HomeMy WebLinkAbout12449 10 11 12 13 14 is 16 17 18 19 20 21 22 23 24 2S 26 27 28 . 1 RESOLUTION NO. /,.;J.:Y~? 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING AND CONCtJRlUNG IN POLICY DETERMINATIONS APPLICABLE TO AND BE'lWEEN 3 THE MAYOR AND COMMON COUNCIL OF SAID CITY AND THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO RELATING TO PROSPECTIVE 4 EXPENDITURES AND INDEBTEDNESS OF SAID AGENCY WITHIN AND WITHOUT REDEVELOPMENT PROJECT AREAS. S 6 WHEREAS, on March 1, 1976, the Mayor and Common Council of the City of San Bernardino adopted Resolution Nos. 12353 and 12354 designating survey areas for the proposed Southeast Industrial Redevelopment Project which contained a recital that purchases of real property, contracts for services or studies, or other commitments would not be consummated without the pr~8E approval of the Mayor and Common Council; and 7 8 9 WHEREAS, the Redevelopment Agency of the City of San Bernardino concurred in the policy determinations of said resolutions and on June 7, 1976, through its members, agreed to ex~~4such policy determinations to all redevelopment project areas and the other financial transactions hereinafter IIIOre particularly set forth; and WHEREAS, the Mayor and Common Council and said members desire to work together cooperatively and harmoniously in the public interest in the initiation and conswmnation of redevelop- ment projects and related matters, NOW, THEREFORE, BE IT RESOLWD BY THE.'!m.YOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor and Common Council of the City of San Bernardino, hereinafter called RCouncilR and the members of the Redevelopment Agency of the City of San Bernardino, herein- after called RMembersR, bave agreed to establish and comply with certain policy determinations in the exercise of their 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15- 16 17 18 19 20 21 22 23 24 25 26 27 28 legislative, administrative and quasi judicial powers in the initiation and the implementation of redevelopment projects in conformance with the California Community Development Law and in the consummation of related areas of mutual public interest, as more particularly set forth herein. SECTION 2. The Council has requested, and the Members have agreed to and concurred in, procedural limitations and requirements upon the exercise of the powers and duties of the Members. Consequently, the Council and the Members agree that the Members shall not take any official action, expressed or implied, within and without redevelopment project areas on matters involving sums of money, property, or things of value in excess of $3,000, except as otherwise provided herein, with- out the prior approval of Council taken at a public meeting. The word "matters" shall include but not be limited to: (a) The purchase, sale, exchange or lease of land, improvements and real property; (b) Agreements with, awards of contracts to, or retention of consultants to perform services, undertake studies or surveys or perform other contractural undertakings; (c) The sale or refunding of tax increment bonds or notes; (d) The payment or approval for payment of off-site improvemen ts ; (e) Execution or approval of short term notes or obligations; (f) The payment or approval for payment of relocation costs in excess of $30,000; - 2 - 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 (g) The approval of change orders relating to public 2 projectsf 3 (h) The payment or approval for payment of costs of 4 installation or repair of municipal utilities, sewer and water mains, streets, and other public projects. 5 6 7 8 SECTION 3.
