HomeMy WebLinkAbout9844 9 10 111 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 J.I i 2: i I 31 i 41 , " 51 I 6 7 81 RESOLUTION NO. <?f~~ A RESOLl1IION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF SAN BERNARDINO TO ANNEX TO SAID CITY CERTAIN UNINHABrrED TERRrrORY DE8elBED HEREIN AND DESIGNATED ANNEXATION DISTRICT NO. 227 (LAFC 730), AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO. SECTION ONE: That pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of San Bernardino, on its own motion, to annex to the City of San Bernardino all that uninhabited territory situate in the County of San Bernardino, State of California, hereby designated as Annexation District No. 227, and described as follows: Those portions of Blocks 65, 66, 70, 71, 76, 77, 82, 83 and 87, Irvington Land and Water Company's Subdivision, as per plat thereof recorded in Book 1, Page 32, Records of Survey, and those portions of Lots H, I, J, K, L and M of the Meyer and Barclay Resubdivision as per plat thereof recorded in Book 12 of Maps, Page 18, and Lots 11 and 13 of the Meyer and Barclay Sub as per plat thereof recorded in Book 2 of Maps, page 32, and that portion of Tract 3167 as per plat recorded in Book 42 of Maps, page 59, and that portion of Section 2, Township 1 North, Range 5 West, San Bernardino Meridian, if said Section lines were extended across the Rancho Muscupiabe as per plat recorded in Book 7 of Maps, page 23, all of records of the COUQQY Recorder of San Bernardino County, State of California, and those portions of the adjoining streets, described as follows: Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being the intersection of the center line of Palm Avenue, 60.00 feet wf.le and Belmont Avenue, 60.00 feet wide; thence leaving said City Limit Line Northwesterly along the center line of Belmont Avenue a distance of 2850.00 feet, more or less to the Northeasterly prolongation of the Northwesterly line of Magnolia Avenue, 60.00 feet wide; thence Southwesterly along said Northeasterly prolongation a distance of 30.00 feet to a point on the present non-contiguous City Limit Line; thence along said present non-contiguous City Limit Line the following courses and distances; thence Southwesterly along the Northwesterly line of Magnolia Avenue a distance of 1360.00 feet, more or less, to the intersection with the Northeasterly line of Irvington Avenue, 60.00 feet wide; thence Northwesterly along said Northeasterly line of Irvington Avenue a distance of 994.00 feet, more or less, to the~intersection of the Southwesterly prolongation of the Easterly line of t~. West one-half of the West one-half of said Block 76; thence Northeasterly along said last mentioned Easterly line and its Northerly prolongation a distance of 130.00 feet, more or less, to the Southwesterly line of said Belmont Avenue; thence Southeasterly along said Southwesterly line of Belmont Avenue a disblQce of 990.00 feet, more or less to the Northwesterly line of said Magnolia Avenue; thence leaving said non-contiguous City Limit Line North- easterly along the Northeasterly prolongation of the Northwesterly line of said Magnolia Avenue a distance of 30.00 feet to the center line of said Belmont Avenue; thence Northwesterly along the center line of said Belmont Avenue a distance of 2060.00 feet, more or less, to the most Westerly terminus of said Belmont Avenue, said point also being on the South line of Lot "H" of said Meyer and Barclay Resubdivision; thence Westerly along the South line of said Lot "H" a distance of 75.00 feet, more or less, to the Southeast corner of that certain property conveyed to Bernice Nyda Bonstein as parcel three in the deed recorded September 18, 1958, Document No. 435 in Book 4607, page 214, Official Recor9s of said County; thence North 310 53' West a distance of 449.90 feet to the most Northerly corner thereof; thence South 570 31' West along the Northwesterly line of said Bonstein property a distance of 132.69 feet to a point on the Easterly line of said Lot "I" of said Meyer and Barclay Resubdivision; thence Northwesterly along the Northeasterly line of Lots I, J, K, and L of said Meyer and Barclay Resubdivision a distance of 3282.00 feet, more or less to the Northeast corner of Lot 11 of the Meyer and Barclay Sub; thence Northwesterly along the Northeasterly lines of said Lots 11 and 13 of said Meyer and Barclay Sub a distance of 1910.70 feet to the Northeasterly corner of Lot "Q" of said Meyer and Barclay Resubdivision; thence Southerly along the Easterly line of said Lot Q a distance of 1933.00 feet, more or less to the center line of State Highway No. 3l;c.thence Southeasterly along the center line of State Highway No. 31 a distance of 10,120.00 feet, more or less, to the ceal:er line of said Palm Avenue; thence Northeasterly along the center line of said Palm Avenue and along said City Limit Line a distance of 3420.00 feet, more or less to the point of beginning. 2 3 4 5 6 7 8 9 Containing 460 Acres, more or less. That there are less than twelve qualified electors residing in said territory and that said territory is uninhabited as defined by said Act. SECTION TWO: That the said Council of the City of San Bernardino 30 desire to annex said uninhabited territory to the City of San Bernardino for 31 the following reasons: Said territory is contiguous to the City of San 32 Bernardino and its proposed annexation will contribute and facilitate the _,""C"' ~,~~_._-'__ __ q_...........'r.. _.",~_.... - 2 - 18 19 20 21 ~ orderly growth and development of both the City of San Bernardino and the 2 territory proposed to be annexed, and will provide and facilitate proper 3 over-all planning and zoning of lands in said City and said uninhabited 4 territory in a manner most conducive to the welfare of said City and said 511 6" I 71 ! i 81 , 91 , 101 , 11! 121 13 14 uninhabited territory. SECTION THREE: That upon the completion of said annexation of said territory, all of the property included in said Annexation District No. 227 shall be taxed equally with the other property within the City of San Bernardino to pay the bonded indebuedness ftnd any and all general indebtedness of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of said described property as provided in said Act. SECTION FOUR: That Monday, the '7d , day of J~t- , 1969, at the hour of '7':....'10 12. ~ . 15 16 of said day in the Council Chambers in the City Hall in the City of San Bernardino, County of San Bernardino, California, is hereby fixed as the time 17 and place when and where any person owning real property within the uninhabited territory, above described and proposed to be annexed to the City of San Bernardino, and having any objections to the proposed annexation may appear before the Council of the City of San Bernardino and show cause why such uninhabited territory should not be so annexed to said City of 22 San Bernardino. Such protest must be in writing, may be filed with the City 23 24 25 26 Clerk at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description of such property in general terms. SECTION FIVE: The City Clerk of the City of San Bernardino is 27 hereby authorized and directed to cause a copy of this resolution to be 28 published at least twice, but not oftenerGthan once a week, in the San 29 Bernardino Free Press, a newspaper of general circulation published in the 30 City of San Bernardino, the city to which it is proposed to annex the 31 aforesaid territory, and also in the Highland Messenger, a newspaper of 32 general circulation published outside the City of San Bernardino, but in the - 3 - \! II , II II I ! i I I I Ii I I 21 31 411 5 :1 II 61 71 I 8; I 9 10 I 11i 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 County of San Bernardino, California, the county in which is located the territory proposed to be annexed to the City of San Bernardino, said publication to be complete at least twenty (20) days prior to the date set for hearing; The said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom lands within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation; And in the event that any land within the territory proposed to be annexed is owned by a county, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation; And in the event there is upon the land proposed to be annexed a structural improvement, owned, being acquired or leased by a county fire protection district, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation; And the City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
