RESOLUTION OF THE. CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 6433
ENTITLED IN PART "A RESOLUTION . . . ESTABLISHING POSITIONS FOR THE VARIOUS
DEPARTMENTS . . ."; AND AMENDING SECTIONS PROVIDING FOR EMPLOYEE BENEFITS
RELATING TO SICK LEAVE, PAYMENT FOR UNUSED SICK LEAVE, VACATIONS AND HEALTH
INSURANCE COVERAGE.
BE IT RESOLVED BY THEIIlAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNAR-
DINO AS FOLLOWS:

SECTION 1. Resolution No. 6433 Section Five, Subsection (b) is hereby

amended to read as follows:

"SECTION FIVE:

(b) All full time officers and employees of the City of San I2rnardino
10
who are actively on duty, have been in the service of said City for six months
11
or more continuously, and who are compelled to be absent from their work on
12
account of illness or injury, other than that caused by or arising from their
13
own moral turpitude, or that which is compensable under Section Six of this
14
Resolution, shall receive their full salary, wages or compensation for a
15
period of one day for each month of continuous service; provided that such
16
salary, wages or compensation shall cease upon the exhaustion of all accumulated
17
Sick Leave; and further provided that Sick Leave shall not accumulate while
18
said employees or officers are being compensated under the provisions of Section
19
Six of this Resolution.

Said Sick Leave may be accumulated without limit and time off with pay for
21
ick Leave shall be considered as time worked for purposes of the accrual of
22
Sick Leave only. Sic.k Leave usage shall not be decreased by the fact that any
23
egal holiday occurs during time off on account of illness. The words "legal
24 olidays" shall have the meaning ascribed to them in Section Seven of this
25
solution. Sick Leave shal.l not accumulate during periods of leave of absence
26
ithout pay. The words "working day" shall mean a normal eight hour day to
27 hich an employee has been assigned to work.

The six working days of Sick Leave granted after six calendar months
of continuous service as herein provided for all full-time officers and em-
ployees of the City of San Bernardino shall be computed at the rate of approx-
imately 3.7 hours per pay period. In the event an employee works less than
fifty percent (50%) of the total normal work hours in the pay period, he shall
receive no Sick Leave benefit for such pay period and shall not be credited
with the 3.7 hours of Sick Leave.
Approved vacation, sick leave, holiday or compensatory time off shall be
considered as time worked'for the purpose of computing Sick Leave benefits
only."
SECTION 2. Resolution No. 6433 Section Five and Three-Quarters is hereby
amended to read as follows:
"SECTION FIVE AND THREE-QUARTERS: PAYMENT FOR UNUSED SICK LEAVE.
(a) All permanent full-time officers and employees of the City of San
Bernardino and all temporary full-time employees whose positions are funded
under Federal law who are regularly employed in permanent or Federally funded
positions if such benefit is required by said Federal law, or the estate of
any such deceased employee who dies during employment shall be entitled to
receive payment for unused Sick Leave, subject to the restrictions and condi-
tions as set forth below:
(1) Every general permanent employee including the above mentioned
Federally funded temporary full-time positions, or the estate of any such
deceased employee who dies during employment, shall upon retirement, or death,
receive compensation for twentyfive percent (25%) of accumulated, unused sick
leave provided that in no event shall such compensation exceed sixty working
days of such leave.

Effective July 1, 1976, every general permanent employee including the
above mentioned Federally funded temporary full-time positions, or the estate
of any such deceased employee who dies during employment, shall, upon retire-
ment, or death, receive compensation for fifty percent (50%) of accumulated,
unused sick leave provided that in no event shall such compensation exceed
sixty working days of such leave.
(2) Management/confidential employees including positions classifications
P5, P6 and P7 in the Police and Fire Departments, or the estate of any such
deceased employee who dies during employment, shall, upon retirement, or death,
receive compensation for twenty-five percent (25%) of accumulated, unused sick
leave after the completion of less than ten years of continuous full-time em-
ployment with the City, and fifty percent (50%) of accumulated, unused sick
leave after the completion of ten years or more of continuous full-time employ-
ment with the City, provided that in no event shall such compensation exceed
sixty working days of such leave.
Effective July 1, 1976, management/confidential employees, or the estate
of any such deceased employee who dies during employment, shall, upon retiremen
or death, receive compensation for fifty percent (50%) of accumulated, unused
sxck leave provided that in no event shall such compensation exceed sixty work-
ing days of such leave.
(3) Safety Members of the Police Department in position classifications
PI, P2, P3 and P4, of the estate of any such deceased employee who dies during
employment, after the completion of five years of continuous full-time employ-
ment with the City, upon retirement, death or termination of employment, except
through dismissal or resignation with prejudice, shall receive compensation for
fifty percent (50%) of accumulated, unused sick leave, provided that in no
event shall such compensation exceed sixty working days (480 hours) of such
leave.

Safety Members of the Fire Department in position classification Pl, P2,
P3 and P4, or the estate of any such deceased employee who dies during employ-
ment, after the completion of five years of continuous full-time employment
with the City, upon retirement or death shall receive compensation for fifty
percent (50%) of accumulated, unused sick leave, provided that in no event
shall such compensation exceed sixty working days (480 hours) of such leave.
(b) For the purposes of this section, the word "retirement" shall have
the meaning ascribed to it and the definition therefor as set forth in Section
20035 of the Government Code."
SECTION 3. Resolution No. 6433 Section Eleven, Subsections (a) (4) and
(b) (5) are hereby deleted and Subsection (e) is hereby amended to read as
follows:
nCe) Vacation credits may accrue and accumulate for a maximum of two
years' total accumulated vacation credits on a carry over basis from year to
year. Vacations or portions thereof from anyone year so accrued may run
consecutively with vacations or portions thereof of the next succeeding year,
subject to the approval of the Department Head. Except as approved by the
Department Head, no vacation or portion thereof from anyone year shall run
consecutively with the vacation of the preceding year and a period of three
or more months must elapse between the expiration of one year's vacatiDn and
the commencement of the next following year's vacation.
The vacation period to which any employee shall be entitled shall be
assigned by the Head of the Department in the calendar year when due, except
when the department head with the approval of the Mayor determines that emer-
gency or other valid factors beyond the control of the employee prevents the
employee from utilizing his vacation during the calendar year when due. Such
approved carry-over vacation time shall be taken in the subsequent calendar
year as assigned by the Department Head and shall not be taken concurrently wit

SECTION 4. Resolution No. 6433 Section Twelve, Subsection (~) is hereby
amended to read as follows:
"(e) The City shall pay the monthly subscription charges for the sub-
scriber only for group health insurance for Safety M~mb~rs of th~ Fire Dep4rt-
m~nt through August 31, 1978, with the maximum payment limited to th~ pr~mium
charged by eith~r th~ h~alth insurance carrier for the fire fighters' union
or the City's prime group h~alth insurance carrier, provided the selection
is limited to any of the group health plans as may be approved by the City,
The City shsll pay the monthly subscription charg~s for the subscriber only
for group h~alth insurance for Safety Members of the Police Department through
August 31, 1978, with th~ maximum payment limited to the premium charged by
the City's prime group health insurance carrier, provided the group health plan
is limited to any of the group health plans as may be: approved by the City.
The City shall pay the monthly subscription charges for a subscriber and one
family member not to exceed forty-nine dollars and seventy-eight cents
($49.78) for group health insurance for management/confidential and general
employees and their dependents, provided the group health plan is limited to
any of the group health plans as may be approved by the City. The City
further shall pay any increases in health insurance subscription charges for
each management/confidential and general employee and one family member as may
be charged by the City's prime group health insurance carrier through June
30, 1977 up to a maximum total increase of fifteen percent (15%) over the
current charge of forty-nine dollars and seventy-eight cents ($49.78). In
addition to group health insurance, the City shall provide to management/confi-
dential employees ten thousand dollars ($10,000) life insurance coverage and
provide to general employees and safety employees one thousand dollars
