The Mayor of the City of San Bernardino is 7 authorized and directed to execute on behalf of said City an 8 9 agreement with the City of Rialto which authorizes mutual aid in fire protection for designated adjacent incorporated areas, a copy of which is attached hereto, marked Exhibit "I" and incorporated herein by reference as fully as though set forth at length. I , I I 1 I 2 i 3 ,I 4 I 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A G R E E MEN T THIS AGREEMENT is made and entered into this 7t:h day of , 1977, by and between the CITY OF SAN FEBRUARY BERNARDINO, a municipal corporation, hereinafter referred to as "San Bernardino", and the CITY OF RIALTO, a municipal corporation hereinafter referred to as "Rialto". WIT N E SSE T H: WHEREAS, the parties to the Agreement provide fire protection and rescue services within their respective territorial limits; and WHEREAS, certain areas of San Bernardino and Rialto are immediately adjacent to each other; and WHEREAS, it is mutually advantageous to both San Bernardin and Rialto to jointly respond to fires in these areas; and WHEREAS, this joint response is authorized by California State Government Code Sections 5001 and 55632, NOW, THEREFORE, it is hereby agreed by and between each and all of the parties hereto, as follows: 1. A joint response zone shall be established as encompassed by the red line on the map marked Exhibit "A" and attached hereto and incorporated herein by reference. Both San Bernardino and Rialto are signatories of "The California Disaster and Civil Defense Master Mutual Aid Agreement", as well as an East San Bernardino Valley Mutual Aid Agreement, effective June 12, 1972. Nothing in this present contract should be construed to detract from or otherwise interfere with these previous agreements in any way. 2. The Chief Engineer of the San Bernardino City Fire 1 Department and the Fire Chief of the Rialto City Fire Department 2 be, and they are hereby, directed to develop a running card 3 system for response to fires in this joint response zone. 4 Within this zone San Bernardino shall retain prime responsibility 5 and authority for fires within the corporate boundaries of 6 San Bernardino,and Rialto shall retain prime responsibility and 7 authority for fires within the corporate boundaries of Rialto. 8 3. The Chief Engineer of the San Bernardino City Fire 9 Department is hereby directed to order response pursuant to said 10 running card system to help control fires in the Rialto portion 11 of the joint response zone. The San Bernardino City Fire 12 Companies shall function under the operational direction of the 13 senior officer of the Rialto Fire Department present at the 14 scene in such areas. 15 4. The Fire Chief of Rialto is hereby directed to order 16 response pursuant to said running card system to help control 17 fires in the San Bernardino portion of the joint response zone. 18 The Rialto Fire Companies shall function under the operational 19 direction of the senior officer of the San Bernardino City 20 Department present at the scene. 21 5. San Bernardino, through its Fire Department Chief 22 Engineer, and Rialto, through its Fire Chief, may alter the 23 boundary lines of said joint response zone or running assignments 24 as conditions change. No modification of this Agreement shall be 25 required when changes in the boundary lines are made; however, 26 a map shall be attached to this Agreement showing the revised 27 boundary lines and signed by the officers authorized by this 28 Agreement to approve such changes. -2- II . q ~ I ~ " 1 Ii I I 2 and 6. San Bernardino shall conduct all fire investigations have responsibility for fire prevention in the San Bernardino 3 portion of the joint response zone,and Rialto shall conduct all 4 fire investigations and have responsibility for fire prevention 5 in the Rialto portion of the zone. 7. No party to this Agreement shall be required to pay 7 any compensation to the other party to this Agreement for 6 8 ordinary services rendered hereunder; the mutual advantage and 9 protection afforded by this Agreement being considered adequate 10 compensation to all parties. 11 8. San Bernardino agrees to indemnify and hold harmless 12 Rialto and its agents and employees from and against all claims, 13 damages, losses and expenses arising out of performance by San 14 Bernardino of the work herein detailed where such damages, 15 losses and expenses are caused in whole or in part by San 16 Bernardino's negligent act or omission, or that of its agents 17 and employees or that of anyone employed by them or for whose 18 acts San Bernardino may be liable. 19 9. Rialto agrees to indemnify and hold harmless San 20 Bernardino and its agents and employees from and against all 21 claims, damages, losses and expenses arising out of performance 22 by Rialto of the work herein detailed where such damages, 23 losses, and expenses are caused, in whole or in part by Rialto's 24 negligent act or omissions, or that of its agents and employees 25 or that of anyone employed by them or for whose acts the 26 Authority may be liable. 27 10. This Agreement shall become effective from the date 28 this Agreement is fully executed and shall continue in full -3- 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 \- 1 force and effect for succeeding calendar years unless terminated 2 by either party after thirty (30) days written notice to the. 3 other.
