HomeMy WebLinkAbout12285 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 RESOLlITION NO. /~;<S'.,s- 2 A RESOLlITION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DECLARING TIlE FACT mAT TIlE OWNERS OF ALL TIlE LAND IN CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO SAID CITY HAVE REQUESTED ANNEXATION TO TIlE CITY OF SAN BERNARDINO, AND APPROVING THE ANNEXATION OF DISTRICT NO. 305 (LAFC 1567). 3 4 5 WHEREAS, the Mayor and Conunon Council of the City of San Bernardino 6 have duly received a request by the owners of all the land within certain 7 uninhabited territory contiguous to said City, as shown on the records of the 8 San Bernardino County Assessor, and asking that said territory be annexed 9 to the City of San Bernardino; and WHEREAS, at its meeting of December 10, 1975, the Local Agency Formation Conunission of San Bernardino County approved the proposed annexation and gave consent to proceed without notice, pursuant to Government Code Section 54797.1. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: That pursuant to Chapter 1, Article 1, Section 35015 of the Government Code, the annexation of that certain uninhabited territory contiguous to the City of San Bernardino, designated as Annexation District No. 305 (LAFC 1567), be and the same hereby is approved. Said territory is described as follows: Those portions of Tract No. 3008 as per plat thereof recorded in Book 40 of Maps, page 93, Records of the County Recorder of San Bernardino County, State of California and those portions of the adjoining streets, described as follows: Beginning at a point on the present corporate limits of the City of San Bernardino, said point being the intersection of the South line of Third Street 82.50 feet wide and the center line of Del Rosa Drive; thence leaving said City Limit Line North along said center line of Del Rosa Drive, a distance of 400 feet more or less to its intersection with the center line of Court Street; thence East along said center line of Court Street, a distance of 395 feet more or less to its intersection with the center line of Del Rosa Avenue; thence South along said center line of Del Rosa Avenue, a distance of 375 feet, 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 more or less to its intersection with the South line of Third Street, said point also being on said City Limit Line; thence West along said South line of Third Street and said City Limit Line, a distance of 395 feet more or less to the point of beginning. (Containing approximately 3.76 acres) 2 3 4 SECTION TWO: That the described property will be subject to 5 taxation equally with the property within such municipal corporation to 6 pay its proportion of the following bonded indebtedness of the City of San 7 Bernardino, which said bonded indebtedness was outstanding or theretofore 8 authorized and is outstanding at the time of said annexation, to wit: 9 A bonded indebtedness of $490,000.00 incurred for the acquisition and construction of a public library, including additions to and enlargements of the public library system of said city, the outstanding indebtedness thereon being $90,000.00, bearing interest rates of 4-3/4%, 3-1/4% and 3-1/2% per annum; A bonded indebtedness of $1,116,000.00 incurred for the acquisition and construction of additions to; relocations of and replacements of the fire fighting system of said city, the outstanding indebtedness thereon being $480,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% per anntml. SECTION THREE: That the property herein annexed is declared to be a part of Ward 3, the boundaries of Ward 3 hereby altered to include said annexed territory, and said annexed territory admitted to the City in the following land use zones, as per map entitled Exhibit "A": a. Lots 34, 35, 36, 37, 38, 41, 42, and 43 to be zoned C-3A General Limited Commercial. b. Lots 39 and 40 to be zoned "T" Transitional.
