BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said City a First Amendment to Agreement with the San Bernardino Economic Development dbuncil providing additional funding and extending said Agreement to June 30, 1978, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. FIRST AMENDMENT TO AGREEMENT (Funding Economic Development Council) THIS FIRST AMENDMENT TO AGREEMENT is made and entered into this .A' /.2/ CITY OF SAN day of Y/h,///}:! BERNARDINO, a municipal , 1978, by and between the corporation, hereinafter calle "City", and the SAN BERNARDINO ECONOMIC DEVELOPMENT COUNCIL, a non-profit corporation, hereinafter called "EDC". WIT N E SSE T H : WHEREAS, City has previously granted funding to EDC in the amount of seventy-six thousand nine hundred seventy dollars ($76,970.00) from City's Public Works Employment Act funds for a period ending February 15, 1978, pursuant to a written agreement dated April 22, 1977; and WHEREAS, EDC desires that City grant additional funding to EDC in the amount of five thousand dollars ($5,000.00) from City funds, the source thereof to be determined by City, for an additional period ending June 30, 1978, and City desires to grant said funds to EDC as aforesaid. NOW, THEREFORE, it is mutually agreed between the parties hereto as follows: 1. Section 3 of that agreement between the parties hereto dated April 22, 1977, is hereby amended to read as follows: "3. Payments and Term. City shall pay to EDC from said Public Works Employment Act funds during the term hereof funds up to a maximum of seventy-six thousand nine hundred seventy dollars ($76,970.00), payable in twelve equal monthly installments of six thousand four hundred fourteen dollars and sixteen cents ($6,414.16) commencing on the 15th day of February, 1977, and ~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 continuing thereafter on or before the 15th day of each succeed- ing month. In addition, City shall pay to EDC from additional sources to be determined by City in its sole discretion, an additional sum of five thousand dollars ($5,000.00) in four (4) equal monthly installments of one thousand two hundred and fifty dollars ($1,250.00) commencing on the 15th day of March, 1978, and con- tinuing thereafter on or before the 15th day of each succeeding month. This agreement shall terminate on June 30, 1978. The funds paid to EDC shall be used by it solely for the purposes set forth in this agreement during the term hereof in accordance with Exhibit "B", attached hereto and incorporated herein by reference. A ten percent (10%) or less transfer of funds shall be allowed on any budget line item, providad the prior approval of the City Administrator is first had and obtained. At the end of said term, all unexpended grant funds sha 1 be returned to the City by EDC. Prior to the final payment under this agreement, and at such other times as may be requested by the City Administrator or Director of Finance of City, EDC shall submit to the City Adminis- trator, with a copy to the Director of Finance, an accounting of the proposed and actual expenditures of said funds, including the line item amounts and purposes for which said funds have been spent or obligated. Fiscal books and records in a form satisfactory to City's Finance Director shall be maintained by EDC in such a manner as to permit the City to readily trace the expenditures of the funds provided by City hereunder. All accounting reports required hereunder shall be submitted by EDC in conformity with established City guidelines and audit guides." 2. All other terms, conditions and covenants of said agreement shall remain the same and be in full force and effect.
