RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
SALE OF SIX PARCE:LS OF REAL PROPERTY SITUAT!:D AT 460 MT. VIEW
AVENUE, 444 MT. VIEW AVENUE, 234 AND :l36 FOURTH STREET, AND AT
'I'HE NORTHWEST CORNER OF FOURTH STREET AND MT. VIEW AVENUE IN THE
CITY OF SAN BERNARDI~O, SAID PARCELS OF REAL PROPERTY BEING
LOCA'tSD IN THE CENTRAL CITY EAST REDEVELOPMENT PROJECT AREA,
TO TtfE CITY OF SAN BERNARDINO BY THE REDEVELOPMENT AGENCY OF
THE CITY OF SAN BERNARDINO (HEALTH AND SAFETY CODE SECTION 33433).

WHEREAS, the Redevelopment Agency of the City of San

Bernardino is the owner of certain parcels of real property
11
situated in the Central City East Redevelopment Project Area, and
said parcels of real property are more particularly described in
Exhibit "A" attached hereto and incorporated by reference herein
12
as fully as though set forth in full and at length; and
13
WHEREAS, said parcels of real property were purchased on
14
the dates and for the purchase prices as follows:

The total cost of said parcels of property was four hundred

forty-four thousand five hundred dollars ($444,500.00), the fair
23
market value of the aforesaid parcels of real property for the
highest and best use consistent with the Redevelopment Plan; and
WHEREAS, the current fair market value of said lots and
24

parcels of real property for the highest and best use consistent
27
with the Redevelopment Plan has been determined by appraisal to
28
be the sum of four hundred ninety-one thousand five hundred dollars

($491,500.00); and
WHEREAS, the Redevelopment Agency of the City of San
Bernardino proposes to sell said parcels of real property to the
City of San Bernardino, a municipal corporation, for the sum of
three hundred thousand dollars ($300,000.00) cash; and
WHEREAS, said selling price is less than the estimated
fair market value of the real property being sold; and
WHEREAS, said three hundred thousand dollars ($300,000.00)
selling price for said parcels is necessary to effectuate the
purposes of the Redevelopment Plan in that the City of San
Bernardino contemplates using said lots and parcels of real
property for civic and public purposes pursuant to a Joint Powers
Agreement dated April 27, 1970, wherein it is agreed to develop
said area as a County Government Center; and
WHEREAS, said County Government Center will provide direct
benefit to the Central City East Redevelopment Project Area; and
WHEREAS, the City and/or the County of San Bernardino will
develop said parcels of real property in accordance with a plan
and concept initiated pursuant to the Joint Powers Agreement
dated April 27, 1970, entered into between the City, the County,
and the Redevelopment Agency; and
WHEREAS, the City of San Bernardino does not have adequate
funds available in which to pay the Redevelopment Agency for the
fair market value of these parcels of real property determined
at the highest and best use consistent with the Redevelopment
Plan; and
WHEREAS, notice of the time and place of hearing has been
given as required by law; and

1 WHEREAS, the Redevelopment Agency has made available for
2 public inspection and copying all of the information required by
3 law; and
4 WHEREAS, all hearings have been held as required by Health
5 and Safety Code Section 33433,
6 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY
7 OF SAN BERNARDINO do hereby find and declare that the sale is for
8 less than the estimated fair market value of the parcels of real
9 property being sold determined at the highest use permitted under
10 the Central City East Redevelopment Project Area Redevelopment
11 Plan, and that such lesser consideration is necessary to effec-
12 tuate the purposes of said plan for the following reasons:

1. The Redevelopment Plan for the Central City East
14 Redevelopment Project Area provides, allows and determines uses
15 !, for civic and public purposes. On November 19, 1969, the City
16
!Administrator of the City of San Bernardino prepared a Joint
17
iPowers Agreement concept for a Civic Center Complex.
18
On April 27, 1970, pursuant to said concept, a Joint i
Powers Agreement was entered into between the said Redevelopment I
Agency, the City of San Bernardino and the County of San Bernardint

providing for the joint exercise of powers of these public '

entities for the development within the City of San Bernardino
'of the area bounded on the south by Third Street; on the north
I

Iby Fifth Street; on the east by Sierra Way; and on the west
I
'I! by Arrowhead Avenue; hereinafter called the "County Government
I Center", which area is delineated on an exhibit attached to

: Pursuant to the Joint Powers Agreement, the Agency has

developed a plan and program consistent with the Agreement for
the development and implementation of the said concept.

The City, by Resolution No. 11834, has formally "approved
4
the overall concept", and indicated therein that it is "prepared
5
6
to proceed with the implementation of the plan of development of
the City-County-State-Federal civic Center Complex".

The County has also indicated its willingness to proceed
with the implementation of the plan of development of the complex.

These parcels of property were originally purchased by
the Agency for the purpose of exchanging or leasing said property
to the County of San Bernardino for a County Government Center.
On November 8, 1976, the City of San Bernardino, the County
of San Bernardino and the Redevelopment Agency of the City of San
Bernardino entered into a City/County/Agency Land Exchange Agree-
ment for the County Government Center, by the terms of which the
three entities agreed to exchange and/or lease to each other the
parcels of land set forth and identified in the exhibits attached
to said land exchange agreement.

2. The City does not have sufficient funds to pay the
fair market value of these parcels of property determined at the
highest and best use consistent with the redevelopment plan, and
if the plan is to be effectuated at all by the development of
these parcels of property into a County Government Center and
Super-Block, the only way that it can be done is by the Agency
selling this property for the sum of three hundred thousand
dollars ($300,000.00) for the public purpose indicated.
If the Agency does not sell this property to the City
for the sum of three hundred thousand dollars ($300,000)

1 which may be less than the fair market value, the County Govern-
2 ment Center and Super-Block will not be able to be completed and
3 the redevelopment plan for this project area cannot be
4 effectuated.

3. The parcels of real property involved have been owned
by the Agency since the dates of purchase and have been held for
the development of a County-City Government Complex.

There is no claim for a finder's fee provided for by

! established Agency policy for the proposed development.

5. All of the recitals set forth hereinabove are
11 incorporated herein by reference.

6. Should the Redevelopment Agency not sell the parcels
of real property as proposed herein, the Redevelopment Plan for

this project area could not be effectuated.

BE IT FURTHER RESOLVED that the Mayor and Common Council
16
of the City of San Bernardino hereby approve the sale of said
17
parcels of real property upon the terms, conditions, and for
18
the reasons herein set forth.
