HomeMy WebLinkAbout12435 1 RESOLUTION NO. /,;J."'~.s- 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE CITY OF REDLANDS CONCERNING 3 THE USE OF THE CITY ANIMAL SHELTER AND RELATED FACILITIES. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 6 SECTION 1. WIT N E SSE T H: ---------- WHEREAS, City has an Animal Shelter and other facilities for the handling of animals; and WHEREAS, Redlands does not have an Animal Shelter or other facilities to handle the impounding or disposal of animals and City is agreeable to aid and assist Redlands by impounding, caring for and disposing of animals delivered to the Animal Shelter by residents of Redlands or official represen- tatives of Redlands, according to the fee provisions of this Agreement, NOW, THEREFORE, IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS: 1. City shall, through its Animal Control Department, 21 accept, impound and dispose of any and all dogs, cats or other 22 animals which are delivered to City's Animal Shelter pursuant 23 to this Agreement. This Agreement shall be for a term of five 24 (5) years commencing July 1, 1976. 2S 26 27 28 2. City shall, for and on behalf of Redlands, euthanize or otherwise dispose of all dogs at the request of Redlands, provided that no dog shall be euthanized or disposed of without an attempt to notify the owner of such dog, if he be known by 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 City; and no dog so impounded shall be euthanized or disposed of before seventy-two (72) hours have elapsed from the time the dog was delivered to the Animal Shelter. Redland. shall indemnif , defend and hold harmless City, its officers, agents and employees from any liability or claim arising from the performance of any of the provisions of this Agreement. 3. Redlands shall pay to City the sum of eight dollars ($8.00) for each and every dog brought to the City Animal Shelter by an agent, officer or employee of Redlands. 4. It is agreed that upon Redlands delivering a dog, together with a bona fide request from the owner for the imme- diate disposal thereof, City, pursuant to said authorization, shall dispose of said dog and shall charge eight dollars ($8.00) to cover the cost of euthanization or other means of disposal. 5. Redlands agrees to pay to City the sum of eight dollars ($8.00) for each and every stray dog brought into the Animal Shelter by anyone from within the corporate limits of Redlands. The person delivering said dog shall sign a stub or delivery sheet. 6. City is hereby authorized to accept a dog (or cat) from the bona fide owner thereof residing within the incorpora- ted limits of Redlands. In such cases, where such dog (or cat) is delivered to the Animal Shelter by the owner thereof, no charge shall be made against Redlands for its disposal. Fees charged the owner for such disposal shall be the same as those provided for in this Agreement for Redlands. 7. City shall charge three dollars ($3.00) per day for each animal placed in quarantine for observation of suspected -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 . 1 disease and, in the event of disposal of said animal upon order of Redlands, City shall charge the sum of three dollars ($3.0.0.) for said disposal. 8. City shall charge the sum of three dollars ($3. DO.) each for the disposal of dead dogs, the sum of one dollar ($1. DO.) each for the disposal of dead cats; the sum of three dollars ($3.0.0.) each for the disposal of live cats over the age of four (4) months; and the sum of one dollar ($1.0.0.) each for the disposal of live kittens under the age of four (4) months. The sum of two. dollars ($2.0.0.) each shall be charged for the disposal of live puppies under the age of four (4). months, when authorized to be disposed of by the agent, officer and/or employee of Redlands. 9. City shall present a bill on or before the tenth day 0 each month for all charges made during the prior month, wHich said bill shall be paid by Redlands not later than the last day of the month in whiCh billed. 10.. City officers, agents and/or employees shall be deputized and authorized to collect Redlands' license, apprehension, Shelter and related penalty fees at the Animal Sh.elter, as directed by""litedlands, for all dogs released from the Shelter to residents of Redlands. City officers, agents and/or employees shall also collect the requisite sums for rabies vaccinations where required. Such license forms and receipt books as may be deemed necessary by Redlands will be furnished to City by Redlands. 11. All monies collected by the City Animal Control Department for Redlands in connection with this Agreement -3- . 1 shall be deposited in the City Treasury and shall be paid to Redlands on or before the tenth day of each month for the 2 3 month preceding. 12. City shall annually review the fees charged herein 4 5 for the purpose of determining whether an adjustment in the 6 fees charged will be required, effective the following July 7 first. If City determines that an increase in the fees charged 8 is warranted, based upon its cost to perform the services 9 herein described, it shall notify Redlands in writing of the 10 proposed increase, on or before the first day of May of that 11 year. It is mutually agreed that City shall not increase fees 12 charged by more than ten percent (10%) annually. 13 13. This Agreement terminates that certain agreement between the parties hereto dated September 1, 1970.
