2 A RESOLUTION OF THE MAYOR AND COMl<<lN COUNCIL OF THE CITY OF SAN BERNAR-
DINO PROVIDING FOR EMPLOYEE EVALUATION REPORTS FOR ALL REGULAR EMPLOYEES OF
3 SAID CITY EXCEPT THOSE EMPLOYEES SERVING UNDER OR IN THE DEPARTMENT OF ELECTED
OFFICIALS, AND REPEALING RESOLUTION NO. 11645.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNAR-
5 DINO AS FOLLOWS:

SECTION ONE: At least once each year, each department head shall prepare
7 or cause to be prepared and shall submit to the Personnel Office an Employee
8 Evaluation Report for each regular employee in his department or under his
9 supervision.
SECTION TWO: A sample copy of the Employee Evaluation Report which is
11 attached hereto and marked Exhibit "A", is hereby referred to and made part
12 hereof as fully as though set out at length herein and is hereby approved. A
booklet of instructions on the preparation and processing of the Employee

Evaluation Report shall be provided to each department head by the Personnel
Office.
SECTION THREE: One Employee Evaluation Report for each regular employee
17 shall be submitted on or before a date designated by the City Administrator
18 once each year; provided, that in addition to said yearly Employee Evaluation
19 Report, the department head shall submit for each probationary employee and
20 for each provisional employee a report within three months after the appoint-
21 ment of said employee and an additional Employee Evaluation Report within five
22 months after such appointment. At the discretion of the department head,
23 Employee Evaluation Reports may be prepared and submitted at more frequent
24 intervals to reflect any significant change in performance or conduct by the
25 employee. Also, at the discretion of the Department Head, an Employee Evalua-
26 tion Report may be prepared and submitted on any full time temporary employee
27 whenever the Department Head feels that the performance of that employee is
28 noteworthy in that it either exceeds standards or is unsatisfactory.

SECTION FOUR: Employee Evaluation Reports shall be prepared in the
manner as set forth in the booklet of instruction. If the department head
is not the actual rater preparing an Employee Evaluation Report, he or his
designee shall be the reviewer of the report and shall sign the report as
Reviewer. The supervisor who actually prepared the Employee Evaluation Report
shall sign the report as Rater. The department head or his designee when
functioning as Reviewer, shall discuss the report with the Rater and the em-
ployee, but he cannot change the report without the concurrence of the Rater.
If he recommends changes with which the Rater agrees, the Rater either makes
the changes or prepares a new report. If he recommends changes with which the
Rater does not agree, the Reviewer will indicate his rating of each factor
on which there is disagreement and mark each such rating with his initials.
He also shall add his comments to those of the Rater and initial such comments.
Each employee shall be given the opportunity to review and discuss with the
Rater each report prepared concerning his performance since this is a progress ,

report to the employee, letting him know how well he is doing his job and help-
ing him orient his efforts effectively. The signature of the employee on the
report does not necessarily indicate his agreement with the report; it merely
indicates he has had the opportunity to read and review his Supervisor's eva-
luation of his performance. The employee may, if he desires, indicate his
disagreement in writing and have that written statement added to and become a
part of the evaluation report. A conference to resolve this disagreement shall
be arranged with the employee and his department head or the City Administrator
as appropriate.
SECTION FIVE: To provide a record of the employee's use of sick leave,
the appropriate blocks in the report shall be used to indicate the number of
hours of sick leave the employee used each month during the period of the re-
port. For probationary employees who do not have an accrual of sick leave un-

til the completion of six months of service, the number of hours of leave of

absence without pay will be recorded on the 3 monthly and 5 monthly reports

in place of sick leave hours.

SECTION SIX: Employee Evaluation Reports of record may be considered by

the Civil Service Board, the Mayor and Common Council, or the department head
6
for any permissible personnel purpose including but not limited to disciplinary
7
proceedings, examinations for promotional applicants, or reduction-in-force
8
determinations pursuant to Civil Service Rules and Regulations.

SECTION SEVEN: The provisions of this Resolution shall not be applicable
to employees serving under or in the department of elected officers.
SECTION EIGHT: Each Employee Evaluation Report shall be a confidential
record and its contents shall be kept and remain confidential to and from other

employees or persons not authorized to review and examine the same or to hear
the contents thereof.
SECTION NINE: This resolution shall become effective JUcly 1,1976
and Resolution No. 11645 is repealed effective July 1, 1976.
