Aml COMMON COUNCIL OF THE CITY OF SAN BERNAllDINO, AUTHORIZING THE CHAIllMAN
OF PUBLIC BUILDINGS OF THE CITY OF SAN BERHAllDINO TO RENT THE MUNICIPAL
AUDITORIUM. FIXING THE RENTALS THEREFOR, AND MAKING REGULATIONS THEREFOR".
WHEREAS, the Mayor and Common Council on the 14th day of January, 1924,
passed and adopted Resolution entitled, "A Resolution of the Mayor and Common
Council of the City of San Bernardino, Authorizing the Chairmen of Public
Buildings of the City of San Bernardino to Rent the Municipal Auditorium,
Fixing the Rentals Therefor, and Making Regulations Therefor".
THEREFORE, BE IT RESOLVED, by sa,id Mayor and Common Council that said
Resolution shall be and hereby is amended to read as follows:
The Mayor and Common Council of the City of San Bernardino do ordain
as follows:
SECTION ONE: That that certain building constructed within Pioneer
Park, in the City of San Bernardino, and fronting on Sixth Street, between
"E" Street and "F" Street, shall be known as the Municipal Auditorium, and
used for purposes of public meetings and conventions, a social center, and
for public and private entertainments.
SECTION TWO: That the primary purpose of said building is governmental,
and that all other uses shall be subservient to its governmental use.
SECTION THREE: That to enable the Chairman of Public Buildings to more
effectually perform said duties, the Chairman of Public Buildings is hereby
authorized and empowered to lease the said Municipal Auditorium from time to
time for public or qua,si public purposes, and for charitable, entertainment,
amusement and educational purposes, for rentals hereinafter fixed and es-
tablished; provided, however, that if the applicant seeks to secure the use
of said Municioal Auditorium for other than the full rental price, the
Chairman of Public Buildings must obtain the permission of the Mayor and
Common Council of said City before letting the SRme.

The following schedule of prices to be paid for the use of said
Municipal Auditorium is hereby fixed:
For attractions under the direct authority of the Board of Education
for the benefit of said school department, where admission is charged; day,
$25.00; night, $35.00;
For all matters of a civic chara.cter open to the general public without
charge; day, $15.00; night, $25.00;
However, in any case where application is made to the Mayor and Common
Council of said City for the use of the Municipal Auditorium by a patriotic
organization recognized as such, or for a purpose which shall, in the judg-
ment of said Mayor and Common Council, be especially calculated to foster
or instill in the persons attending the gathering so held, a sense of pat-
riotism, then the Mayor and Common Council of said City may permit such meeting
to be held without charge;
For concerts where admission is charged: day, $35.00; night, $50.00;
For lectures where admission is charged: day, $35.00; night, $50.00;
For lectures where no admission or collection is charged: day, $25.00;
night, $35.00;
For professional theatrical attractions; day, $50.00; night, $100.00;
For amateur theatrical attractions, depending on the number of re-
hearsals: day, $25.00; and $35.00; night, $50.00 and $75.00;
For exhibition or moving pictures, purely educational only, where no
admission is charged: day, $15.00; night, $35.00; if admission i. charged:
day, $25.00; night, $50.00;
For dances and balls where admission is charged: day, $35.00; night,
$50.00;
For dances and balls where no admission is charged: day, $35.00; night,
$50.00;
For charity fUnctions. such as bazaars, socials, and other enterprises
held under the auspices of a.bona fide church or local organization, where
the admission charged or collection taken is to be disbursed for charitable
purposes: day, $25.00; night, $35.00;

For fraternal organizations and clubs, for receptions, rituals or degree
work, and occasions of like character where no admission is charged: day,
$50.00; night, $50.00;
For dog, paultry and pet stock shows: day, $75.00; night $100.00;
For society circuses and athletic events: day, $100.00; night, $150.00;
For expositions and exhibitions for the display of manufactured and
soil products: day, $100.00; night, $125.00;
For benefits of national or local use when the total proceeds of such
are used for that purpose: no charge;
For union church services: no charge;
For patriotic assembleges on national holidays: no charge;
For conventions, state or national: no charge;
For High School Baccalaureate sermons: no charge;
For High Schoo~ Commencement Exerciees: no charge;
For entertainments sponsored by local railway company: day, $15.00;
night, $25.00;
For church banquets: day, $15.00; night, $25.00;
For any political meeting to be held in the interests of any candidate
or candidates for public office, or to advance to interests of any political
party or faction: day, $25.00; night $50.00;
In all cases wherein the night charge for rental is $50.00, in case said
Auditorium is vacated before 10 o'clock p.m. the rent shall be $35.00 per night.
The Mayor and Common Council of the City of San Bernardino may, in any
case, use the Municipal Auditorium for purposes deemed by it to be governmental
in purpose.
For any meeting strictly governmental in purpose and so denominated by
the Mayor and Common Council of said City, no charge shall be imposed.
SECTION FOUR: All sums collected for the operation of the said Muni-
cipal Auditorium shall be deposited with the City Treasurer of the City of
San Bernardino.
SECTION 4!: No engagements of said Municipal Auditorium shall be made
for private enterprises more than sixty (60) days in advance of the date to
be used.

