A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF TIlE CITY OF SAN
BERNARDINO DECLARING THE FACT THAT THE OWNER OF ALL TIlE LAND IN CERTAIN
UNINHABITED TERRITORY CONTIGUOUS TO SAID CITY HAS REQUESTED ANNEXATION TO
THE CITY OF SAN BERNARDINO, AND APPROVING THE ANNEXATION OF DISTRICT NO. 304
(LAFC 1566).

WHEREAS, the Mayor and Conunon Council of the City of San Bernardino

have duly received a request by the owner of all the land within certain
7
uninhabited territory contiguous to said City, as shown on the records of the
8
San Bernardino County Assessor, and asking that said territory be annexed to
9
the City of San Bernardino; and
WHEREAS, at its meeting of December 10, 1975, the Local Agency
Formation Conunission of San Bernardino County approved the proposed annexation
and gave consent to proceed without notice, pursuant to Government Code
Section 54797.1.
NOW. THEREFORE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION ONE: That pursuant to Chapter 1, Article 1, Section 35015
of the Government Code, the annexation of that certain uninhabited territory
contiguous to the City of San Bernardino, designated as Annexation District
No. 304 (LAFC 1566), be and the same hereby is approved.
Said territory is described as follows:
That portion of Lot 18, Tract No. 2834, as per plat thereof
recorded in Book 39 of Maps, Page 16 Records of the County
Recorder of San Bernardino County, State of California and
those portions of the adjoining streets described as follows:
Beginning at a point on the present corporate limits of the
City of San Bernardino, said point being the intersection of
the center lines of Third Avenue and 40th Street; thence
South along said City Limit Line a distance of 20 feet more
or less to an angle point in said City Limit Line; thence
East along said City Limit Line, a distance of 130 feet more
or less to its intersection with the Southerly prolongation
of the East line of said Lot 18; thence leaving said City
Limit Line North along said Southerly prolongation and along
the East line and its Northerly prolongation, a distance of
177 feet more or less to its intersection with the center

line of that certain 20 foot alley as shown on the map of
said Tract No. 2834; thence West along said center line a
distance of 130 feet more or less to its intersection with
the center line of said Third Avenue; thence South along
said center line, a distance of 27 feet more or less to an
angle point in said City Limit Line; thence continuing South
along said center line and City Limit Line, a distance of
130 feet more or Ie.. to the Point of Beginning.

SECTION TWO: That the de.cribed property will be subject to

taxation equally with the property within such municipal corporation to
pay its proportion of the following bonded indebtedness of the City of San
9
Bernardino, Which said bonded indebtedness was outstanding or theretofore
authorized and i. outstanding at the time of said annexation, to wit:
A bonded indebtedness of $490,000.00 incurred for the acquisition
and construction of a public library, including additions to and enlargements
of the public library system of said city, the outstanding indebtedness
thereon being $90,000.00,
bearing interest rates of 4-3/4%, 3-1/4% and 3-1/2
per annum;
A bonded indebtedness of $1,116,000.00 incurred for the acquisition
and c~nstruction of additions to; relocations of and replacements of the
fire fighting system of said city, the outstanding indebtedness thereon being
$480,000.00,
bearing interest at the rates of 4%0 3%, 2-3/4%, 2.9% and 2-1/2
per annum.
SECTION THREE: That the property herein annexed is declared to be
a part ~f Ward 5, the boundaries of Ward 5 are hereby altered to include said
annexed territory" and said annexed territGry is placed and declared to be
admitted to the Ci~ty with zoning classification in the C-3A General Limited
Commercial Zoning DIstrict.
SECTION FOUR: That the area included in the above annexation is
hereby detached from County Service Area 1138, Improvement Zone "e" of CSA 1138,
CSA 1170, Improvement Zone "A" of CSA 1170 and CSA SL-l.
