RESOLUTION NO.
A RESOLUTION OF THE MAYOR AND C MMON COUNCIL OF THE CITY OF
SAN BERNARDINO AWARDING A CONTRACT TO KRUGER PAVING COMPANY, INC.
FOR THE IMPROVEMENT OF THE NORTHWEST CORNER OF HIGHLAND AVENUE AND
ORANGE STREET. IN ACCORDANCE WITH SPECIAL PROVISIONS NO. 3762.
RESOLVED. that the bid of KRUGER PAVING COMPANY, INC.
for the improvement of the northwest corner of Highland Avenue and
Orange Street, in accordance with Special provisions No. 3762, is
the lowest responsible bidder therefor, and that the same be and is
hereby awarded to KRUGER PAVING COMPANY, INC.
That the contract, a copy of which is attached hereto, marked
Exhibit "A" and referred to and made a part hereof as fully as
forth at length herein, be and the same is hereby

NOTICE INVITING BIDS
NOTICE IS HEREBY GIVEN that the City of San Bernardino will receive
bids or proposals for:
THE IMPROVEMENT OF THE NORTHWEST CORNER OF HIGHLAND AVENUE
AND ORANGE STREET, IN ACCORDANCE WITH SPECIAL PROVISIONS
NO. 3762, ON FILE IN THE ADMINISTRATIVE OFFICE, ROOM 211,
CITY HALL, SAN BERNARDINO, CALIFORNIA.
Deliver all bids to the Office of the City Administrator, Room 211,
City Hall, 426 W. 3rd Street, San Bernardino, California, with the
specification title and number clearly marked on the outside of the
envelope.
Said bids or proposals will be received up to the hour of 2:00 p.m.,
Tuesday, June 3, 1969 , at which time all of said bids or
proposals will be publicly opened, examined and declared in the
Council Chambers, Room 202, City Hall, 426 W. 3rd Street, San Bernar-
dino, California.
No bid will be received unless it is made on a proposal form furnished
by the city. All bids or proposals shall be signed, sealed and accom-
panied by.cash, cashier's check, certified check or bid bond made
payable to the City of San Bernardino, in the amount of ten per cent
(10%) of the bid. Such cash, check or bond shall be given as a
.guarantee that the bidder will enter into the contract if awarded
to him. In the event the bidder refuses to execute said contract,
the use by the public of the improvements will be delayed, and the
public will suffer great damage. From the nature of the case, it
would be extremely difficult and impractical to fix said amount of
damage. Therefore, the City and the bidder agree that the above sum
of 10% shall be paid to the City upon the condition above set forth
as liquidated damages and not as a forfeiture. All bonds furnished
pursuant to thic. notice must be underwritten by a surety company having.
. a rating in Best's most recent Insurance Guide of "A" or better.

Pursuant to law, the Mayor and Common Council of the City of San
Bernardino, by Resolution No. 5718 and any and all amendments thereto
which are hereby referred to and made a party hereof by reference as
fully as though set forth at lerigth herein, have ascertained and
determined the general prevailing rate of per diem wages, and of per
diem wages for legal holidays and overtime work for each craft or type
of workman needed in the execution of contracts under jurisdiction of
said Mayor and Common Council.
Said prevailing rates of wages shall conform to "Wage Scales for the
Six Basic Trades", filed in the Office of the City Clerk, and "Sub-

and amendments thereto.
It shall be mandatory upon ,the contractor to whom the contract is
awarded and upon any sub-contractor under him, to pay not less
than said specified rates to all laborers, workmen, and mechanics
employed by them in the execution of the contract, and to prevent
discrimination in the employment of persons because of race, creed,
color or national origin, as set forth in the provisions of
Resolution No. 7414 of the Mayor and Common Council of the City
of San Bernardino.
No bid will be accepted from a contractor who is not licensed in
accordance with the provisions of Chapter 9, Division III of the
Business and professional Code.
The City of San Bernardino reserves the right to reject any and
all bids.
Plans and specifications may be obtained from the Office of the
City Administrator, Room 211, City Hall, 426 W. 3rd Street,
San Bernardino, California, upon a non-refundable payment of
$5.00 for each set.

SPECIAL PROVISIONS
SECTION I
GENERAL
1.01 General -- The work embodied herein shal I be done in
accordance with the Standard Specifications No. 2271, revised October
1966, of the City of San Bernardino, Department of Engineering, insofar
as the same may apply, and as modified and in accordance with the
following special provisions.
1.02 Place of Production/Manufacture -- In the performance of
this contract, Contractor agrees to use or supply only such unmanu-
factured materials, articles and suppl ies as have been produced in
the United States, and only such manufactured materials, articles
and supplies as have been manufactured in the United States substan-
tially all from mater'ials produced in the United States, unless ex-
empted from this requirement by Article I, Chapter 4, Division 5,
Title I of the Government Code of California or by treaties or general
tra'de agreements of the Un i ted States.
1.03 Conflicts -- In case of conflict between the Standard
Specifications and these special provisions, the special provisions
shall take precedence over and be used in lieu of such conflicting
portions. .
SECT! ON II
DESCRIPTION OF WORK
2.01 General -- The work to be done consists, in general, of
clearing and grubbing; removal of chain link fence, miscellaneous
signs, PCC flume and asphalt concrete; performing earthwork; placing
asphalt concrete over aggregate base; construction concrete curbs,
gutters, apron, sidewalk and driveways; installing drain pipe and
guide markers; all as shown on the plans.

posed of; a chain link fence is to be removed; embankment is to be
constructed; asphalt concrete is to be placed; concrete curbs,
gutters, apron, sidewalk and driveways are to be constructed; a drain
pipe is to be installed; the roadway is to be finished; and such other
items or details not mentioned above which are required by the plans,

the Standard Specifications or these Special Provisions are to be
constructed or furnished and installed, al I as shown on the plans,
as specified herein and as directed by the Engineer.
2.02 Maintaining Traffic -- Traffic shal I be allowed to pass
through the construction are~ at all times.
The Contractor shal I furni~~ and install signs, flasher, barri~
cades, guards, temporary sidewalks and bridges, flagmen, and al I
other necessary safety devices as conditions require to properly safe-
guard I ife and pro~erty. .
If the City replaces, adds to or erects said safety devices when
the Contractor fails to do so, the Contractor shal I be billed for alt'
costs thereof including a daily rental. Said costs shal I be deducted
from the final payment. The contractor shall provide additional
safety devices of his own to take care of the conditions previously
ment i oned,at the ear I i est poss i b I e time, and sha II . not not i fy the
Engineer of the fact that he has done so, and shall return forthwith
the City's safety devices as directed. The City assumes no responsi-
bility and the Contractor is relieved of no responsibility by the
pr';visions of this paragraph.
All signs shall be provided in accordance with the standards
established by the State Division of Highways (State Uniform Sign
Chart). Any special signs must be approved by the City Traffic
Engineer.
Access shall be maintained to adjacent property at all times.
Hydrants under pressure, valve pipe covers, valve boxes, fire or
police call boxes, or other utility controls shall be left unob-
structed and accessible during construction.
The Cont~actor shall provide the City Traffic Engineer and the
City Police Department with the name, address, and telephone number
of the person or persons who will be available at all times to per-
form such work as deemed necessary by the Engineer to properly safe-
guard I ife and property.
Payment for this item of work shall be included in the various
other items of work and no separate payment will be made therefor.

SECTION I II
CONSTRUCTION DETAILS
3.01 Obstructions -- Existing facil ities such as traffic and
warning signs and fences within the road right of way shall be
removed or relocated as directed by the Engineer. An end post
and braces shall be instal led on existing chain link fence at
locations shown on the plan. Installation shall match existing
construction. Plugging of existing pipe as shown on the plan shall
be a PCC plug 8" thick. .
Payment for this work shall be considered as included in the
various other items of the work and no additional compensation
shall be allowed therefor.
3.02 Concrete and Asphalt Removal shal I be performed as shown
on the plans in conformance with the Standard Specification. Removed
material shall become the property of the contractor and be disposed
of outside the street right of way in accordance with Subsection 9.02
of the Standard Specifications. Concrete and Asphalt removal shall
be paid for at the lump sum price stated in the contract.
3.03 Earthwork -- Earthwork shal I conform to the provisions of
Section I I of the Standard Specifications except as modified by these
special provisions.
Surplus excavated material if any shall become the property of
the contractor and be disposed of outside the street right of way.
Import material if necessary shal I be furnished and installed
by the Contractor.
Payment for Roadway Excavation shall be on a lump sum basis as
provided in the contract which price shall include full compen-
sation for furnishing al I labor, materials, tools, equipment and
incidentals, and for doing al I the work involved in excavating,
loading, hauling, depositing, spreading and compacting excavated
material in place, including furnishing and applying water and dis-
posing of surplus materials, including furnishing import material,
all as shown on the plans.
3.04 Aggregate Base -- Aggregate ~ase shall be broken stone~
crushed gravel, ........ complying with ~he Standard Specifications.

3.05 Asphalt Concrete -~ Type "8" asphalt concrete shal I
conform to the provisions of Section 15 of the Standard Specifica-
tions and these Special Provisions.
Paving asphalt to be mixed with the mineral aggregate shall be
steam-refined asphalt having a penetration of 60-70, 85-100, 120-150,
or 200-300, the range of penetration to be designated by the Engineer.
A prime coat and/or paint binder shal I be furnished and qpplied
as directed by the Engineer, and full compensation for furnishing
and applying this material shall be considered as included in the
prices paid per ton for asphalt concrae and no additional compensa-
tion will be allowed therefor.
3.06 Finishing Roadway -- Finishing roadway shall conform to
Section 16 of the Standard Specifications.
Compensation for finishing roadway shall be considered as in-
cluded in the prices paid for the various contract items of work
and no additional compensation will be allowed therefor.
3.07 Curbs, Gutters, Aprons, Sidewalks, Driveway Appraches
This work shall conform to Section 18 of the Standard Specifica-
tions. Curb cut opening for driveways ahal I be provided as directed
in the field. .
Full compensation for excavation and backfill required in con-
nection with curb and gutter, driveway approaches, and driveways
. construction shall be considered as included in contract price paid
per cubic yard for Portland cement concrete and no additional compen-
sation will be allowed therefor.
3.08 Guide Markers -- Metal guide markers shall be furnished
and installed and shall conform to State of California, Division of
Highways Drawing A74-9.

Article I - Witnesseth, That for and in consideration of pay-
ments and agreements hereinafter mentioned, to be made and performed
by the said party of the first part, and under the conditions ex-
pressed in the two bonds, bearing even date with these presents, and
hereunto annexed, said party of the second part agrees with the said
party of the first part, at his own proper cost and expense to do all
the work and furnish all the materials, except such as are mentioned
in the Special Provisions to be furnished by said party of the first
part, necessary to complete in good workmanlike and substantial manner
the improvement of the NORTHWEST CORNER OF HIGHLAND AVENUE AND ORANGE
STREET, in strict conformity with the Plans and Special Provisions
No. 3762, on file in the Office of the City Engineer, and also in
accordance with Standard Specifications No. 2271, City- of San Bernar-
dino, Department of Engineering, revised October 1966, which said
Plans, Special Provisions and Standard Specifications are hereby
specially referred to and by such reference made a part hereof.
Article II - And the said contractor agrees to receive and
accept the following prices as full compensation for furnishing all
materials and doing all the work contemplated and embraced in this
agreement; also for all loss or damage arising out of the nature of
the work aforesaid, or from the acts of the elements, or from any
unforeseen difficulties or obstructions which may arise or be en-
countered in the prosecution of the work until its acceptance by the
City of San Bernardino and for all risks of every description con-
nected with the work; also for all expenses incurred by or in con-
sequence of the suspension or ~iscontinuance of work, and for well
and faithfully completing the work, and the whole thereof, in the
manner and according to the Plans and SpeciaL Provisions, and
requirements of the Engineer under them, :to-wit:
