HomeMy WebLinkAbout13118 10 11 12 13 15 20 21 1 RESOLUTION NO. /3/ / f 2 RESOLUTION OF THE CITY OF SAN BERNARDINO GIVING NOTICE INVITING COMPETITIVE BIDS FOR THE SALE, LEASE, OR LEASE WITH AN 3 OPTION TO PURC!lASE, OF CERTAIN REAL PROPERTY OWNED BY SAID CITY, j GENERALLY LOCATED AT THE SOUTHWEST CORNER OF HOME AVENUE AND 4 MUSCOTT STREET IN SAID CITY, ESTABLISHING A MINIMUM SALE-PRICE FOR SAID PROPERTY, OR, IN THE ALTERNM'IVE, MINIMUM LeASE PRO- 5 VISIONS SUCH AS PAYMENTS, TERM, ETC.; AND REPEALING RESOLUTION NO. 13083. 6 7 WHEREAS, the City of San Bernardino, a municipal corpora- 8 9 tion, is the owner of the hereinafter described parcel of real property situated in the City of San Bernardino, State of California; and WHEREAS, the Mayor and Common Council of the City of San Bernardino find and determine that the~e is no further need or necessity for the use of said real property; and 14 WHEREAS, the Mayor and Common Council of the City of San Bernardino believe it to be in the best interest of the said 16 City that said parcel of real property be sold, leased, or 17 leased with an option to purchase at the highest price obtainable in the open market, 18 19 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Notice is hereby given inviting competitive 22 bid proposals for the sale of the following real property, more 23 particularly described in and subject to the terms of Specifica- 24 tion No. 5074 on file in the Office of the Director of Public 25 Works/City Engineer, Real Property Section, City Hall, 300 North 26 "0" Street, San Bernardino, California, and generally described 27 as follows: 28 "A rectangular parcel of land totalling approxi- 1 2 3 4 5 6 7 8 9 10 11 12 r mate~y ~7,535 square feet containing a vacant ~ibrary type bui~ding of approximate~y 2,435 square feet and ~ocated at the southwest corner of Home Avenue and Muscott Street in the City of S(!.n Bernardino." SECTION 2. The minimum acceptab~e bid for said rea~ property to be so~d, ~eased, or ~eased with an option to purchase I i I I I (b) In the a~ternative, a ~ease with an option to purchase!, I I by said City is estab~ished as fo~~ows: (a) $50,000.00 cash selling price, or in a form satisfactory to the City. The terms for the option to purchase shall include a provision that 10% of the total selling price, with $50,000.00 as the minimum selling price, be paid to the City at the commencement of the lease term as and for con- 13 sideration for the option to purchase. The lease shall be for a 14 term of 15 years. Lease payments shall be paid in advance at the 15 rate of $300.00 per month. At the end of the 15 year lease term, 16 if the ~essee exercises the option to purchase, he shall be 17 credited toward the purchase price from monthly lease payments 18 already paid at the rate of $250.00 per month for the full 15 yearl 19 term, in addition to the 10% of the purchase price paid to the 20 City for the option to purchase. If at the expiration of the 15 24 25 26 27 28 21 22 23 year lease term, the lessee declines to exercise the option to purchase, or at any time prior to the expiration of the lease term that the lessee shall breach the terms of the agreement, the ~O% paid to the City for the option to purchase and a~l lease payments made to the City, shall not be refundable to the lessee. Lessee shall pay a~l taxes upon the property during the terms of the lease; or (c) In the a~ternative, a lease in form satisfactory to -2- I: ~- 1 the City for a lease term of five years, or more, providing for 2 lease payments at a minimum rate of three thousand dollars 3 II ($3,000.00), or more, per year. 4 SECTION 3. Each competitive bid or proposal shall be 5 6 delivered to the Office of the City Administrator, City Hall, 300 North "0" Street, San Bernardino, California, on or before the 7 hour of 2:00 p.m., Tuesday, January 31, 1978, at which time said 8 sealed bids or proposals shall be opened and publicly declared. II The highest of said bids or proposals shall be submitted to the I II Mayor and Common Council at the hour of 2:00 p.m., at the Council i Chambers, City Hall, 300 North "0" Street, San Bernardino, 9 10 11 12 California, at their next regularly scheduled meeting being Monday, February 6, 1978, at which time said Mayor and Common Council may receive oral bids, in $250.00 increments, provided 13 14 15 that the oral bids shall be an amount not less than the highest 16 bid plus $250.00 and accompanied by cash or check in an amount of 17 ! $2,500.00, non-refundable, if bidder receives the award; and oral bidding for the sale of property shall be continued in the same manner and bids received orally until all bidding shall have been 18 19 20 i completed. In the alternative, with respect to the lease of the 21 property, in six hundred dollar ($600.00) increments per year 22 lease payments; provided that the oral bids for the lease of the 23 " property shall be in an amount not less than the highest bid plus I a six hundred dollar ($600.00) increment per year for the proposed , Ii i I, I' Ii I 24 25 lease term and accompanied by cash or check in the amount of 26 $3,000.00, non-refundable, if the bidder receives the award, and 27 oral bidding for the lease of the property shall be continued in 28 the same manner and bids received orally until all bidding shall -3- - r ; 1 have been completed. In respect to the alternative of a lease 2 with an option to purchase, oral bids for the full purchase price 3 may be made in $250.00 increments, provided that the oral bids 4 i! shall be in an amount not less than the highest bid plus $250.00 , I 5 6 7 8 9 10 11 12 13 14 15 16 17 I 18 I' 19 I I i 20 I 21 22 23 24 25 26 27 28 and accompanied by cash or check in an amount of 10% of the purchase price as payment for the option to purchase, non-refundab e if the bidder receives the award. Oral bidding for the lease with an option to purchase shall be continued in the same manner and bids received orally until all bidding shall have been completed. The Mayor and Common Council of the City of San Bernardino reserve the right to make, in their sole discretion, a determina- tion as to whether the property shall be sold, leased, or leased with an option to purchase. SECTION 4. Attention of bidders is directed to "Descriptio of Property, Requirement of Bidders, Requirements of Sale and Official Bid Form" which may be obtained at the office of the Director of Public Works/City Engineer, Real Property Section, Room 405, City Hall, 300 North "D" Street, San Bernardino, California. SECTION 5. All written bids or proposals shall be signed, sealed and delivered. No bid proposal which fails to contain a sum equal to or. greater than the minimum acceptable bid price established herein or which is filed at a later time or at a different place or with a different person than required shall be valid or considered for award unless there is substantial com- pliance herewith as determined by the City Administrator in his sole discretion; and the Mayor and Common Council reserve the right to reject any or all bid proposals for any reason. -4- 1 SECTION 6. This resolution shall be posted on or near the 2 door of the Council Chamber; City Hall, San Bernardino, California, 3 and a Notice Inviting Bids for the sale, lease or lease with an 4 option to purchase the property shall be published not less than 5 once, at least 10 days prior to the date for filing bid proposals 6 with the City Administrator in the San Bernardino Sun Telegram, a 7 newspaper of general circulation published and circulated in said 8 City. 9 SECTION 7.
