U / l/ RESOLUTION Of THE CITY OF SANIBlMARDINO AUTHORIZING A FEE SCHEDULE FOR ~ USE OF PUBLIC ~klATION BUILDINGS, AND SWIMMING POOLS FOR A PERIOD OF ONE (1) YEAR. 2 3 4 BE IT RESOLVEDiBY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS tOLLOWS: 5 6 7 8 9 SECTION 1. pursuant to City Ordinance No. 3326, Section 9, a fee schedule for the use of public and recreation buildings and swimming pools is hereby established for a period of one year commencing with the date of adoption of this resolution and terminating one year thereafter. 11 SECTION 2. Policy: Public parks and recreation buildings 12 and swimming pools, under the jurisdiction of the Park and 13 Recreation Department are public property and as such are avail- 14 able for use by any person or persons in accordance with the 15 following specifications and as deemed appropriate by the Director. 16 SECTION 3. Procedure: The facilities and equipment shall 17 be used only for those meetings and activities pursuant to City 18 Ordinance No. 3326. Any person, persons, or groups of persons 19 desiring the use of any facilities or equipment shall make 20 application on forms provided by the Park and Recreation Depart- 21 ment and shall provide such additional infor~tion as may be 22 required to assure compliance with City Ordinance No. 3326. 23 SECTION 4. Cancellations: Cancellations of meetings and 24 activities may occur twenty-four (24) hours priDr to scheduled 25 use of facilities or equipment without forfeiting any fees and/or 26 deposits collected by the Department. In the event of cancella- 27 tion by the Department, notice will be given as far in advance 28 of the scheduled use as is possible under the circumstances. . ." . . I I I I 1 ! SECTION 5. Priority of Use: The priorities of use shall 2 be in the fOllowing order: 3 4 i (a) Park and Recreation Department sponsored activities. I I (b) Park and Recreation Department co-sponsored activities II I and tax-supported groups. I ~) Civic and social groups (resident or non-profit) . I (d) Civic and social groups (non-resident or commercial). 5 6 7 8 SECTION 6. Classification of Groups and Fee structure: 9 For the purpose of assessing fees, all individuals or groups 10 shall be classified pursuant to the herein listed classifications: 11 (a) Department sponsored groups and/or activities are 12 those groups and activities organized and conducted by the Park 13 and Recreation Department. Groups or activities under this 14 classification shall pay no fee for the use of facilities. 15 (Examples: girls and women's softball, teen splash nites, 16 dances, youth clubs, senior citizens, slim and trim, etc.) 17 (b) Departmental co-sponsored groups and activities are 18 19 those community groups and activities self governed, privately organized and of a recreational nature which may be brought under the sponsorship of the Park and Recreation Department; e.g., tap and ballet, guitar lessons, singing sixties, etc.; and..tax.$upporte groups and activities are those organized and conducted by the school district and governmental agencies; e.g., adult education, lip reading, County Agricultural Extension Service, etc. Groups 20 21 22 23 24 25 in this classification shall pay no fee. (c) Civic and social groups which are non-profit ~~9aniza 26 27 tions or corporations and can clearly demonstrate their non-profi 28 status and whose membership is made up of at least fifty-one -2- 10 22 24 27 28 f! " .' , ,I 'I I, 1 ii 'I percent (Sl%) of City residents shall pay a fee equal to fifty percent (50%) of the stated rate. (Examples: Women's Club, 2 3 Navy Mothers, Friendship Club, Lens & Shutter Club, Chess Club, 4 5 6 7 AARP, YWCA, YMCA, etc.) (d) Civic and social groups which are commercial in nature and do not have non-profit corporation or organization status or have a membership of less than fifty-one percent (Sl%) 8 of City residents, shall be assessed fees equal to one-hundred 9 percent (100%) of the rate. (e) Rates and fees determined in accordance with (a), (b), 11 (c) and (d) hereinabove shall include all charges including those 12 made for additional personnel costs provided for herein. Refundal:>le Depo'sit: Refundable deposits held pursuant to this resolution may be refunded in full or in part Within fourteen (14) days after completion of the use period. No refund shall be made until the using party or group has secured a signed building inspection and release form from the appropriate facility manager, and delivered this executed release form to the Park and Recreation Department. Deductions for any damages to the facility or for clean up and repairs shall be made from the said deposit by City. SECTION 8. Utilization of City Employe'as. During any event when a City employee or employees are required to be present for ,the purposes of cleanup, monitoring, etc., a fee shall be paid equivalent to the total cost of said employees.
