:3 FOR THE IMPROVEMENT OF HILL DRIVE AND MOUNTAIN DRIVE, IN ACCORDANCE

RESOLVED. that the bid of RIVERSIDE CONSTRUCTION COMPANY
for the improvement of Hill Drive and Mountain Drive, in accordance I
with Special provisions No. 3162, is the lowest responsible bidder I
therefor, and that the same be and is hereby accepted and all other i
bids are hereby rejected.
That the contract, a copy of which is attached hereto, marked
Exhibit "A" and referred to and made a part hereof as fully as
though set forth at length herein, be and the same is hereby
awarded to RIVERSIDE CONSTRUCTION COMPANY.
That the Mayor and City Administrator of the .ity of San
Bernardino are hereby authorized and directed to execute in the
name of said City of San Bernardino, the contract with RIVERSIDE
CONSTRUCTION COMPANYfor the improvement of Hill Drive and Mountain
Drive.

NOTICE INVITING BIDS
NOTICE IS HEREBY GIVEN that the City of San Bernardino will receive
bids or proposals for:
THE IMPROVEMENT OF HILL DRIVE, S.B. COUNTY FLOOD CONTROL
DISTRICT CHANNEL TO MTN. DR. AND WEST SIDE OF MTN. DR. FROM
HILL DR. TO NORTHPARK BLVD. IN ACCORDANCE WITH SPECIAL
PROVISIONS NO. 3662, ON FILE IN THE ADMINISTRATIVE OFFICE,
ROOM 211, CITY HALL, SAN BERNARDINO, CALIFORNIA
Deliver all bids to the Office of the City Administrator, Room 211,
City Hall, 426 W. 3rd Street, San Bernardino, California, with the
specification title and number clearly marked on the outside of'the
envelope.
Said bids or proposals will be received up to the hour of 2:00 p.m.,
Tuesday, May 27, 1969 , at which time all of said bids or
proposals will be publicly opened, examined and declared in the
Council Chambers, Room 202, City Hall, 426 W. 3rd Street, San Bernar-
dino, California.
No bid will be received unless it is made on a proposal form furnished
by the City. All bids or proposals shall be signed, sealed and accom-
panied by'cash, cashier's check, certified check or bid bond made
payable to the City of San Bernardino, in the amount of ten per cent
(10%) of the bid. Such cash, check or bond shall be given as a
guarantee that the bidder will enter into the contract if awarded
to him. In the event the bidder refuses to execute said contract,
the use by the public of the improvements will be delayed, and the
public will suffer great damage. From the nature of the case, it
would be extremely difficult and impractical to fix said amount of
damage. Therefore. the City and the bidder agree that the above sum
of 10% shall be paid to the City upon the condition above set forth
as liquidated damages and not as a forfeiture. All bonds furnished
pursuant to this notice must be underwritten by a surety company having
a rating in Best's most recent Insurance Guide of "A" or better.'

Pursuant to law, the Mayor and Common Council of the City of San
Bernardino, by Resolution No. 5718 and any and all amendments thereto
which are hereby referred to and made a party hereof by reference as
fully as though set forth at length herein. have ascertained and
determined the general prevailing rate of per diem wages, and of per
diem wages for legal holidays and overtime work for each craft or type
of workman needed in the execution of contracts under jurisdiction of
said Mayor and Common Council.

the City Clerk, which are made a part of said Resolution No. 5718
and amendments thereto.
It shall be mandatory upon ,the contractor to whom the contract is
awarded and upon any sub-contractor-under him, to pay not less
than said specified rates to all laborers, workmen, and mechanics'
employed by them in the execution of the contract, and to prevent
discrimination in the employment of persons because of race, creed,
color or national origin, as set forth in the provisions of
Resolution No. 7414 of the Mayor and Common Council of the City
of San Bernardino.
No bid will be accepted from a contractor who is not licensed in
accordance with the provisions of Chapter 9, Division III of the
Business and Professional Code.
The City of San Bernardino reserves the right to reject any and
all bids.
Plans and specifications may be obtained from the Office of the
City Administrator, Room 211, City Hall, 426 W. 3rd Street,
San Bernardino, California, upon a non-refundable payment of
$5.00 for each set.

