HomeMy WebLinkAbout12813 -~! > 1 RESOLUTION NO. /b<,f/$ 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE COUNTY OF RIVERSIDE RELATING 3 TO THE ON-THE-JOB TRAINING PROGRAM FOR A PORTION OF THE 1976-1977 FISCAL YEAR WHICH SAID AGREEMENT SUCCEEDS TO AND REPLACES A PRIOR 4 AGREEMENT AUTHORIZED BY SAID RESOLUTION NO. 12618. 5 WHEREAS, the Mayor and Common Counci~ by Resolution No. 6 12618, authorizing the execution of an agreement, dated November 7 10, 1976, with the County of Riverside relating to the On-The- 8 Job Training Program for a portion of the 1976-1977 fiscal year; 9 and 10 WHEREAS, it is desired that said agreement with the County 11 of Riverside be modified and replaced by the agreement attached 12 hereto, marked Exhibit "A" and incorporated herein by reference 13 in order to provide for modification of the On-The-Job Training 14 Program as set forth in said Exhibit "A"; and 15 WHEREAS, it is the intention of the parties hereto that 16 said Exhibit "A" attached hereto be complementary and succeed to 17 the provisions of the prior agreement with the County of Riversid 18 relating to the On-The-Job Training Program, 19 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 20 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 21 SECTION 1. The Mayor of the City of San Bernardino is 22 authorized and directed to execute on behalf of said City that 23 agreement with the County of Riverside relating to the On-The- 24 Job Training Program for a portion of the 1976-1977 fiscal 25 year, a copy of which is attached hereto, marked Exhibit "A" and 26 incorporated herein by reference as fully as though set forth 27 at length. Goal: The goal of the Riverside County Manpower Division is to develop and implement a program for the baildicapped individual based on the assessed needs of the baildi- capped in Riverside County. B. Objectives: -- The Objectives are; to en ploy 19 handicapped individuals in CE:I'A PUBLIC OJT jOb positions with governmental agencies; to transition approximately 50% of those ; .'76 - 6 - I B. PROGRAM DESIGN (Continued) individuals into unsubsidized employment; and to develop such pennanent job posi- tions whereby the handicapped person can achieve econOOlic self-sufficiency. All program applicants will be referred to the Riverside County Manpower Division for program placanent by the State of California Department of Rehabilitation and various Veteran organizations. Also, we will require a current medical file be provided with each applicant who is referred. Finally, we will require all appli- cants be referred equitably frcxn throughout the County of Riverside. B. Fran the referrals, the Manpower Division will develop a CErA eligibility list for placanent in a CErA OJT jOb position, (priority will be given to the disabled veteran) . Concomitantly, each eligible applicant will be counseled as to their job interest and capabilities. Once this process is canpleted, each applicant will then be placed, based on their interests and capabilities conjunctionally with the job duties of an available PUBLIC OJT position. 6. This program will be closely linked with the State Department of Rehabilitation, as well as various Veteran organizations. These agencies will predaninantly be used to facilitate the handicapped persons in maintaining CErA employnEnt and also in obtain- ing future employment status through services provided. 7. Accounting: a) Data is collected frcxn the time cards and EhIploying Agencies request for reirnbursanent sheets.. . b) Data is then sumnarized in various internal record-:-keeping journals. c) Data processing controls include: Computer print-out General Ledgers, Finan- cial Statanents, and monthly canparisons of budget expenditures to actual ~enses. . d) Participant characteristics data is sumnarized frcxn the M-l and entered on a data control sheet. The following procedure includes complaints from participants, applicants, employers of program agentsl operators, and other persons not directly involved with aCETA program. It must be noted, however, that decisions made by I~ffi will be based only upon the Act authorizing the program, Federal Regulations or Contractual Agreements. Therefore, the complainant should try to cite a specific possible violation in the complaint. If the complainant is not sure that a violation exists, the IMA will provide assistance in the determination. All complaints, oral or written, will be accepted by the I~~ from any complainant or his/her representative. If the complaint is from a participant, he/she must have atte~pted to reach an agreement with the progra~ agent or operator before the IMA will take any action. All complaints not sub~itted in \rriting must be reduced to writing and the IMA will, if necessary, assist in the composition of the complaint. Within five days after receiving the complaint, the IMA will make a preliminary investigation of the complaint and arrange an informal conference with the complainant. If the complaint was not resolved at the informal conference, an informal hearing will be scheduled within 5 days, to include the complainant, a representative