I;?~/? 2 RESOLUTION OF THE CITY OF SAN BERNARDINO PROVIDING FOR AND CALLING A SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE FIRST WARD 3 OF THE CITY OF SAN BERNARDINO ON TUESDAY THE 9TH DAY OF MARCH, 1976 AND APPOINTING OFFICERS OF ELECTION AND DESIGNATING THE 4 POLLING PLACES THEREFOR. 5 WHEREAS, at a Municipal Primary Election on February 6, 6 1973, Anthony E. Campos was duly and regularly elected as a member 7 of the Common Council in and for the First Ward of the City of San 8 Bernardino; and 9 WHEREAS, a recall petition seeking the removal of the 10 incumbent, said Anthony E. Campos, was filed in the Office of the 11 City Clerk on the 27th day of January, 1976; and 12 WHEREAS, the City Clerk's Certificate, dated the 28th day 13 of January, 1976, shows the petition to be sufficient, and it is 14 now necessary to call an election in accordance with the pro- 15 visions of the Charter of the City of San Bernardino; 16 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 17 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 18 SECTION 1. A recall election is hereby called in the First 19 Ward of the City of San Bernardino, to be held on Tuesday, the 20 9th day of March, 1976, for the purpose of electing a candidate 21 as a member of the Common Council in and for the First Ward of the 22 City of San Bernardino for the unexpired term of the office of 23 Councilman of the First Ward. 24 SECTION 2. That for the purpose of said special municipal 25 election said First Ward of the City of San Bernardino shall be 26 and is hereby divided into 14 consolidated voting precincts, 27 which consolidated voting precincts shall be respectively numbered 28 and shall respectively embrace the following enumerated regular .... ~; i' 1 2 3 election precincts of said City as established by the Board of Supervisors of the County of San Bernardino, and as said precincts now exist in the City of San Bernardino; that the polling places 4 5 6 and officers of election shall be as follows, to wit: Consolidated Voting Precinct No. 1 shall consist of the following County Precincts, namely: San Bernardino 63-83-104. 7 8 9 Polling Place: Inspector: Judge: Clerk: Clerk: Allessandro School, 670 Ramona Avenue Irene Arrieta, 1598 West 5th Street Joyce Cervantes, 527 Tia Juana Street Audrey B. The City Clerk is hereby instructed, directed and authorized to procure, prepare and distribute all necessary 17 18 ballots and election supplies for said election. SECTION 4. The polls shall be open at 7:00 a.m. of the 19 day of said election and shall be kept open until 7:00 p.m. of the 20 same day when the polls shall be closed, except as provided in 21 Section 14436 of the Elections Code. 22 SECTION 5. Said election is hereby called and will be held 23 in accordance with and under and pursuant to the Charter of said 24 City and in accordance with the provisions of the Elections Code 25 of the State of California, except as specifically provided for 26 by local ordinances or this resolution. 27 The time provisions contained in Section 22836 of the 28 Elections Code are inapplicable due to the time requirements of -4- ,- : - ," 1 the City Charter. The candidates shall be nominated in accordance 2 with said section 22836, except that all candidates shall be 3 nominated not earlier than the 3rd day of February, 1976, and not 4 later than five o'clock p.m. on the 9th day of February, 1976. 5 Each candidate shall pay the usual filing fee as set forth in 6 Ordinance No. 2048. 7 All nomination papers shall be filed with the City Clerk 8 not later than five o'clock p.m. on the 9th day of February, 9 1976. 10 The time provisions contained in Section 14621 of the 11 Elections Code are inapplicable due to the time requirements of 12 the City Charter. That absentee voting shall be in accordance 13 with section 14621 of the said Elections Code, except that 14 absentee ballots will be issued not earlier than the 12th day of 15 February, 1976, and not later than five o'clock p.m. on the 2nd 16 day of March, 1976. 17 SECTION 6. The City Clerk shall certify to the passage 18 and adoption of this resolution and cause the same to be published' 19 once in the San Bernardino Sun Telegram, a newspaper hereby 20 designated for that purpose, and that due publication of this 21 resolution as herein provided is hereby determined to be and shall 22 constitute due notice of said election and no other notice need 23 be given. 24 I HEREBY CERTIFY that the foregoing resolution was duly 25 adopted by the Mayor and Common Council of the City of San 26 Bernardino at a on the A'''!.--J day of meeting thereof, held 27 , 1976, by the following vote, 28 to wit: -5- .