SPECIAL PROVISIONS
SECTION I
GENERAL
The work embodied herein shall be done in accordance with the
Standard Specifications No. 2271, revised October, 1966, of the
City of San Bernardino, Department of Engineering, insofar as the
same may apply, and as modified and in accordance with the fol low-
ing special provis~ons.
In case of conflict between the Standard Specifications and
these special provisions, the special provisions shal I take pre-
cedence over and be used in 1 ieu of such confl ict.ing portions.
SECT! ON I I
DESCRIPTION OF WORK
2.01 General -~ The work to be done consists, in general, of
removal of existing concrete pavement, asphalt pavement, A.C. drive-'
way approaches, performing earthwork for grading roadbed, placing
asphalt concrete pavement, constructing concrete pavement, curbs,
gutters, sidewalks, x-gutters, driveway approaches,construc~ing
A.C. Dike, modification of Wier Box, adjusting existing sewer man-
holes, encasement of irrigation line, al I as shown on the plans.
Existing concrete pavement, asphalt concrete pavement, portions
of A.C. driveways are to be removed and disposed of; clearing and
grubbing is to be performed; embankment is to be constructed; concrete
pavement, curbs, gutters, sidewalks, x-gutters, driveways are to be
constructed; asphalt concrete pavement is to be placed; A.C. Dike is
to be constructed; Wier Box is to be modified; existing sewer manholes
are to be adjusted to grade; irrigation I ine is to be encased; the
roadway is to be finished; and such other items or details not mentioned
above which are required by the plans, the Standard Specifications or
these Special Provisions, are to be constructed or furnished and
instal led, all as shown on the plans, as specified herein and as
directed by the Engineer.

SECTION III
CONSTRUCTION DETAilS
3.0 I Concrete and Aspha I t Pavement Remova I sha II be perfor'med.
as shown on the plans in conformance with the Standard Specifica-
tions. Asphalt concrete removal shall include A.C. driveways.
Removed material shal I become the property of the contractor and
be disposed of outside the street right of way in accordance with
Sub-section 9.02 of the Standard Specifications. Saw cutting shall
be included in this payment item. Concrete and Asphalt pavement
removal shall be paid for at the lump sum price stated in the contract
and no additional compensation wil I be allowed therefor.
3.02 Earthwork -- Earthwork shal I conform to the prOVISions
of Section I I of the Standard Specifications except as modified by
these special provisions.
Surplus excavated material if any shall become the property of
the contractor and be disposed of outside the street right of way.
Payment for Roadway Excavation shall be on a lump sum basis
as provided in the contract which price shal I include ful I compen-
sation for furnishing all labor, materials, tools, equipment and
incidentals, and for doing all the work involved in excavating
loading, hauling, depositing, spreading and compacting excavated
material in place, including furnishing and applying water and dis-
posing of surplus materials, all as shown on the plans.
3.03 Imported Borrow -- Imported Borrow shall conform to
Section II, Chapter 3 of the Standard Specifications and shall have
a minimum sand equivalent value of 30.
Payment for Imported Borrow shal I be the contract price paid
per ton for Imported Borrow in place and shall also include furnish-
ing and applying water.
3.04 Concrete Pipe Encasement -- 12" of concrete encasement ,
is to be constructed on existing 16" concrete pressurized irrigation
line, al I as shown on the plans, as-directed by the Engineer and as
herein provided.

Concrete encasement shall conform to the p~ovlslons of Section
the Standard Specifications.

The lump sum price paid for concrete pipe encasement shall
include full compensation for furnishing al I labor, materials,
tools, and equipment and doing all the work involved in the con-
struction of the concrete pipe encasement, complete in place,
and no additional compensation wil I be allowed therefor.
3.05 Curbs, Gutters, Sidewalks, X-Gutters, Concrete Pavement,
Driveway Approachs -- This work shall conform to Section 18 of the
Standard Specifications.
Fu~ 1 compensation for excavation and backfil I required in con-
nection with curb and gutter, sidewalks, x-gutter, concrete pavement,
driveway approaches, and construction shal I be considered as included
in contract price paid per cubic yard for Portland cement concrete
(curbs, gutters, sidewalks, x-gutters, concrete pavement, driveway
approaches, and no additional compensation wil I be al lowed therefor.
3.06 Aggregate Base -- Aggregate base shall be Class 2 and
shall conform to the provisions in Section 14 of the Standard
Specifications and these special provisions.
The grading for the 3/4-inch maximum aggregate shall be used.
At the time aggregate base is spread it shall have a moisture
content sufficient to obtain the required compaction. Such moisture
shal I be uniformly distributed throughout the material.
Payment shal I conform to Section 14.06 of the Standard Specifi-
cations except that the contract price paid per ton for aggregate
base in place shal I also include furnishing and applying water.
3.07 Asphalt Concrete and Asphalt Concrete Dike -- Type "B"
asphalt concrete shall conform to the provisions of Section 150f the
Standard Specifications and these Special Provisions.
Paving asphalt to be mixed with the mineral aggregate shall
be steam-refined asphalt having a penetration of 60-70, 85-100,
120-150, or 200-300, the range of penetration to be designated by
the Engineer.
The placing of Asphalt Concrete Dikes as shown on the plans
shall be paid for at the contract price per ton for "Placing Asphalt
Concrete'~ .

A prime coat and/or paint binder shall be furnished and appl ied
as directed by the Engineer, and full compensation for furnishing
and applying this material shall be considered as included in the
prices paid per ton for asphalt concrete and no additional compen-
sation will be allowed therefor.
3.08 Finishing Roadway -- Finishing roadway shall conform to
Section 16 of the Standard Specifications.
Compensation for finishing roadway shall be considered as
included in the prices paid for the various contract items of work
and no additional compensation will be al lowed therefor.
3.09 Wier Box Modification -- Existing Wier Box to be modified,
all as shown on the plans, as directed by the Engineer.
The lump sum price paid for Wier Box Modificatlon shall include
full compensation for furnishing al I labor, materials, tools, and
equipment and doing all the work involved in the modification of the
Wier Box, complete in place, and no additional compensation will be
allowed therefor.
3.10 Adjust Existing Sewer Manholes

ments and agreements hereinafter mentioned, to be made and performed

party of the first part, at his own proper cost and expense to do
all the work and furnish all the materials, except such as are men-
tioned in the Special Provisions to be furnished by said party of
the first part, necessary to complete in good workman I ike and sub-
stantial manner the improvement of HILL DRIVE FROM SAN BERNARDINO
COUNTY FLOOD CONTROL DISTRICT CHANNEL TO MOUNTAIN DRIVE AND WEST
SIDE OF MOUNTAIN DRIVE FROM HILL DRIVE TO NORTHPARK BOULEVARD,
in strict conformity with Plans and Special Provisions No. 3662, on
file in the Office of the City Engineer, and also in accordance with
Standard Specifications No. 2271, City of San Bernardino, Department
of Engineering, revised October 1966, which said Plans, Special
Provisions and Standard Specifications are hereby specially referred
to and by such reference made a part hereof.
Article II - And the said contractor agrees to receive and
accept the following prices as ful I compensation for furnishing all
materials and doing all the work contemplated and embraced in this
.. agreement; also for all loss or damage arising out of the nature of
the work aforesaid, or from the acts of the elements, or from any
unforeseen difficulties or obstructions which may arise or be en-
countered in the prosecution of the work until its acceptance by the
City of San Bernardino and for all risks of every description con-
nected with the work; also for all expenses incurred by or in con-
sequence of the suspension or discontinuance of work, and for well
and faithfully completing the work, and the whole thereof, in the
manner and according to the Plans and Special Provisions, and re-
quirements of the Engineer under them, to-wit:
