HomeMy WebLinkAbout12803 1 /;:<j'tJ~ RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO OPPOSING ASSEMBLY , BILL NO. 155 AND SENATE BILL NO. 555 RELATING TO WORKERS' ; COMPENSATION BENEFIT APPORTIONMENT. i 3 4 I , 'I '! passed WHEREAS, Assembly Bill No. 155 has been introduced and by the General Assembly of the California Legislature; and 5 6 7 i! Ii WHEREAS, said Assembly Bill does, in effect, terminate I! apportionment of benefits to prior workers' compensation insurance I! I' carriers, and by the year 1981 reduces apportionment to a period 8 9 i , i of one year immediately preceding the date of injury; and II ! WHEREAS, Senate Bill No. 555 has been introduced in the 10 11 State Senate of the California Legislature; and 12 WHEREAS, said Senate Bill provides that liability for 13 occupational diseases or cumulative injuries will be limited to 14 those employers employing claimant employees during a period of 15 one year immediately preceding the date of injury; and 16 WHEREAS, both Assembly Bill No. 155 and Senate Bill No. 555 17 will result in a multi-million dollar reduction of liability for 18 the insurance industry at the expense of public entities, and 19 WHEREAS, public entities have in the past paid high 20 insurance premiums to the insurance industry for protection for 21 workers' compensation liabilities; and 22 WHEREAS, the premiums paid over the years to the insurance 23 industry were paid with the understanding and assurance that all 24 workers' compensation liabilities accruing to the employer during 25 that period would be covered and indemnified; and 26 WHEREAS, neither of the aforesaid bills contained any 27 positive provisions attempting to limit or restrict the current 28 rapid expansion of the scope of liability in the area of workers' .' . 1 .11 I , " i: I, ii compensation; alld II WHE:REAS, the said bills merely transfer an existent burden , II from the insurance industry to local taxpayers, Ii NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON Ii COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: I Ii , II san Bernardino do hereby oppose the passage and adoption of " "Assembly Bill No. 155 and Senate Bill No. 555. 2 3 4 5 6 7 8 SECTION 1.
