HomeMy WebLinkAbout13119 ! 1 RESOLUTION NO. 1.3 //1 2 RESIOLUTION OF THE CITY OF SAN BERNARDINO GIVING NOTICE INVITING COMPETITIVE BIDS FOR THE SALE, LEASE, OR LEASE WITH AN 3 OPtION TO PURCHASE, OF CERTAIN REAL PROPERTY OWNED BY SAID CITY, GENERALLY LOCATED AT 269 SOUTH MT. VERNON AVENUE IN SAID CITY, 4 ESTABLLSHING A MINIMUM SALE PRICE FOR SAID PROPERTY, OR, IN THE ALTERNATIVE, MINIMUM LEASE PROVISIONS SUCH AS PAYMENTS, TERM, ETC.; 5 AND REPEALING RESOLUTION NO. 13084. 6. WHEREAS, the City of San Bernardino, a municipal corporatio , 7 is the owner of the hereinafter described parcel of real property 8 situated in the City of San Bernardino, State of California; and 9 WHEREAS, the Mayor and Common Council of the City of San 10 Bernardino find and determine that there is no further need or 11 necessity for the use of said real property; and 12 WHEREAS, the Mayor and Common Council of the City of San 13 Bernardino believe it to be in the best interest'of the said City 14 that said parcel of real property be sold, leased, or leased 15 with an option to purchase at the highest price obtainable in the 16 open market, 17 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 18 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 19 SECTION 1. Notice is hereby given inviting competitive 20 bid proposals for the sale of the following real property, more 21 particularly described in and subject to the terms of Specifica- tion No. 4859 on file in the Office of the Director of Public 22 23 Works/City Engineer, Real Property Section, City Hall, 300 North 24 "D" Street, San Bernardino, California, and generally described as foltows: 25 26 "An irregular shaped rect.ngular parcel of land totalling approximately LI-",500 square feet con- taining an old fire station building of approxi- mately 2986 square feet and located at 269 South Mt. The minimum acceptable bid for said real property to be sold, leased, or leased with an option to purchase by said City is established as follows: (a) $20,000 cash selling price; or (b) In the alternative, a lease with an option to purchase" in a form satisfactory to the City. The terms for the option to purchase shall include a provision that 10% of the total selling price, with $20,000 as the minimum selling price, be paid to the ! City at the commencement of the lease term as and for consideratior for the option to purchase. The lease shall be for a term of 12 i years. Lease payments shall be paid in advance at the rate of $150.00 per month. At the end of the 12 year lease term, if the lessee exercises the option to purchase, he shall be credited I I 'dl pal. i toward the purchase price from monthly lease payments already at the rate of $125.00 per month for the full 12 year term, in addition to the 10% of the purchase price paid to the City for the option to purchase. If at the expiration of the 12 year lease term, the lessee declines to exercise the option to purchase, or at any time prior to the expiration of the lease term that the lessee shall breach the terms of the agreement, the 10% paid to the City for the option to purchase and all lease payments made to the City, shall not be refundable to the lessee. Lessee shall pay all taxes upon the property during the terms of the lease; or (c) In the alternative, a lease in form satisfactory to the City for a lease term of five years, or more, providing for lease payments at a minimum rate of eighteen hundred dollars ($1,800.00), or more, per year. SECTION 3. Each competitive bid or proposal shall be -2- , .1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 delivered to the Office of the City Administrator, City Hall, 300 North "D" street, San Bernardino, California, on or before the hour of 2:00 p.m., Tuesday, January 31, 1978, at which time said sealed bids or. proposals shall be opened and publicly declared. The highest of said bids or proposals shall be submitted to the Mayor and Common Council at the hour of 2:00 p.m., at the Council Chambers, City Hall, 300 North "D" street, San Bernardino, California, at their next regularly scheduled meeting being Monday, February 6, 1978, at which time said Mayor and Common Council may receive oral bids, in $250.00 increments, provided that the oral bids shall be an amount not less than the highest bid plus $250.00 and accompanied by cash or check in an amount of $2,500.00, non-refundable if the bidder receives the award, and oral bidding for the sale of property shall be continued in the same manner and bids received orally until all bidding shall have been completed. In the alternative, with respect to the lease of the property, in three hundred sixty dollar ($360.00) incremen s per year lease payments, provided that the oral bids for the leas of the property shall be in an amount not less than the highest bid plus a three hundred sixty dollar ($360.00) increment per year for the proposed lease term and accompanied by cash or check in the amount of $1,800.00, non-refundable if the bidder receives the award, and oral bidding for the lease of the property shall be continued in the same manner and bids received orally until all bidding shall have been completed. In respect to the alternative .of a lease with an option to purchase, oral bids for the full purchase price may be made in $250.00 increments, pro- vided that the oral bids shall be in an amount not less than the -3- II - 1 highest bid plus $250.00 and accompanied by cash or check in an 2 amount of 10% of the purchase price as payment for the option to 3 purchase, non-refundable if the bidder receives the award. Oral 4 bidding for the lease with an option to purchase shall be continued 5 in the same manner and bids received orally until all bidding shal~ 6 have been completed. I 7 The Mayor and Common Council of the City of San Bernardino 8 reserve the right to make, in their sole discretion, a determina- 9 tion as to whether the property shall be sold, leased, or leased 10 with an option to purchase. SECTION 4. Attention of bidders is directed to "Descrip- 12 tion of Property, Requirements of Bidders, Requirements of Sale 11 13 and the Official Bid Form" which may be obtained at the Office of 14 the Director of Public Works/City Engineer, Real Property Section, 15 Room 405, City Hall, 300 North "D" Street, San Bernardino, 16 California. 17 SECTION 5. All written bids or proposals shall be signed, 18 sealed and delivered. No bid proposal which fails to contain a 19 sum equal to or. greater than the minimum acceptable bid price established herein or which is filed at a later time or at a 20 21 different place or with a different person than required shall be 22 valid or considered for award unless there is substantial com- 23 pliance herewith as determined by ~he City Administrator in his i sole discretion; and the Mayor and Common Council reserve the 24 25 I right to reject any or all bid proposals for any reason. I SECTION 6. SECTION 7. Resolution No. 13084 is hereby repealed.
