HomeMy WebLinkAbout12391 1 RESOLUTION NO. /,;{.5?/ 2 A RESOLUTION 01' t~ MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF COLTON AVENUE 3 (50.00 .FE1!!r,WIh!;) LYING SOUTH OF HILLCREST AVENUE, AND NORTHWESTERLY OF THE P.E. RAILROAD, AND RESERVING PUBLIC UTILITY EASEMENTS THEREON. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 5 BERNARDINO AS FOLLOWS: 6 SECTION 1. That the Mayor and Common Council of the City of San Bern- 7 ardino hereby declares its intention to order the vacation of a portion of 8 Colton Avenue (50.00 feet wide) lying South of Hillcrest Avenue and Northwest 9 of the P.E. Railroad, in said City, which said portion more particularly is 10 described as follows: 11 13 That portion of Colton Avenue (50.00 feet wide) as delineated on the Map of Tract No. 2397, as per plat thereof recorded in Book 34 of Maps, Page 29, Records of the County Recorder, County of San Bernardino, State of California, lying Southwesterly of a line drawn parallel with and 30.00 feet South of and measured at right angles to the center line of Hillcrest Avenue as delineated on said map of Tract No. 2397. 12 14 15 SECTION 2. That the Mayor and Common Council of the City of San 16 Bernardino, in vacating the above described portion of said street, elects 17 to proceed under and in accordance with the provisions of the "Street 18 Vacation Act of 1941", being Division 9, Part 3, of the Streets and Highways 19 Code of the State of California. SECTION 3. That the hour of 9:30 A.M., on the 3rd of May, 1976, in 20 21 the Council Chamber of the City Hall, San Bernardino, lJcalifornia, be, and 22 the same hereby is fixed as the time and place when and where all persons 23 interested in or objecting to the proposed vacation may appear before the 24 said Mayor and Common Council and offer evidence in relation thereto. For 25 further particulars as to the proposed vacation of the hereinbefore des- 26 cribed portion of said street, reference is made to that certain map marked 27 "Plan No. 4892" approved April 12" 1976, on file in the office of the City 28 Clerk of said City. 1 SECTION 4. Nothing in this Resolution shall in any way affect or 2 disturb any existing easements for sanitary sewer and appurtenant facilities 3 and for public utility purposes belonging either to the City of San Bernar- 4 dino or to any public utility and there is hereby reserved for future general 5 public utility purposes and for this City an easement reasonably necessary 6 to locate such sanitary sewer and public utility facilities over, in, under, 7 or across the Southeast 25.00 feet of the above described portion of said 8 Colton Avenue described hereinbefore and to use, maintain, repair, replace 9 or renew such facilities. 10 SECTION 5. That the City Engineer of the City of San Bernardino 11 hereby is directed to cause Notices of Street Vacation to be posted as re- 12 qui red by the Street Vacation Act of 1941. 13 I HEREBY CERTIFY that the foregoing resolution was duly adopted by 14 the Mayor and Common Council of the City of San Bernardino at 15 16 17 18 19 20 21 22 23 24 25 26 27 28 day of meeting thereof held on the :6~O~~~ NOES:....7~... ......... ...... ...... ... ........... .