from the involved program agent or operator, and the IMA. If the complaint continues to be unresolved, the complainant may, within 5 days after the informal hearing, request another hearing before an impartial hearing officer. Upon receipt of the request, the IMA will schedule a hearing not later than 10 working days after the request. A written notice of hearing will be given to the appropriate persons nol~ter that 5 days prior 'to the hearing. The Hearing Officer will submit in writing the decision and reasons for the decision to the IMA within 5 working days after the hearing. The decision will be forwarded to the complainant and also presented to the I~~ Executive Board for approval. If the complainant feels an unsati~factory decision was reached, he may submit a notarized formal complaint to the Assistant Regional Director of Manpower, Department of Labor. The formal complaint must be submitted no later than 30 days after'the final decision and Executive Board approval. The IMA will assist the complainant by providing information regarding the address of the appropriate Assistant Regional Director of Manpower, the content of the formal complaint, and Department of Labor procedures for resolving complaints. It will comply with the requirements of the Comprehensive Employment and Training Act (CETA) of 1973, as amended (P.L. 93-203, 87 Stat. 839 and P.L. 93-567, 8B Stat. 1845), hereinafter referred to as the Act, and with the regulations and policies promulgated there- under; and b. It ~1ill comply ~1ith m~B Circular number A-95 and Federal Management Circulars (mC) 74-4 and 74-7, as those circulars relate to functions such as the utilization of funds, the operations of programs, and maintenance of records, books, accounts, and other documents under the Act. 2. The Subgrantee further assures and certifies that if the regu- lations promulgated pursuant to the Act are amended or revised, it shall comply \~ith them or notify the Inland ;'1anpower Association (rr'IA), within 30 days after promulgation of the amendments or revision that it cannot so conform, so that the IMA may take appropriate action including term- ination, if necessary. 3. In addition to the requirements of 1 and 2 above and consistent with the regulations issued pursuant to the Act, the Subgrantee makes the following further assurances and certifications: a. It possesses legal authority to apply for the Subgrant; that a resolution, motion, or si~i1ar action has been duly adopted or passed as an official act of the Subgrantee's governing body, authorizing the filing of the Subgrant, including all understandings and assurances con- tained therein, and directing and authorizing the person identified as the official representative of the Subgrantee to act in connection with the Subgrant and to provide such additional information as may be requir- ed (sections 102 (a); 701 (a) (9) and (10)). " b. It will comply with Title VI of the Civil Rights Act of 1964, (P.L. 88-352), and in accordance with Title VI of that Act no person in the United States shall on the grounds of race, color, sex, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which the Subgrantee receives Federal financial assistance and will imnlediate1y take any measures necessary to effectuate this agreement. c. It will give the Department of Labor and the Comptroller General through any authorized representative the access to and the right to examine all records, books, papers, or documents related to the Subgrant (section 713 (2)). j. Participants in the program will not be employed on the con- struction, operation, or maintenance of that part of any facility \'Ihich is used for religious instruction or worship (section 703 (3)). k. Appropriate standards for health and safety in work and train- ing situations will be maintained ,(section 703 (5)). 1. Conditions of employment or training will be appropriate and reasonable with regard to the type of work, the geographical region and the proficiency of the applicant (section 703 (4)). m. Provisions of workmen's compensation protection to partici- pants in on-the-job training, work experience, or public service employment programs under the Act at the same level and to the same extent as other employees of the employer who are covered by a State or industry workmen's compensation statute; and pl'ovision of l'lorkmen's compensation insurance or medical and accident insurance for injury or disease resulting from their participation to those individuals engaged in any program activity under the Act, i.e., l'lork experience, on-the-job training, public service employment, classroom training, services to participants, and other activities, where , . others similarly engaged are not covered by an applicable workmen's com- pensation statute (section 703 (6) and 208 (4)). n. The program will not result in the displacement of employed workerScor impair existing contracts for services or result in the substi- tution of Federal funds for other funds in connection with work that 1'/Ou1d otherwise be performed (section 703 (7)). Training will not be for any occupations which require less