($l.OO) each for the disposal of dead cats; the sum of three dollars ($3.(0) each for the disposal of live cats over the age of four (4) months; and the sum of one dollar ($LOO) each for the disposal of live kittens under the age of four (4) months. The sum of two dollars ($2.(0) each shall be charged for the disposal of live puppies under the age of four (4) months, when authorized to be disposed of by the agent, officer and/or employee of Rialto. 9. city shall present a bill on or before the tenth day 0 each month for all charges made during the prior month, which said bill shall be paid by Rialto not later than the last day of the month in which billed. 10. City officers, agents and/or employees shall be deputized and authorized to collect Rialto's license, apprehension, Shelter and related penalty fees at the Animal Shelter, as directed by Rialto, for all dogs released from the Shelter to residents of Rialto. City officers, agents and/or employees shall also collect the requisite sums for rabies vaccinations where required. Such license forms and receipt books as may be deemed necessary by Hialto will be furnished to City by Rialto. 11. All monies collected by the City Animal Control Department for Rialto in connection with this Agreement -3-" II . it . . " !I . City shall annually review the fees charged herein for the purpose of determining whether an adjustment in the fees charged will be required, effective the following July first. If City determines that an increase in the fees charged is warranted, based upon its cost to perform the services herein described, it shall notify Rialto in writing of the proposed increase, on or before the first day of May of that year, It is mutually agreed that City shall not increase fees charged by more than ten percent (10%) annually. 13. This Agreement terminates that certain agreement between the parties hereto dated August 3, 1970.
