HomeMy WebLinkAbout13167 '. . ' 1 2 3 4 RESOLUTION NO. /..5.I? 7 A RESOLUTION OF UlE MAYOR AND ClHIDN COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING UlE ANNExATION OF DISTRICT NO. 308 (LAFC 1734). WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 9, 10 11 12 WHEREAS, on the 12th day of December, 1977, a resolution was adopted by the aforesaid Common Council of the City of San Bernardino, California, declaring that proceedings had been initiated by said Council, and proposing the annexation, for the reasons therein stated, of the aforementioned uninhabited territory to the City of San Bernardino, and that said resolution 13 provided that the proposed annexation should be generally known and identified 14 as Annexation District No. 308; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all general 18 indebtedness and liability of the City of San Bernardino contracted prior to 19 or existing or outstanding at the time of the aforesaid proposed annexation 20 of the aforesaid property as provided in the hereinbefore mentioned Government 21 Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 6th day of Fe~ruary, 1978, at the hour of 2:00 o'clock 24 p.m., in the Council Chambers of the City Hall, 300 North "D" Street, San 25 Bernardino, California, and the same was the day, hour and place designated 26 where any person owning real estate within such territory so proposed to be 27' annexed and having any objections to the proposed annexation, might object 28 before the Common Council and show cause why such territory should not be . ; , 1 annexed; furthermore, the said resolution provided that at any time not later 2 than the said hour set, as mentioned hereinbefore for the said hearing, any 3 owner of property within the said territory proposed to be annexed might file 4 written protest with the City of San Bernardino against such annexation; and 5 WHEREAS, there were no written protests filed with the City Clerk 6 of the City of San Bernardino prior to 2:00 o'clock p.m. on February 6, 1978; 7 and thereafter, on the 6th day of February, 1978, Resolution No. 8 was adopted by the Mayor and Common Council declaring that a majority protest 13160 9. has not been presented; and 10 WHEREAS, it appears to the Common Council of the City of San 11 Bernardino that the aforesaid annexation proceedings ha~e been completed and 12 everything performed at this time in accordance with said Government Code, 13 conditions of LAFC Resolution No. 1331, adopted October 19, 1977, and any and 14 all other laws in any way connected with the said annexation procedure; and 15 WHEREAS, the Common Council of the City of San Bernardino desires to 16 approve at this time the annexation of the aforesaid territory. 17 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 18 BERNARDINO DO ORDAIN AS FOLLOWS: 19 SECTION ONE: That said territory herein described as Annexation 20 District No. 308 is hereby annexed and incorporated in and made a part of the 21 City of San Bernardino. 22 SECTION TWO: The territory herein referred to as being annexed to the City of San Bernardino is particularly described as follows; to wit: 23 24 2S 26 27 28 That portion of the West one-half of the Northeast one-quarter of Section 32, Township 1 North, Range 3 West, San Bernardino Base and Meridian, according to the Government Survey thereof; all of Block "A" of the York Place Subdivision as per plat thereof recorded in Book 18 of Maps, page 40, records of the County Recorder, County of San Bernardino, State of California, and those portions of the adjOining streets, described as follows: - 2 - ". ~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Beginning at a point on the present Corporate Limits of the City of San Bernardino, said point being the intersection of the center lines of Atlantic Avenue and Orange Street; thence North along said City Limit Line and the centerline of said Orange Street, a distance of 670 feet more or less to its inter- section with the centerline of Love Lane (20.00 feet wide); thence leaving said City Limit Line, West along said centerline of Love Lane, a distance of 660 feet more or less to its inter- section with the East line of the Southwest one-quarter of the Northwest one-quarter of the Northeast one-quarter of said Section 32, said point also being the present Corporate Limits of said City; thence South along said East line and said City Limit Line, a distance of 670 feet more or less to an angle point in said City Limit Line; thence West along said City Limit Line, a distance of 150 feet more or less to an angle point therein said point also being the Southwesterly line of the A.T. & S.F. Railroad right-of-way; thence Southeasterly along said City Limit Line and said Southwesterly Railroad right-of-way line, a distance of 342 feet more or less to its intersection with the Westerly prolongation of the South line of Parcel "A" as conveyed to the State of California in Document No. 246, recorded March 17, 1964, in Book 6109, page 492, Official Records of said County Recorder; thence leaving said City Limit Line along said Westerly prolongation and said South line a distance of 557 feet more or less to its intersection with the centerline of said Orange Street; thence North along said centerline, a distance of 237 feet more or less to its intersection with the centerline of Atlantic Avenue and the Point of Beginning. (Containing approximately 14.10 acres) SECTION THREE: That the above described property will be subject to taxation equally with the property within such municipal corporation to pay its proportion of the following bonded indebtedness of the City of San Bernardino, which said bonded indebtedness was outstanding or theretofore authorized and is outstanding at the time of said annexation, to wit: A bonded indebtedness of $490,000.00 incurred for the acquisition and construction of a public library, including additions to and enlargements of the public library system of said City, the outstanding indebtedness thereon being $30,000, bearing interest at the rates of 4-3/4%, 3-1/4%, and 3-1/2% per annum; A bonded indebtedness of $1,116,000.00 incurred for the acquisition and construction of additions to, relocations of and replacements of the fire - 3 - . ..