than two weeks of pre-e~p10yment training, unless immediate employment opportunities are available in that occupation (section 703 (8)). p. Training and related services ~till, to the extent practicable, be consistent with every individual's fullest capabilities and lead to em- ployment opportunities which will enable participants to become economically self-sufficient (section 703 (g) and 105 (a) (6)). q. Institutional skill training and training on the job shall only be for occupations in which the Secretary or the prime sponsor has determined there is reasonable expectation for employment (section 703 (10)). r. CETA funds will, to the extent practicable, be used to supple- ment, rather than supplant, the level of funds that would otherwise be avail- able for the planning and administration of programs under the Subgrant (section 703 (11)). s;' It will submit reports as required by the Secretary and I.till maintain records and provide access to them as necessary for the Secretary's review to assure that fonds are being expended in accordance with the purposes and provisions of the Act, including the maintenance of records to assist the Secretary in determining the extent to which the program meets the special needs of disadvantaged, chronically unemployed, and low income persons for meaningful employment opportunities (section 703 (12) and 311 (c)). t. The program will, to the maximum extent feasible, contribute to the occupational development or upward mobility of individual participants (section 703 (13)). ~. The program has adeguate administrative and accounting controls, personnel standards, evaluation procedures, availability of in-service train- ing and technical assistance programs, and other policies as may be necessal'y to promote the effective use of funds (section 703 (14)). v. The program makes appropriate provisions for the manpower needs of youth in the area served (section 703 (15), and will assure that:' (1) Individuals receiving training on the job shall be compen- sated by the employer at such rates, including periodic increases, as may be ..< '... deemed reasonable under regulations prescribed by the Secretary, but in no event at a rate less than that specified in Section 6 (a) (l) of the Fair labor Standards Act of 1938 or, if higher, under the applicable State or 'local minimum wage law. Wages in the Commonwealth of Puerto Rico, the Virgin-:Islands, American Samoa, and the Trust Territory of the Pacific Islands shall be consistent ~tith the Federal, State, or local la~1 othenlise applicable (section 111 (b)). w. It will comply with the labor standard requirements set out in section 706 of the Act. x. Services and activities provided under this Subgrant will be administered by or under the supervision of the Prime Sponsor (section 105 (a) (b) and 205 (c) (1)). y. No funds made available under the Subgrant shall be used for lobbying activities in violation of 18 USCA 1913. B. Additional Assurances for Titl e I Programs In carrying out programs under Title I of the Act, the Subgrantee assures and certifies that: 1. Manpower services, including job development, will be provided to those most in need of them including low income persons and persons of limited English- speakin9 ability (section 105 (a) (d)). 2. Programs of institutional skill training shall 'be designed for occupa- tions in which skill shortages exist (section 105 (a) (6)). 3. The Subgrant meets all the requirements of section 105 (a) and the Sub- grantee will comply with all provisions of the Act (section 105 (b)). . 4. It will make such arrangements as are prescribed by regulation to assist the Secretary in carrying out his responsibilities under sections 105 and 108 of the Act (section 105 (a) (7)). 5. 'Special consideration will be given to the needs of eligible disabled veterans, special veterans, and veterans who served in the Armed FOl'ces and \'iho received other than a dishonorable discharge within four years before theda:e of their application. The Subgrantee in selecting participants for programs funded under Title I of the Act, shall take into consideration the extent th~t such veterans are available in the area. Specific effort should be made to de- velope appropriate full or part-time opportunities for such veterans. The Sub- grantee should utilize the assistance of the State and local veterans emplo~"ent service representative in formulating its program objectives. On a continuing and timely basis, information on job vacancies and training opportunities funded under Title I of the Act shall be provided to the State and local veterans e"l- ployment service representative for the pUl'pose of disseminating information to eligible veterans (section 104 (b) of Emergency Jobs and UnemploYlnent Assistance Act of 1974). . ,.'. .. .- 6. Special Certification for State Subgrantees. A State Subgrantee further assures and certifies that it will comply with the requirements and proyisions of Sections 106 and 107 of the Act. 7. The Inland r1anpo~/er Association's "lanagement Information System will be utilized for the development, maintenance, and reporting of all required Subgrant Program Data. Subgrantee will submit quarterly reports due no later than the twentieth (20th) day after the close of each quarter to include the IMA Quarterly Program Summary, the Quarterly Summary of Participant Characteristics, the Quarterly Financial Status Summary, and other supplemental reports as required. 8. All costs incurred under the Subgrant shall be in accordance with the H1A's FY'77 Schedule of Allowable Costs. Salaries for Project Staff charging less than 100% of time to the project will be prorated in accord- ance with the above. All costs in excess of maximum costs allowable per IMA schedule and incorporated budget will require prior justification and approval. In no case will pre-subgrant costs be reimbursed. :.. 9. Approval for the expenditure of Subgrant funds for consultant fees will be obtained from the Ii.1A prior to cOlmnitment for such services. 10. It will adhere to special limitations on participant selection as described in the Federal Register, Para. 98.23, pertaining to political activities and the Hatch Act. 11. It.wi1l comply with requirements of the law and Employment and Training Administration, Department of Labor, regarding the obtaining of employer identification-account nu,:bers; collection, payment, deposit and reporting of Federal, State, and local taxes. Work Experience Subgrantees will withhold Social Security or its equivalent and income taxes for all . program enrollees if required for regular employees of the agency. 12. Assure that no funds will be used to hire eny person to fill a job opening created by the action of an employer in laying off or terminating the employment of any other regular employee not supported under the Act.in anticipation of filling the vacancy so created by hiring an employee to be supported under the Act (Section 905 (c) (8)). 13. It will maintain a separate account for all funds received under the Subgrant in addition to the r.1aintenance of separate records, source documents and other account books as required. The Subgrantee further assures that all recOl"ds, documents and books pel"taining to this Subgrant will be available for inspection by authorized Inland ~lanpOl~er Association personnel. All such records, documents and books shall be retained by the Subgrantee for a period of three (3) years subsequent to. the termination of the Subgrant. ~ .. . .... ....~ " , . 14. The Subgrantee assumes the fiscal and financial responsibility for exceeding cost by line item or cost category. No requests for Sub- grant modifications will be honored by the IMA if such requests represent expenses or obligations incurred prior to the Subgrantee receiving written approval from IMA. Post Subgrant costs will not be paid unless previously approved by I11A. 15. No less than 84 percent of funds will be used for enrollee wages, fringe benefits, allowances, training and services, and that administrative costs will not exceed 16% of total Subgrant budget unless previously approved by H1A. 16. Subcontractino: Subcontracts for various services may be entered into by Subgrantee. All subcontracts require prior approval by IMA except negotiated fixed price On-the-Job Training subcontracts by Subgrantee con- tracted to deliver OJT services. These shall be prepared using IMA standard OJT forms and vii 11 not requi re prior approva 1. by the H.1A Di rector, but I"Ii 11 be reviewed. Subgrantee is required to seek competition in the solicitation of subcontracts according to procedures specified in the Federal Rules and Regulations. Further, Subgrantee shall make positive efforts to utilize small business and minority business enterprises in subcontracting. 17. Title of Property: a. Title to all property acquired by Subgrantee, including acquisition through lease-purchase agreement, for the cost of which Sub- grantee is to be reimbursed in \'ihole or in part under this agreement, shall immediately vest in H1A upon: (1) Delivery of such property by the vendor. (2) Issuance for use of such property in the performance of this agreement. (3) Commencement of processing or use of such property in the performance of this agreement; or (4) Reimbursement of cost thereof by the IMA, whichever first occurs. b. Prior to initial disbursement of funds to the Subgrantee the Inland-~anpower Association shall receive a statement from the Subgrantee's Chief Fiscal Officer or its insurer assuring that all persons handling funds received or disbursed under the Subgrant are covered by fidelity bond in an amount of not less than $20,000. The Subgrantee shall ir.~ediately notify the IMA Director if the bond is cancelled or reduced. In that event IMA shall not make any further disburse;;Jents to the Subgrantee until is is as- sured that coverage has been obtained. The Subgrantee further agrees to assume full responsibility for liability in excess of $20,000. 19. Hold Harmless a. The subgrantee agrees to indemnify and save the Ii-1A, and all the agents and employees, harmless from any and all liabilities, claims, damages, or injuries to any person or property including injury to Subgrantee employees, and all expenses of investigation and defending against same including attorney, court and/or legal fees. (1) Arising from or connected with performance or failure to perform any work or other obligations of this agreement; (2) Cause or claim to be caused by the independent status of Subgrantee, his agent~ or employees; (3) The concurrent acts of Subgrantee, or their agents or employees. 20. . . Performance Standards The Subgrantee agrees that, should the Subgrantee's actual performance with respect to either planned expenditure rates as stated on the Cumulative Expenditure Plan and the Budget Statement or planned program objectives in- cluding significant segments as stated on the Cumulative Monthly Program Plan deviate 15: or more, the Inland Manpower Association will have the prerogative of unilaterally modifying the Subgrant. Subgrantee further agrees that no participant vlill be enrolled in any activity under this Subgrant during the last sixty (60) days of this agreement unless the participant can successfully complete training as specified by incorporated statement rerein. 23. Suspension or Termination of Subgrant. a. Should the Inland Manpower Association determine that suspension or termination of the Subgrant is required, the Inland Manpower Association shall forv/ard a written notice of such determination to the Subgrantee four- teen (14) days prior to any initiation by the Inland Manpower Association of its termination procedures. Such notice shall contain a detailed statement of facts upon which the Inland 11anpower Association's recommendation is based and shall set a time and place to conduct a formal meeting with the Subgrantee to discuss whether termination procedures will be initiated. If it shall have been determined that suspension of funds is necessary, the Inland fl,anpC'.'ler Association shall have the authority to suspend funds as may be deemed appropri- ate until corrections are made in a manner satisfactory to the Inland Manpower Association. In no event shall the time allowed for correction exceed thirty (30) days unless the Director agrees to a continuance. The Director may sus- pend funds for. a peri od of not more than forty- fi ve (45) days. I f it shall have been determined that termination procedures are necessary, the Director shall recommend tel1Tlination to the Executive Board for approval. If the Boal'd approves termination, the agreement shall be terminated upon seven (7) days written notice to the Subgrantee. b. The Subgrant may be terminated or funds suspended in whole or in part for cause. Cause shall include the following: (1) Failure of the Subgrantee to comply in any substantial or material respect with either the terms or conditions of this agreement. (2) The Grant to the Inland Manpower Association from the Department of Labor for this program is terminated, sus- pended, or reduced. The Inland ManpOl'/er Association may also withhold payment of any unearned portion of the Sub- grant if the Subgrantee is unable or unwilling to accept any additional conditions that may be required by la\./, by executive order, by regulations, or by other policy announced by the Department of Labor at any time. c. Upon termination of the Subgrant, the Subgrantee will remit any unencumbered balance of payments previ ous ly recei ved as determi ned by the Inland Manpower Association to be due it. Association in accepting any such amount shall not constitute a waiver of any claim which the Inland Manpower Association may otherwise have arising out of thfs agreement. d. Upon suspension of funds, the Subgrantee agrees not to expend any funds related to, or connected with, any area of conflict from which the Inland Manpower Association has determined that suspension of funds is necessary. 24. The Subgrantee shall not assign this agreement or any monies due or to become due hereunder except as specified in the terms of this agreement, with- out having first obtained the written consent of IMA. 25. IMA will not be obligated or liable hereunder to any party other than the Subgrantee. Subgrantee shall so notify all subcontractors and agents. 26. The Subgrantee will comply ~Iith the Clean Air Act and the Federal Water Pollution Control Act as related to the use of facilities which are on the Environmental Protection Agency's List of Violating Facilities. 27. The Subgrantee understands and agrees that all Gross Income earned by the Subgrant supported activities during the period of this agreement shall be recorded and identified as such by specific and separate account. All expenses incurred in the generation of this income that is not a part of this Subgrant may be deducted from the Gross Income to determine if any program income exists. Program income shall be deducted from the total program costs for the purpose of determining the net costs on \'Ihich the Inland 11anpo~ler Association share of costs ~/ill be based. The Subgrantee further agrees to provide access to any authorized representative of the Inland I'ianpoi'ler Jl,ssociation for the examina- tion'of any records, books, or documents related to the determination of Program income in any manner.