SECTION FIVE: Additional charges shall be made for excess lighting and
for janitor work in excess of the usual hours.
In all cases an extra charge of $3.00 shall be made for services of an
electrician when required to operate a switch board: provided that if such
electrician is required to handle a spot-light, the additional charge shall
be $4.00.
SECTION SIX: An additional charge of $15.00 shall be made for the use
of the kitchen and equipment.
SECTION SEVEN: Rates for events not covered by the above schedule shall
be fixed by the Chairman of Public Buildings.
SECTION EIGHT: It is further provided that in any case, where for the
purpose of theatrical performances, concerts and like entertainments under
private management, application for the use of the Municipal Auditorium
upon a percentage basis is made, then the Chairman of Public Buildings,
in his discretion, may permit the Auditorium to be so used upon the payment
of a minimum guaranty sum of $40.00 and twenty-five per cent of the gross
receipts collected from the sale of tickets for said entertainment.
For the purpose of the schedule hereinbefore outlined, the charge
imposed for day events is for that period of any day commencing not earlier
than twelve o'clock noon, and ending not later than six o'clock P.M. of the
same day. For night events, the same shall commence not earlier than seven
o'clock P.M. of any day, and end not later than twelve o'clock midnight of
the same day.
SECTION NINE: The City reserves the right to refuse to rent the Audi-
torium or any part thereof, to any person or association. Determination of
the character of the use for the purpose of fixing the charge to be imposed
for the Auditorium is vested solely in the Chairman of Public Buildings.
Any person desiring to appeal from the decision of"'said Chairman of Public
Buildings in matters pertaining to above, may appeal to the Mayor and
Common Council of said City, and said decision of the Mayor and Common
Council shall be final.

SECTION TEN: In every contract or agreement relating to the use of
the Auditorium by others than the City directly, such contract shall make
this R~solution and every part thereof, a portion of said contract by re-
ference. In every such case, the City shall have, and does hereby retain,
full and complete control of said Auditorium building, approaches, appur-
tenances and fixtures, and may, under supervision of Chairman of Public
Buildings, take such precaution and perform such acts as may be necessary
in any case to protect the said City.
SECTION ELEVEN: The Mayor and Common Council hereby reserves the right
to forbid the use of the Auditorium for any performance or purposes, which,
in the opinion of said Mayor and Common Council, would be likely to be harm-
ful, immoral or otherwise improper, and to prohibit and terminate any im-
moral or harmful performance or exhibition.
SECTION TWELVE: All moneys resulting from the operation of the Audi-
torium shall be and are hereby declared to be properly a portion of the
public funds of the City of San Bernardino. All expenses for the operation
of the Auditorium, including lighting, heating, fire insurance, janitor service,
repairs, workmen's compensation insurance, etc., and all other incidentals
shall be charged to said fund.
All sums collected for the operation of the Auditorium shall be de-
posited in said fund.
SECTION THIRTEEN: The Chairman of Public Buildings shall, from time
to time, establish and enforce such general and special rules and regulations
as may be determined to be necessary for the proper conduct of the Auditorium,
in addition to those now established by the Mayor and Common Council of said
City.
SECTION FOURTEEN: All applications for the use of the Municipal
Auditorium shall be made directly to the Chairman of Public Buildings, who
shall determine the classification under which the use applied shall be
placed. In every case, application shall be in writing, signed by the
person, association or corporation to be charged with responsibility there-
under, and filed with the Chairman of Public Buildings.

The Chairman of Public Buildings may, in any ease, require the deposit
of the whole or any portion of the charge intended to be imposed upon the
application.
SECTION FIFTEEN: This Resolution shall be in force and shall take
effect from and after its passage and approval.
The City Clerk shall certify to the passage of this Resolution.
I HEREBY CERTIFY that the foregoing Resolution wes duly approved by
the Mayor and Common Council of the City of San Bernardino, at a regular
meeting thereof, held on the 18th day of July, 1927, by the following vote,
to-wit:
